State Sponsored 190 and 491 visa programs to reopen in October 2020

The State Sponsored 190 and 491 visa programs are set to reopen after the Federal Budget is handed down on 6 October 2020. At that time, the State and Territory Governments will have received their nomination allocations for the remainder of the 2020 – 2021 financial year.

The number of nominations offered will limited and only given to applicants who possess the critical skills required to maintain the supply of essential goods and services in Australia and to support the delivery of services in sectors critical to Australia’s economic recovery.

Due to the border closures a priority will be given to onshore applicants. Applicants offered 190 or 491 State Sponsorship will need to be working in the following industries:

Medical
Building – critical infrastructure
Telecommunications
Engineering and Mining
Supply chain logistics
Agricultural technology
Food production
Maritime industry
Financial technology
Large scale manufacturing
Film and television production
Emerging technology

Each State and Territory Government will be releasing their own occupation lists and eligibility criteria in the coming months.

Invitations for State Sponsored 190 and 491 visas will only be offered to a very limited number of applicants. Onshore applicants are encouraged to explore all other visa options including employer sponsorship, student, family or tourist visas to extend their stay in Australia. At this stage, relying on state sponsorship is not a strong migration plan.

How do I extend my tourist visa?

Under Australian migration law, it is not possible to extend a Visitor visa or ETA. You must apply for a new visa before your current visa expires. In most cases, if you can support yourself, you can apply to remain in Australia as a Visitor (tourist stream).

If your tourist visa is expiring, you are unable to return home because of entry restrictions and you can’t meet the requirements for another visa, you may be eligible for the COVID-19 Pandemic event visa. You’ll need to demonstrate why you can’t meet the requirements for another visa, including a Visitor visa. This could include a statement and evidence that you do not have access to sufficient funds to be able to pay another visa application charge (VAC).

What is the Covid-19 Pandemic Event 408 Visa?

The Covid-19 Pandemic Event visa is a temporary visa allowing a maximum stay of 12 months. There is no application fee and it is only available to onshore applicants.

You must have no other visa options and are unable to depart Australia due to COVID-19 travel restrictions and you wish to continue your current employer in critical sectors including agriculture, food processing, health care, aged care, disability care and child care and no Australian Citizen or Permanent Resident can be found to fill the position.

Medical Professionals who are making employment arrangements in the health care sector can also apply for this visa.

You may also qualify for this visa is you cannot return to your home country and you have no other visa options. Applicants under this category will not receive work rights.

Prospective applicants will be pleased to see movement and activity in the Australia’s skilled migration program, with the May and June 2020 invitation rounds released. Whilst there is a temporary freeze on 190 and 491 nominations, there is some activity in the independent and family sponsored streams.

Invitations issued on 11 June 2020

170 invitations were issued for 189 visas in June 2020.
30 invitations were issued for Family Sponsored 491 visas.

The minimum point scores required for 189 invitations were 85 points and Family Sponsored 491, 70 points.

Prospective applicants will be pleased to see movement and activity in the Australia’s skilled migration program with the June and May 2020 invitation rounds released.

State Governments are currently unable to nominate applicants for 491 or 190 sponsorship.

Yesterday, the Migration Institute of Australia informed members that the Department of Home Affairs (DHA) had advised the State and Territory Governments they would not be receiving nomination allocations for 491 and 190 visas on 1 July 2020. This means the State and Territory Governments have no ability to nominate any new applicants. The DHA may make further announcements to the State and Territory Governments about nomination allocations ahead of the 2020-21 Budget being handed down on 6 October 2020.

Applicants are still able to lodge an Expression of Interest for a 491 or 190 and they will be held in the pool for two years.

We hope to receive a formal announcement from DHA and encourage all applicants to start reviewing their alternative visa options.

Visa application fees to increase by 5.4% from 1 July 2019

This will apply to all visa subclasses except the Tourist 600.

This is a significant increase, a Partner visa will increase by $384.64 and an application for a Permanent Employer Sponsored visa will increase by $202.77

Those with dependents will face even higher increases in the total application costs. A reminder to all potential applicants, if you qualify, lodge before July 2019.

Results for the Migration WA invitation round, March 2019

A strong focus remains on Graduate Skilled Migration, with 78 invitations issued for 190 and 489 applications compared to just 9 in the General Stream. In the financial year to date, a total of 775 invitations have been issued under the Graduate Skilled Migration compared to 111 in the General Stream.

A minimum point scores required:

65 points for a 190 visa
75 points for a 489 visa

Minimum application requirements include completion of a Bachelor’s degree at a WA university, 5 points for work experience and proficient English.

Competition for Accountants (General) 221111, remains high with a minimum point score of 90, completion of Phd/Masters and Superior English. Invitations to Accountants were issued for 489 visas only.

The next round of invitations will be issued on 16 May 2019.

On 11 March 2019, the skilled occupation lists were updated. If your occupation previously was restricted to the Short Term List or wasn’t listed on any list, then it’s worth having another look as your visa options may have changed.

Childcare workers, hospitality supervisors and disability wokers are just some of the occupations that will be available for employer sponsorship in the Goldfields area.

The Goldfields Designated Area Migration Agreement (DAMA) allows employers to sponsor skilled overseas workers in 72 occupations across a range of industries.

The DAMA is an employer sponsored visa program and individual applicants cannot apply without employer sponsorship. Find an employer first and then Australian Visa Group can manage the sponsorship and visa application process. Applications will be open from July 2019.

Want to stay in Australia longer? From 1 July 2019, applicants who hold a second Working Holiday Visa 417 or 462, can apply for a third year Working Holiday Visa, if they complete another SIX (6) months regional work.

Requirements:

Complete all 6 months specified regional work whilst holding a second 417 or 462 visa and the six months work must start on or after 1 July 2019.

Details of how to apply will become available on the DHA website from 1 July 2019. At Australian Visa Group we can assist you with Family, Partner, Skilled and Employer Sponsored migration. We do not manage Working Holiday Visa applications and we do not obtain or assess applications for specified regional work. Applicants who do not meet the 2 years' post qualification work experience, required for a 482 visa, may be interested in the 407 Training visa.

Employers may find the 407 Training visa an attractive alternative to the 482 visa. There is no training levy, no labour market testing and no market salary rate. The salary can be based on the relevant Award.

After the government brought in the training levy, which is applicable to the temporary 482 nomination application, some employers are looking at alternative visa options to sponsor overseas workers in Australia. The 407 Training Visa is worth considering.

WA State Sponsorship for Medical Professionals

If you are a medical professional working in Western Australia or with a job offer from a West Australian employer, you may qualify for a Skilled Sponsored (subclass 190) visa or the temporary Skilled Regional (provisional) visa (subclass 489).

A new training levy applies to all permanent employer sponsored nominations including the 190 ENS and 187 RSMS. Your employer may now be unwilling to offer permanent employer sponsorship. In which case, you should look at your other visa options and lodge an Expression of Interest for a 190/489 visa with WA State Sponsorship.

What can I do if my 482 application is taking a long time?

It can be very frustrating to wait for DHA to process your 482 application. The processing standards issued by DHA are a guide only and they indicates the average processing time for 75% of cases. You should ensure you have included all relevant information in your application, respond to DHA requests providing any evidence requested as soon as possible. If you submit a status update whilst your application falls within DHA service standards, DHA will ignore your request and you will not receive any response. It is unfortunately, a waiting game and as long as you have submitted an accurate and complete application, you are at the mercy of DHA working through their case load.
