Ericht Planning and Property Consultants Town and Country Planning Consultancy - Scotland I offer a highly professional yet personal approach to Clients' planning consultancy requirements.

I work throughout Scotland, with the focus of my work in the Scottish Borders, Dumfries and Galloway, the Lothians and Argyll and Bute. Appraisals, planning applications, appeals, listed building reviews and changes of use for urban and rural residential and commercial Clients. I pride myself in quality of work and high success rates owing to experience gained over 20 years as a Chartered Surveyor and also as a Chartered Planner.

One thing I love about my job is helping great businesses move from strength to strength. This week, another welcome planning permission arrived for a new sizeable modern industrial premises for the most outstanding blacksmith “The Blazing Blacksmith” based near Peebles whose incredible work can be seen in gardens and the public realm locally, in Edinburgh and all over the country. Our strategy began 2 years ago when I obtained a Certificate of Lawful Existing Use, with volumes of ‘forensically prepared’ supporting information, to demonstrate the lawfulness of the premises, located in the countryside, as class 5 industrial.
Patience, strategy and hard work prevail yet again.

The City of Edinburgh voted to approve consultation relating to a city-wide 'short term let control area'. If implemented property owners will need to acquire planning permission for ‘change of use’ to use the property as a short term let.

If an entire property has been continually operated as a short-term let for 10 years or more, planning permission may not be required (as the use may have become ‘lawful’). A Certificate of Lawfulness can be obtained to confirm lawful use in that case.

The proposed regulations don’t affect those renting out spare rooms within their own homes or renting their properties out while, for example, they are on holiday if it’s their principal dwelling. Where required, planning permission, will be a mandatory requirement for the licencing system from April 2024.
