International Students Can Now Work Over 20 Hours a Week

Immigration, Refugees and Citizenship Canada (IRCC) has announced temporary measures to increase the number of authorized work hours for international students. Starting November 15, 2022, international students in Canada who have off-campus work authorization on their study permit will be allowed to work over the 20 hour per week limit.

New Student Work Measures Announced
The new measure is aimed at addressing Canada’s historic labour shortages. Canadian employers have been facing unprecedented challenges filling job vacancies. With nearly one million job vacancies, labour shortages are at an all time high. As a result, many are turning to immigration to fill these shortages.

International students could be key to help fill these gaps. With nearly half a million foreign students in Canada available to potentially work additional hours, this temporary change could have a big impact on the labour market. It also reflects how important international students are for the country and the economy. In fact, research has shown that immigration is crucial in addressing the labour shortage and filling essential jobs..

The IRCC stated that from November 15, 2022, until December 31, 2023, international students in Canada who have off-campus work authorization on their study permit will not be restricted by the 20-hour-per-week rule. Foreign nationals who have already submitted a study permit application, as of Friday, will also be able to benefit from this temporary change, provided their application is approved.

Previous Restrictions
Previously students were limited to working a maximum 20 hours a week off campus. This restriction was lifted only during breaks such as summer and winter holidays or by other past temporary measures.

However, with the cost of living on the rise, many international students have been urging for an increase in the number of working hours allowed. Canada has been facing a record high inflation rate which has been affecting many across the country. International students are especially hard hit by increased inflation as they often pay much higher tuition rates than Canadian nationals. The new measure would give the students the ability to potentially earn more and be better able to afford their tuition and living expenses.

Canada is a popular destination for many when deciding where to study. Canadian universities offer a high quality of education that is often times cheaper than other popular study countries, such as the USA. Last year alone, Canada issued nearly 450,000 new study permits and is set to exceed that number by the end of the year.

Options to Remain in Canada After Finishing Your Studies
Many students who come to Canada are interested in making their move more permanent. As a result the IRCC offers a few paths for students to continue to live and work in Canada after they finish their studies.

One popular way is the Post Graduate Work Permit (PGWP). The PGWP gives eligible international students an open work permit. PGWPs allow the holder to work for any employer, anywhere in Canada.

PGWPs are valid for between eight months to three years and are a great way to obtain valuable Canadian work experience. Once an applicant has work experience in Canada, it opens a lot of opportunities to obtain Canadian permanent residence.

Another popular avenue for international students to remain in Canada after finishing their studies is Express Entry. Express Entry is the fastest and most popular pathway to Canadian permanent residency. Once in the Express Entry pool, applicants are assigned a Comprehensive Ranking System (CRS) score and are ranked against other applicants in the pool. Express Entry often favours candidates with Canadian work and study experience giving them a higher CRS score and thus potentially ranking higher. This gives students and graduates in Canada an excellent chance of obtaining permanent residence.

How much does it cost to move to Canada?
A lot of folks always ask me how much it will cost them to move to Canada.

While it is noteworthy to ask such question, the reality also is that everyone's situation is different.

While someone may be suitable to come to Canada to study, and other person might qualify to come directly as a permanent resident. Hence the cost implication will differ.
As a rule of thumb, you need to let your subscribers know that Canadian relocation is a project. They should see it as a project which involves a lot of process and these processes also cost money.

Another thing to also note is that the exchange rate of the Naira (for those in Nigeria) as compared to the Canadian dollar keeps changing. In 2016 when I was processing mine, the Canadian dollar to the Naira only exchanges for about 150 Naira. Today it's over N500 Naira to 1 CAD.

CRIMES THAT WILL MAKE YOU INADMISSIBLE TO CANADA

If you have a criminal record and are planning to come to Canada, it is important to understand the types of crimes that will make you inadmissible.

Being inadmissible essentially means that you are not allowed to enter Canada. Criminal inadmissibility is one of the most common reasons someone may be unable to enter Canada. To determine whether your criminal charge may render you inadmissible, it is helpful to understand the types of convictions in Canada.

Offenses under the Criminal Code of Canada will fall under one of three categories: summary, indictable, or hybrid.

Straight summary offenses are usually considered the least serious of the three in terms of both the crime and the penalty. Straight indictable offenses, on the other hand, are for more serious crimes with more severe sentences. A hybrid offense is an offense where the prosecutor can decide whether it will be processed “summarily” or “by indictment” based on the seriousness of the actions of the accused.

It is important to note that a foreign national does not need to have committed a crime in Canada to be criminally inadmissible to Canada. Immigration and border officers determine the Canadian equivalent of any criminal offense committed abroad to decide whether an individual is criminally inadmissible to Canada.

Indictable offense – crimes that will make you inadmissible to Canada
An indictable offense will always result in criminal inadmissibility to Canada. Examples of indictable offenses include:

Theft over $5,000 CAD
Breaking and entering
Arson
Counterfeiting
Unlawfully causing bodily harm
Criminal negligence causing bodily harm
Discharge firearm with intent to wound
Motor vehicle offense causing death
Hybrid offense – crimes that could make you inadmissible to Canada
When categorizing a foreign national’s offense, border or immigration officers will consider a hybrid offense to be indictable. Some examples of hybrid offenses that could result in being criminally inadmissible to Canada include:

Reckless driving
Simple assault
Driving under the influence (DUI)
Driving while impaired (DWI)
Charges of driving under the influence are a common reason for a foreign national to be criminally inadmissible to Canada. Even if your DUI conviction occurred several years ago, it can still affect your ability to enter Canada. However, if you have a DUI conviction, there are still options to come to Canada.

Can I enter Canada with a ma*****na possession charge?
As of October 2018, it is legal to possess up to 30 grams of legal dried cannabis in Canada. However, possession of illegal ma*****na, which is not purchased through a licensed retailer, is still a summary conviction offense. For this reason, it is possible that this crime could make you inadmissible to Canada. If you have been convicted of more than one summary offense, this may affect your ability to come to Canada.

How can I overcome my criminal inadmissibility?
The options available to overcome your criminal inadmissibility will depend on when and where the crime was committed, and the severity of the offense.

If you were convicted of a crime outside of Canada, you must be considered rehabilitated to be admissible. You may be eligible to apply for rehabilitation if more than five years have passed since the end of the sentence imposed for a crime committed outside of Canada. If more than ten years have passed since completing your sentence, you may be already deemed rehabilitated.

For driving-related offenses, if your license is taken away as part of your sentence, the five-year period must start after your driving prohibition ends.
