Canada’s Temporary Foreign Worker Program (TFWP) and How You Can Apply👇

Canada’s immigration system is complex and foreign skilled workers can be frustrated looking for how to get Canada temporary foreign worker permit.

Below are the key 7 steps to apply.

TFWP allows foreign workers to come to work in Canada in many areas. These include:

Agriculture
Accommodation and Food Services
Health Care and Social Assistance
Retail Trade, and also
Manufacturing

Let's talk about the steps to apply for a work permit.

Step 1: Do I need a work permit to work in my job in Canada?
The first thing is to check if you need a temporary foreign worker permit to work temporarily in Canada. You usually need a work permit to do any work in Canada.

However, in some cases, you can work without a permit.

Step 2: Am I eligible for temporary foreign worker permit?

The basic eligibility requirements for temporary foreign worker permit are that you must:
Prove to an officer that you will leave Canada when your work permit expires.
Show that you have enough money to take care of yourself and your family members during your stay in Canada and to return home, that's if you're coming with family.
Obey the law and have no record of criminal activity (IRCC may ask you to give a police clearance certificate)
Not be a danger to Canada’s security.
Be in good health and have a medical exam, if needed.
Not plan to work for an employer listed with the status “ineligible” on the list of employers who failed to comply with the conditions;
Not plan to work for an employer who, on a regular basis, offers st******se, erotic dance, es**rt services or erotic massages.
give the officer any other documents they ask for to prove you can enter the country.

Step 3: Should I apply online or by paper?

Due to COVID-19, most applicants now need to apply online for a work permit.

Step 4: Apply for the right work permit for your situation.

There are 2 types of work permits.

Employer-specific work permit

An employer-specific work permit lets you work in Canada according to the conditions on your work permit, such as
The name of the specific employer you can work for how long you can work. The location where you can work (if applicable)

Before you apply for an employer-specific work permit, your employer must give you

A copy of your employment contract
1 of the following:
A copy of a labour market impact assessment (LMIA)

An offer of employment number (for LMIA-exempt workers)
To get this number, your employer must use the Employer Portal.

If your employer does not need to use the Employer Portal to submit an offer of employment, they must give you a copy of the employment contract.

Open work permit:

An open work permit lets you work for any employer in Canada, except for one that

is listed as ineligible on IRCC’s list of employers who have failed to comply with the conditions, or
regularly offers st******se, erotic dance, es**rt services or erotic massage.

Step 5:
Get positive Labour Market Impact Assessment (LMIA) from your employer

A Labour Market Impact Assessment (LMIA) is a document that an employer in Canada may need to get before hiring a foreign worker.

Very important

A positive LMIA will show that there is a need for a foreign worker to fill the job.

It will also show that no Canadian worker or permanent resident is available to do the job.

A positive LMIA is sometimes called a confirmation letter.

Once your employer gets the LMIA, you can apply for a Canada foreign temporary worker permit.

The job offer letter. A contract A copy of the LMIA, and also The LMIA number

Step 6:

Get written temporary job offer from your employer

Applicants for Canada temporary work permit must have a temporary job offer from their potential employer.

The offer should be in writing and must detail the job requirements and terms.

The job offer letter must prove that the job offer is genuine.

It must also show that the wages and working conditions are high enough to attract a Canadian worker.

The job offer letter must also include:

The job title for the job being offered.

A description of the job’s duties and responsibilities.

Requirements for the job concerning: education, professional credentials, work experience, skills and licenses.

details about the start date and end date of the job.
details on salary and the way in which salary will be paid.

The name and address of the employer;

The address of the worker’s future workplace;

Contact information for a person at the company who is familiar with the job offer.

The applicant must then attach the job offer letter to their foreign temporary worker permit application.

Step 7:

Make and submit your application for Canada temporary foreign worker permit.

Once you have all eligibility requirements and documentation, make your application on the IRCC website at Application for Foreign Worker Permit.

If You arrive in Canada 🍁🍁 with a Visitor's Visa and wants to process your PR because you don't want to go back to your country.

Here's how you go about it

I'll guide you step by step.

I hope you have 6 months visa.

Step 1 - Find a Job. Easier to find a job in other provinces than Ontario. Make sure that job is applicable for LMIA (Labor Market Impact Assessment) and get LMIA from your employer. Find any job or employer who can provide with LMIA.

Step 2 - Apply for work permit through Canadian Immigration Office. You have to go through Canadian Border to get work permit. You need LMIA for that. This offer is valid till 2025.

Step 3 - Start working on that job for 2 years and then you'll be eligible to apply for PR. (Time depends upon your provinces)

Step 4 - After you get your PR, you'll be eligible for Benefits. Then you can switch your job.🙂

Yes, you are still required to show proof of funds when you arrive at a Canadian port of entry. Your proof of funds will include receipts for tuition and any accommodation you have paid, plus the remainder of your first year's tuition and living expenses in a form that you have direct access to.

You can open a Canadian bank account from Nigeria, once you have your Canadian visa (TRV). You can find the information on any of Canada's charter bank websites. You can also ask your bank if they can help. Or you can bring your proof of funds to Canada in the form of a bank draft.

How do you know if your work permit has been approved by IRCC?

If you receive a passport request letter from IRCC telling you to submit your passport to the Canadian Embassy for the final processing of your work permit does it mean your Application will be approved and you will be getting your Visa to Canada?

The answer is No.

People will try to tell you it means your work permit is approved because they had their work permit approved after they received their passport submission request.

This is not always the case. Your application can be denied after you submit your passport.

IRCC waits until they have all of your information before they make a decision. Your background check (this includes criminal record check, employment history verification, education verification and verification of all information in your application) medical exam review, biometrics review and passport verification. Once all that information is gathered IRCC will review it all together and decide on your application.

The only thing that will tell you if IRCC has approved your work permit is a letter from IRCC telling you they have approved your work permit.

I would say if you have all your documents ready and answer the basic questions that the immigration officer asks, you should not have a problem entering Canada and getting your study permit.

Will IRCC verify a bank statement document for a study permit?

IRCC cannot ask a bank or don't ask a bank what the balance in the account is, but they can ask the bank to verify that they issued the document as provided.

When you arrive at a Canadian port of entry you are required to have your documents with you.

Border services officers may ask for the Port of Entry Introduction Letter from IRCC, your Letter of Acceptance from your DLI and your updated proof of funds in a form you have access to.

This is another way that your proof of funds is verified.

If you show up in Canada without the required funds the border agents can turn you away.

Someone said this to me and I believe so many other people may have the same issue/question, especially those using the study route.

So I'll put out the question below and then my answer to it.

Question: I've applied for a Canadian study permit and it is taking longer than it should. I've been waiting for 2 months and my portal hasn't got any new messages. Is it a good sign?

So the answer to that is

Nope. It's not taking longer than it should. Who told you Canadian study permit applications only take 2 months to process? They take 10 weeks to process and that does not include the time to submit your biometrics or have your passport sent from the Visa Application Centre to an IRCC office (and back).

There are no good signs or bad signs for a visa/permit application. There is a letter from IRCC telling you what their decision is when they've completed processing your application.

It’s quite a sad story.

But I would be sharing it here for you all to learn because your travel agents won't tell you this thing I'm about to tell you.

Anyways, Back to the matter.

So there was this family that got a provincial nomination to move to Canada.

While everything was going on smoothly.

At the federal level, The application was withdrawn and they could not proceed any further.

Now you might think how is this possible after they have been nominated to come to Canada?

Well. Turns out that 2 years earlier when my wife went to give birth in the USA.

She applied for a Canada visit visa to see her sister who lives in Canada.

She was denied a visa to go to Canada and came back to Nigeria after giving birth.

While she was in Nigeria again, she tried to apply again and got a second refusal.

When the whole issue scattered after their application was withdrawn to go to Canada at the federal level.

Through Mr Victor's advice, they simply ordered what is called their GCMS NOTE and discovered that she had been banned for 5 years already for something called misrepresentation.

Turns out that while she was applying for the second visa, She left out a tiny detail stating that she had never been refused a visa prior

Which was already wrong.

Such tiny oversight is big in the eyes of big nations like CANADA, the USA, the UK AND AUSTRALIA.

And that cost her and her family the opportunity of getting a permanent residency in Canada at that time.

This is the more reason why you need to be honest with your application plus also be careful of whoever is filling your application on your behalf, not to go fill out what is not for you as it can lead to you getting a 5-10 years visa ban.
