7 PATI dipenjara 5 bulan masuk secara haram

TAWAU: Tujuh wanita hanya mampu menangis teresak-esak apabila dijatuhi hukuman penjara lima bulan oleh Mahkamah Sesyen di sini, semalam kerana memasuki negara ini tanpa sebarang dokumen perjalanan atau pengenalan diri yang sah.

Hakim Rosli Amat menjatuhkan hukuman itu terhadap Asniah M Amir, 25; Emei Budi, 24; Syafira Aini Jupri, 23; Ekawati Mansur, 25; Nurraysyah Abdullah, 21; Nurul Adriana Nasir, 21; dan Dilla Abd Malik, 24, selepas masing-masing mengaku bersalah terhadap pertuduhan yang dibacakan secara serentak oleh jurubahasa mahkamah.

Seorang lagi tertuduh Miklen Jason Matius, 23, dipenjara lima bulan dan dua sebatan selepas membuat pengakuan bersalah atas pertuduhan sama.

Mengikut kertas pertuduhan, kesemua mereka yang juga pendatang asing tanpa izin (PATI) warga Indonesia dituduh mengikut Seksyen 16(1)(c) Akta Imigresen 1959/63 (Akta 155) dan boleh dihukum dibawah Seksyen 16(3) Akta yang sama.

Bagi kesalahan itu, mereka boleh didenda sehingga RM10, 000 atau penjara tidak lebih lima tahun atau kedua-duanya, jika sabit kesalahan dan dikenakan sebatan tidak lebih enam kali.

Sementara itu, dua tertuduh lain Chandra Mohammad Amin, 32 dan Irfan Fajar, 24, masing-masing dipenjara tiga bulan dan empat bulan serta dua sebatan rotan atas kesalahan tinggal lebih masa selepas Pas Lawatan Kerja Sementara (PLKS) tamat tempoh.

Chandra didapati tinggal lebih masa selama dua tahun, lima bulan dan sembilan hari, manakala Irfan tinggal lebih masa di negara ini selama enam tahun, empat bulan dan 18 hari.

Kedua-duanya yang mengaku salah dituduh mengikut Seksyen 15 (1)(c) dan boleh dihukum di bawah Seksyen 15 (4) Akta Imigresen 1959/63 yang membawa hukuman denda tidak kurang RM10, 000 atau penjara tidak lebih lima tahun atau kedua-duanya sekali, jika sabit kesalahan.

Kesemua 10 PATI terbabit didakwa melakukan kesalahan itu di dua pusat hiburan di Kompleks Fajar ketika serbuan oleh sepasukan anggota penguat kuasa Jabatan Imigresen Tawau menerusi “Ops Gegar” pada 18 Mac lalu sekitar jam 1 pagi.

Pendakwaan dikendalikan Pegawai Pendakwa Imigresen Tawau, Halimatu Saadiah Amat, manakala kesemua tertuduh tidak diwakili peguam.
