When you apply for a visa to work or study in Korea, some of your documents may be required to get an apostille stamp for the purpose of verification. In this case, you need to check whether or not your home country or the country where the document issued is a contracting party of the Convention of 5 October 1961 Abolishing the Requirement of Legalization for Foreign Public Documents.

The purpose of the Convention is to abolish the traditional requirement of legalization, replacing the often long and costly legalization process with the issuance of a single Apostille certificate by a Competent Authority in the place where the document originates.

The electronic Apostille Programme (e-APP) was launched in 2006 to support the electronic issuance and verification of Apostilles around the world. The current number of Contracting Parties to this Convention: 125, including South Korea.

※ If your home country is one of the contracting parties, simply look for an e-apostille service operated by your home country. Note that some countries may only operate paper-based apostille. With this authentication certification, your document is ready to submit!

International students should be considerate while working in Korea 🇰🇷 and here is why

You may be aware of the fact that the immigration authority would integrate the information from the National Tax Service into its system so that they could easily check the income of foreigners effectively.

If you work without permission on visa D4/D2/D10/F3/F1, etc., illegal employment is likely to be detected not only when you extend your visa but also when you change it to another visa type (E7, F2, etc.)

The main purpose of visa D2 and D10 holders is to get a work visa, and if illegal employment is verified, it will surely affect the issuance of E7 visas.

Probably if you are caught working illegally without a permit while holding a visa without absolute working rights (D4/D2/D10), you will need to pay for law violations the first time, but if it is the second time, you may be deported.

Therefore, it is highly recommended that foreign students with D4, D2, and D10 visas must work with permission from the immigration authority.

Is it possible to apply for a WORK VISA E7 when you are in Korea with a Short-term VISIT VISA C3? 🇰🇷

In terms of immigration regulation, it is known that you could not change your status visa from C3 to E7 while being in Korea.

HOWEVER, the fact is that you may be eligible to apply for E7 onshore if you are not the citizens of 21 countries listed by the Ministry of Justice (China, Philippines, Indonesia, Bangladesh, Vietnam, Kyrgyzstan, Mongolia, Thailand, Pakistan, Sri Lanka, India, Ukraine, Myanmar, Nepal, Iran, Uzbekistan, Kazakhstan, Nigeria, Ghana, Egypt, Peru).

BUT not all C3 visas holders are eligible to apply for Visa E7. Visa C3 is also divided into 11 types, from C-3-1 to C-3-11. For example, if you apply for Visa E7 through group tourism (C-3-2) or medical tourism (C-3-3), even if you are not from 21 countries mentioned above, you may not be eligible to apply for E7 in Korea.

AND not all 87 jobs listed within the Visa E7 program are open for C3 visa holders. E7 visas are also divided into E-7-1, E-7-2, E-7-3, and E-7-4. Among them, you can apply for a change of qualification in Korea only if you are employed in 67 jobs with E-7-1, that is, professionals.

For example, E-7-2 (semi-professional) includes medical coordinators, hotel reception clerks, chefs, etc., and E-7-3 (general technical personnel) means being employed at shipyards, shipbuilding welders, painting workers, electricians, etc.

※ You may not be allowed to apply for E-7-4 (skilled personnel) in Korea, regardless of which country you are from.

NOTICE for foreign students who are ABOUT TO GRADUATE from universities in Korea 🇰🇷

With the recent graduation season approaching, the number of prospective graduates in Korea applying for work visas has increased significantly. You will be given an appropriate stay period under your study visa so that you can continue to stay in Korea until the actual degree acquisition date.

If you hold a D2 visa, you can change to a work visa immediately when you are confirmed to be employed in Korea, and if you are not confirmed to be employed in Korea, you should change to a job search D10 visa that allows you to participate in job search activities after graduation and degree acquisition.

A representative work visa that can be changed immediately is an E7 visa that requires a labor contract with a domestic public or private institution and an application for permission to change the status of residence if you want to engage in a specific activity specifically designated by the Minister of Justice.

Foreign students who are scheduled to graduate and employed in Korea, can officially work from the date of approval or the start of work after changing E7 visa from D2 visa. Foreign students must obtain work permits in advance when they get a job, and if they want to change their work visa as a prospective graduate of a domestic university, they must meet all graduation requirements as a D2 visa holder and all the conditions for an E7 visa.

If you hold a partner or marriage VISA F6, you might be eligible to apply for permanent residency VISA F5-2 🇰🇷

You MUST meet these criteria

※ Residence requirement: You must continue to be the spouse of the same person who sponsored you for the Partner visa and you have been staying in Korea for more than 2 years

※ Language requirement: You must have completed KIIP Level 5 or score more than 60 points in the comprehensive evaluation for permanent residence

※ Income requirement: You must have the ability to maintain a livelihood, which means the family's income OR assets of the applicant or spouse, must be above GNI per capita in the previous year. If the income is insufficient, it can be verified as income and the total amount of assets must be above the median.

※ Code of conduct requirement: You must have no criminal history in your home country and abroad.

Those who are scheduled to apply for permission to change their status for permanent residency F-5 or those who are already under review, who have violated domestic laws, must complete the law-abiding citizenship education (준법 시민교육).

If the number of violations is less than one, non-prosecution or a fine of up to 1 million won. If 10 years have passed since the end of the case as a person who has been imposed a fine for negligence (including disposition or exemption from imposition), it is possible to proceed with the permanent residence qualification review without completing the education.

HEALTH EXAMINATION to prove you meet the health requirement for VISA F6 🇰🇷

From April 13, 2023, applicants for marriage immigration (F-6) issuance (foreigners) and invitees (Koreans) must submit an F6 visa health certificate and criminal history certificate regardless of their nationality.

Regarding health check, instead of including all items like a comprehensive checkup, you can also submit the health assessment result for international marriage applications, including AIDS, STD, mental illness (personality disorder, drug addiction), and tuberculosis.

- In Korea: You must be examined by a hospital or public health center designated by the Ministry of Justice

- Outside Korea: You must be examined by a hospital-level medical institution, including the above.

Simply having a physical disability grade does not affect the application, and in this case, it is replaced by checking with the marriage party whether they know about the disability in detail (e.g., interviews, invitations, statements, etc.). The results of your health assessment are valid for 3 months, starting from the date of issuance.

The Korean Language Proficiency Test (TOPIK) requires a process of updating every two years as the validity period of the report card is two years after the test, which may be troublesome.

Instead, KIIP completion is permanent, once completed, you will be given a lifetime score as well as an additional 10 points, so it is better to complete a pre-evaluation, mid-evaluation, and comprehensive evaluation whenever you have time.

* Note: KIIP is a social integration education program designed to systematically cultivate basic knowledge (Korean, Korean culture, Korean society understanding, etc.) essential for immigrants to adapt and stand on their own feet as members of the society.

A sponsor who invites a foreigner for the purpose of living together for marriage shall have annual income (before tax) for the past year (based on the date of application) at least the required amount listed below.

Criteria for income requirements by size of household in 2023 (Ministry of Justice Notice No. 2022-639)

- Household of 2: 20,736,930 KRW
- Household of 3: 26,608,896 KRW
- Household of 4: 32,405,784 KRW
- Household of 5: 37,984,128 KRW
- Household of 6: 43,367,886 KRW
- Household of 7: 48,645,090 KRW

* Income standard for households with 8 or more members: an increase of KRW 5,277,204 per additional household member

※ Calculation of the number of households

If the guest does not have a cohabitation family: a two-person household (sponsor + foreign spouse)

If there is a direct family member (children or parents born in a past marriage relationship) who shares the same generation as the guest on the resident registration table, it is included in the household members

※ Type of income recognized

Earned income + business income acquired by the sponsor over the past year (including income from agriculture, forestry, and fisheries) + Total real estate rental income + interest income + dividend income + pension income
