In addition to the 5,000 state nominated migration places for the 2024-25 program year, the Western Australian State Government has also negotiated the establishment of a Western Australian Designated Area Migration Agreement (DAMA) with the Federal Government.

The WA DAMA will provide a further 5,000 migration places, split equally between regional and metropolitan employers.

The WA DAMA will be used to fill specific jobs in key areas of demand, including in building and construction, health and aged care, tourism and hospitality, and agriculture.

The WA DAMA will operate alongside the existing DAMAs in the Kimberley, Pilbara, Goldfields and South West.

Excellent news for subclass 457, 482 and 494 visa holders!

From 01/07/2024 new and existing subclass 457, 482 and 494 visa holders who cease working for their sponsoring employer will have more time to find a new sponsor, apply for a different visa or make arrangements to depart Australia.

These visa holders will have up to:

👉180 days at a time to find a new sponsor, apply for a different visa or make arrangements to leave Australia; or
👉A maximum of 365 days in total across their entire visa period

During this period, the visa holder can:

👉 Work for other employers;
👉 Work in other occupations not listed on their most recent nomination approval.

The aim of this change is to allow work trials with potential new sponsors and also ensure that the visa holder can support themselves while they remain in Australia.

The Minister for Home Affairs has issued a media release announcing further changes to the migration system.

The aim of these further changes is to prevent so-called "visa hopping". This is where temporary visa holders continue to apply for further temporary visas while they are in Australia, allegedly attempting to extend their stay in Australia when they may have little prospect of becoming permanent residents.

The new measures will commence from 01/07/2024. From that date:

👉 Visitor (subclass 600) visa holders will not be able to apply for a Student (subclass 500) visa while they are in Australia.

👉 Temporary Graduate (subclass 485) visa holders will not be able to apply for a Student (subclass 500) visa while they are in Australia.

The legislation to introduce these changes has not been released yet, stay tuned for further updates.

The Federal Government has published the legislative instrument which will allow second and third Working Holiday (subclass 417) visa applicants from the UK whose passports say that they are either a British citizen or a British national (Overseas) to apply for their next Working Holiday visa without needing to show that they have completed the "specified work" requirement.

The legislation takes effect from 01/07/2024.

The Department of Home Affairs has confirmed that from 01/07/2024 the Temporary Skilled Migration Income Threshold (TSMIT) will increase from $70,000 to $73,150.

From 01/07/2024 new nomination applications will need to meet this new figure, or the annual market salary rate (AMSR), whichever is higher.

The change will not affect existing visa holders or nomination applications lodged before 01/07/2024.

The 2024 Australian Federal Budget was handed down last night. Key takeaways in the migration space are:

👉 The 2024–25 permanent Migration Program planning level has been set at 185,000 places. 132,200 of those places (around 70 per cent) have been allocated to the Skilled stream.

👉 The work experience requirement for the Temporary Skill Shortage (subclass 482) visa will be reduced from two years to one year for all applicants from 23/11/2024 onwards.

👉 A visa pre-application ballot process for the capped Work and Holiday (subclass 462) visa program for China, Vietnam and India will be introduced from 2024–25. A ballot charge (initially $25) will apply.

👉 A new Mobility Arrangement for Talented Early-professionals Scheme (MATES) program for Indian nationals will be introduced from 01/11/2024. MATES will be a new pathway allowing 3,000 Indian graduates and early career professionals (aged 18 to 30 years at the time of application), with knowledge and skills in targeted fields of study to live and work in Australia for up to two years. The visa will initially have a pre-application (ballot) charge of $25 and an application charge of $365.

👉 A new National Innovation visa, replacing the current Global Talent visa (subclass 858) will be introduced from late 2024. This visa will target exceptionally talented migrants who will drive growth in sectors of national importance. The Business Innovation and Investment visa program (BIIP) will cease and refunds of the visa application charge will be available from September 2024.

‼️ MIGRATION UPDATE ‼️

The Department of Home Affairs has announced that the proposed changes to the subclass 485 Temporary Graduate visa will come into effect on 01/07/2024.

What are the changes?

The Graduate Work Stream

👉 The Graduate Work Stream will be renamed the Post-Vocational Education Work stream.

👉 The upper age limit for this stream will be reduced to 35 years of age or under. Hong Kong and British National Overseas passport holders will continue to be eligible as long as they are under 50.

👉Applicants will need to have obtained an associate degree, diploma or trade qualification in Australia which is closely related to their nominated occupation on the Medium and Long Term Strategic Skills List (MLTSSL).

👉Applicants who hold a Bachelor degree level qualification or higher will no longer be able to use this stream.

👉 The maximum length of stay under this stream will be 18 months, however Hong Kong or British National Overseas passport holders may be able to stay for up to 5 years.

The Post- Study Work stream

👉 The Post-Study Work stream will be renamed the Post-Higher Education Work stream.

👉 The upper age limit for this stream will be reduced to 35 years of age or under. Hong Kong and British National Overseas passport holders will continue to be eligible as long as they are under 50.

👉 The ‘select degree’ 2 year extension will cease.

👉 The maximum stay periods will change as follows:

Bachelor degree (including honours) – up to 2 years
Masters (coursework and extended) – up to 2 years
Masters (research) and doctoral degree (PhD) – up to 3 years.

however:

Hong Kong and British National Overseas passport holders may be able to stay for up to 5 years.

Stay periods for Indian citizens will remain as:

Bachelor degree (including honours) – up to 2 years
Bachelor degree (with first class honours in STEM, including ICT) – up to 3 years
Masters (coursework, extended and research) – up to 3 years
Doctoral degrees (PhD) – up to 4 years.

👉 The Second Post- Study Work stream will be renamed the Second Post- Higher Education Work Stream.

👉 The Replacement stream will end.

❗️Key points❗️

👉 Anyone considering studying in Australia in the future needs to be aware that if they will be 35 or over when they finish their studies, there may not be a pathway for them to gain post-qualification work experience in Australia.

👉 The lower age limit will be a key concern for some current students, however it is important to note that the legislation implementing these changes has not been released yet. It may be that current student visa holders who are over the new age limit when they finish their studies may be "grandfathered", so that they are exempt from the new age limit. That would be fair, but we will only know when the legislation is released, so watch this space!

The Department of Home Affairs has confirmed that from 1 January 2024 until the Australian Federal Government has finalised its reforms of the Working Holiday Maker programme visa:

Working Holiday Makers can work for the same employer in Australia for more than 6 months without asking permission if the work is:

1. in different locations and work in any one location does not exceed 6 months;
2. in plant and animal cultivation anywhere in Australia;
3. in certain industries, including aged care and disability services, fishing and pearling, tree farming and felling, construction and mining, in northern Australia only (the Department's website provides a definition of Northern Australia: https://immi.homeaffairs.gov.au/visas/getting-a-visa/visa-listing/work-holiday-462/6-month-work-limitation);
4. from 17 February 2020, natural disaster recovery work;
5. from 4 April 2020, in critical sectors, including agriculture, food processing, health, aged and disability care and childcare, anywhere in Australia; and
6. from 8 May 2021, in the critical sector of tourism and hospitality anywhere in Australia

For any other situations not covered above, Working Holiday Makers must ask the Department of Home Affairs for permission to work longer than 6 months with one employer.

The Department of Home Affairs has announced that the subclass 408 Pandemic Event visa will fully close from February 2024. In the meantime:

👉 From 02/09/2023 applications for a new subclass 408 visa will only be able to be submitted by people who already hold a subclass 480 visa.

👉 From 02/06/2023 all new subclass 408 visas will be granted for 6 months.

👉 From 02/09/2023 a visa application charge of $405 will apply to applications for a subclass 408 visa.

The details of each State and Territory of Australia's allocation of nominations for the subclass 190 and subclass 491 visas have been released. The figures are below.

The figures are a significant reduction to last year's programme, but last year's programme was very large when compared to the numbers for FY 2020/1 and 2021/2. The figures aren't hugely different for the numbers for FY 2019/20.

Focusing on Western Australia, it has been allocated 1,500 nominations for the subclass 190 visa and 850 places for the subclass 491 visa.

👉 Equal invitation ranking for Interstate and Overseas candidates;
👉 Prioritised invitations for candidates with an occupation in a Western Australian industry sector with critical demand for skilled workers; and
👉 Reduced employment requirements for candidates invited through a Western Australian building and construction industry sector occupation.

🇳🇿ATTENTION NEW ZEALAND CITIZENS IN AUSTRALIA 🇦🇺

On 01/07/2023 major changes came into effect which mean that many New Zealand citizens who are in Australia may be eligible to become Australian citizens.

The requirement to hold Australian permanent residence for a set period before being eligible to apply for Australian citizenship has been removed (no need to use the subclass 189 New Zealand Stream visa any more). Here are the details:

👉 From 01/07/2023 all New Zealand citizens in Australia holding a Special Category (subclass 444 visa) (SCV) will be considered permanent residents for citizenship purposes.

👉 New Zealand citizens granted an SCV before 01/07/2022 will have their period of permanent residence backdated to 01/07/2022.

👉 New Zealand citizens granted an SCV for the first time on or after 01/07/2022 will be considered to be a permanent resident for citizenship purposes from the date of their SCV grant.

👉 From 1 July 2023, any child born in Australia on or after 1 July 2022 to an SCV holder may automatically acquire Australian citizenship at birth.

👉 From 1 July 2023, children who meet these circumstances can apply for​ evidence of citizenship.

‼️ ATTENTION SPONSORING EMPLOYERS - TSMIT INCREASE FROM 01/07/2023 - ACT NOW ‼️

👉 From 01/07/2023 the Temporary Skilled Migration Income Threshold (TSMIT) will increase from $53,900 to $70,000.

👉 Nomination and visa applications submitted on or after 01/07/2023 will have to include a minimum salary of $70,000 or the Annual Market Salary Rate, if that is higher.

👉 Nomination and visa applications submitted before 01/07/2023 will not be affected by the change.

👉 If you are intending to recruit overseas employees for your business, speak to your Registered Migration Agent urgently.

👉 Act now to avoid this change affecting your recruitment plans.
