๐Ÿ‡ฐ๐Ÿ‡ท Extending a C-3 Short-Term Visa and Switching to an F-1-D Workcation or Digital Nomad Visa

Foreigners who enter Korea on a C-3 short-term visa for a 60-day stay and wish to extend their stay for purposes like cosmetic surgery can only extend up to a total of 90 days. If they have already stayed for 45 days, the maximum extension is an additional 45 days.

Note: Short-term visas (C-1, C-3, C-4) can only be extended up to 90 days under specific conditions such as natural disasters, emergencies, pregnancy, childbirth, or lack of transportation. Extensions beyond 90 days are generally not allowed, except in extraordinary circumstances, which would be classified as a departure deferral after the visa expiry.

๐Ÿ“Œ Switching to an F-1-D Visa (Workcation/Digital Nomad)

The F-1-D visa, designed for digital nomads, can be applied for at a Korean embassy abroad or through a status change at an immigration office within Korea. Spouses and minor children can also apply alongside the primary applicant.

If you are applying for an E-7-4R visa change to a population reduction area, you must have been working for a company in a population reduction area with an E-9 visa. If you apply for an E-7-4R visa change in an area of attention in population decline, you must have been working for a company in an area of focus in population decline for at least a year with an E-9 visa.

(*There is wrong information on the Internet so I'll explain it. I'm explaining that there is wrong information on the Internet. )

For example, an E-9 visa worker in Gimpo-si, Gyeonggi-do can change to an E-7-4R visa even if they leave the company and move to a company in Pocheon-si, Gyunggi-do. For example, an E-9 visa worker in Gimpo-si, Gyeonggi-do, can change to an E-7-4R visa if he or she has been working at a company in Pocheon-si for at least a year even if he or she leaves the company and moves to a company in Pochon-si, Gyaonggi-do.

To summarize, in summary,

1. E-9 visa workers who are looking for a job can sign contract with companies in reduced population areas and change them to E-7-4R visa. Of course, the E-9 visa workers currently working in a reduced population area can change to E-7-4R visa immediately. E-9 visa workers who are looking for work can sign a labor contract with a company in a population decline area and change to an E-7-4R visa. Of course, E-9 visa workers who are currently working in a population decline area can change to an E-7-4R visa right away.

2. E-9 visa workers in the population reduction area can now change to E-7-4R visa if they have been working for the company for more than one year. E-9 visa workers who will move to a population reduction area can change to an E-7-4R visa by having to work for a year at a company in a population reduction area. E-9 visa workers in areas of attention in population decline can change to an E-7-4R visa if they have been with the company for more than a year now. However, E-9 visa workers who will move to areas of attention in population decline must work for a year at a company in areas of attention in populations decline before they can change to an E-7-4R visa.

๐Ÿ‡ฐ๐Ÿ‡ท Can I Bring My Partner to Korea on an F-2 Visaโ“

YES. If you hold an F-2-7 visa in South Korea, your spouse and minor children can join you, either by being invited from your home country or by changing their visa status within Korea.

Hereโ€™s how it works:

1๏ธโƒฃ F-2-71 Visa: For Family Members of F-2-7 Visa Holders

๐ŸŒŸThe primary visa holder (F-2-7) must meet the annual income requirement to sponsor their family members for the F-2-71 visa.
๐ŸŒŸ The annual income of the primary visa holder must be at least equal to the previous yearโ€™s per capita Gross National Income (GNI) of South Korea.
Spouses and minor children holding the F-2-71 visa are allowed to work legally in professional fields in Korea.

2๏ธโƒฃ Alternative Option: F-1-12 Visa

If the primary visa holder does not meet the required annual income, the spouse and children can still be invited to Korea under the F-1-12 visa.
๐ŸŒŸ The F-1-12 visa allows family members to stay in Korea but does not permit employment.
๐ŸŒŸ This is a suitable option for families where the primary visa holderโ€™s income does not meet the GNI threshold.

๐Ÿ“Œ Additional Information

โœ… Many foreign families currently holding professional work visas and working in Korea can change to the F-2-71 visa, provided the income requirements are met.
โœ… The F-2-7 visa offers a pathway for skilled professionals to bring their families to Korea, enhancing the opportunity for long-term residence and professional growth in the country.
โœ… All supporting documents and income proofs should be up-to-date and accurate to facilitate a smooth visa application process for your family members.

To determine the best visa option for your family, we recommend scheduling a consultation with our registered migration agent today.

๐Ÿค”Is it possible to maintain a F6 visa after divorcing a Korean citizen?๐Ÿ‡ฐ๐Ÿ‡ท

Our answer is YES!

If there is a minor child (or children) in the couple, then even if the child stays with a Korean citizen parent, the F6-2 visa holder can legally stay in Korea until the child reaches adulthood. After the child reaches adulthood, there is the option of obtaining a F2 visa for a foreign parent.

The task is a little more complicated if the couple does not have a child (or children) in the marriage with a Korean citizen.

In this case, our administrative attorney categorically does not advise to divorce by mutual consent (ํ˜‘์˜์ดํ˜ผ). Since, in this case, it will be impossible to keep a F6 visa. Therefore, to get a divorce, you will need to get a judicial divorce (์ดํ˜ผ์†Œ์†ก). The court decision (ํŒ๊ฒฐ๋ฌธ) must necessarily state that the divorce occurred due to the fault of the spouse who is a Korean citizen.

๐Ÿ‡ฐ๐Ÿ‡ท Changing Your Visa Status to F-5 for Permanent Residency

The guidelines and Gross National Income (GNI) requirements for changing visa statuses in Korea are updated annually. Preparing for permanent residency (F-5 visa) can vary significantly based on your current visa status. Knowing the exact criteria can save you unnecessary expenses and time, as mistakes in documentation or unnecessary steps can be costly.

The specific requirements for changing to an F-5 visa depend on the visa you are holding. Here are some general guidelines:

๐ŸŒŸ Compliance with Korean Law and Good Conduct: You must have a clean legal record.
๐ŸŒŸ Financial Requirement: You should demonstrate financial stability.
๐ŸŒŸ Basic Integration Requirement: Completion of a social integration program and language proficiency (TOPIK).
๐ŸŒŸ For applicants who have held a D-7 to E-7 visa or an F-2 visa, and have resided in Korea for more than five years, you may be eligible for the F-5-1 visa. The residency period must be continuous, but all periods can be combined. You must also maintain eligible economic activities under your current visa.

๐Ÿ“Œ Common cases of visa holders

โœ… D-8 Visa Holders: your average annual sales must be over 1 billion KRW for the two years preceding the application.
โœ… E-7 Visa Holders: a bachelor's degree or higher is required; your income must be at least twice the national average or substituted with assets.
โœ… F-6 Visa holders: applicants who have maintained a stable marriage with their Korean spouse and have resided in Korea for more than two years on an F-6 visa are eligible for the F-5 visa.
โœ… F-4 Visa holders: the basic requirements are similar to those for general foreigners. The key difference lies in how the F-4 visa holder engages in income activities before applying. Meeting the conduct and basic integration requirements is crucial, but income qualifications often pose a challenge. Understanding the types and ranges of recognized income for ethnic Koreans is essential.

Is it impossible to change from E-7-4 visa to F-2-99 visa??

I don't know why the instructions change and interpretations change every time.
Recently, after the E-7-4 visa worker changed to F-2-99 visa, the F-2-99 Visa was canceled and reverted to E-7-4 Visa.
The biggest reason was that my spouse and underage children are in Korea.
I stayed with an E-9 visa for over 4 years, received an E-7-4 visa, and invited my spouse to Korea. Now, because of my wife who invited me to Korea, I can't change to an F-2-99 visa.

The Office of the Immigration's interpretation of the F-2-99 visa is currently changing.
