‼️Why AIMA is rejecting the residence permit ‼️

🟡 After 90 business days since the start of immigrant services at the Agency for Integration, Migration and Asylum (AIMA) task force centers , the first residence permits began arriving by mail this week. However, many citizens have nothing to celebrate, because instead of good news, they received notifications by email that their residence applications in Portugal had been rejected. At least 108,000 people were rejected by AIMA and are still waiting for a new chance.

🟡Lawyer Célio Sauer emphasizes that a denial is not a total rejection, since AIMA gives immigrants a period of 10 days to attach the required documents again and pay the fees that were not paid within the stipulated deadlines. In other words, there is a second chance, which, in his opinion, should be taken advantage of.

🟡For Sauer, it is sad to receive notification from AIMA that the residency applications have been rejected, but there is a positive side to this process: it means that AIMA has resumed analyzing the applications, which was not the case until September, when the mission centers were launched. "Again, the rejection is not a rejection, as there is a deadline to complete the process," he emphasizes.

🟡There are several reasons why AIMA has rejected applications for residency in Portugal by foreigners. “There are cases in which the agency asks for the rental agreement to have notarized signatures. A rental agreement does not need notarized signatures,” he says. He explains that rental agreements must be registered with the Tax Office, which is the responsibility of the property owners, not the tenants. “I believe that they ask for the signatures as evidence against the owners,” he suggests.

🟡Transfer to Social Security
Another requirement made by AIMA, which is not in the law, is proof of residence in addition to that issued by the parish council. “Sometimes 30, 40 or 50 people appear with the same address registered by a parish council. When the processes were analyzed with more time between them, this sometimes passed, but now that everything is being analyzed at the same time, the agency sees this,” explains Sauer.

🟡There is also the issue of non-payment to Social Security. “There is the case of a young man who received a notice of rejection of his residence application because the company he works for deducted the amount from his salary but did not pass it on to Social Security. In these cases, AIMA is left with its hands tied, and the immigrant's path is to seek an agreement with the company so that the payment to Social Security is made. If this is not possible, he will have to file a lawsuit against the company. AIMA would have to give time for the matter to be dealt with,” he points out.

🟡 Sauer says that a positive development promoted more recently by AIMA was in the process of submitting documents for the residence permit process. “When people are notified by AIMA about the rejection of their application, everything can be answered on the AIMA portal itself. Immigrants have a user number and a password , gather the documents and write what they intend to do for a new submission of the process. There is no need to hire a lawyer for this”, he describes.

🟡 While many are having problems with AIMA, those who have obtained a residence permit are celebrating . “I have a client who was seen during the second week of operation at the Hindu Temple center and has already received a residence permit,” celebrates lawyer Adriana Ayala.

🟡 “I was at work and a friend came to tell me that I had received a letter from AIMA,” says Algerian Houcine Deba, 27, who lives in Cuba, in Alentejo. He had been trying to legalize his status in Portugal for two and a half years. “I arrived in the country in May 2022 and expressed my interest on June 27,” he recalls. At the time, he was working in the cleaning sector, later moving to the construction sector.

🟡 Deba explains why she chose Portugal to live in, rather than Spain or France, countries where the Algerian population is larger. “It’s a calmer country, with less stress. There are no problems with the police and the people are friendly,” she says.

🟡 AIMA launches new portal for those who have Expressed Interest but were not invited
The migration agency will give the opportunity to all immigrants who expressed an interest in living in Portugal until April 30, 2024, but did not receive the call to regularize their documents.
🟡 The Agency for Integration, Migration and Asylum (AIMA) responded to the appeals and launched, this Friday (17/01), a new portal for immigrants who have Expressed Interest, but were not included in the list of more than 400 thousand people called to regularize their document situation in Portugal. It will be another chance for them to have access to the long-awaited residence permit in Portugal.

🟡 According to information from the entity, immigrants who submitted an Expression of Interest until April 30, 2023 on the old SAPA Portal will receive an email asking them to change their password on a new platform. For AIMA, this is necessary because many people may have lost the password created at the time of registration.

🟡 As lawyer Larissa Belo recalled in a recent interview with PÚBLICO Brasil, there are many cases in which the passwords were created by a third party, with whom the immigrants have lost contact. The new platform will generate the Single Collection Document (DUC) for payment of fees within a maximum of 10 business days.

🟡 AIMA also clarifies that, after payment of the DUC, immigrants will receive a proposal for scheduling within the following 20 business days, indicating the date, time and location. Close to the chosen date, the migration agency will provide instructions on how to resubmit all updated information and documentation.

🟡 "This new procedure is simple and functional, and also safer and more effective. This will make it possible to speed up scheduling and ensure compliance with the new rules that came into force at the beginning of 2024", assures AIMA, which has faced a flood of lawsuits in court. In October and November of last year alone, there were more than 21 thousand lawsuits .

🟡 In a document sent to the press, AIMA explains the reasons for the new portal: "This new procedure implements the change in rules that occurred at the beginning of 2024, in which, among other measures, payment of fees was provided for at the time of submission of the request (expression of interest), and not only after the decision, both for new processes and for processes pending on that date".

🟡The agency also emphasizes that the new tool offered to immigrants was "designed to respond as quickly as possible to the hundreds of thousands of residence permit applications awaiting resolution." The system has a major advantage: immigrants will be able to complete the entire process online, up until the collection of biometrics, which is done in person.

🟡AIMA says: "It is a simpler and more accessible process, because it takes place entirely online until the moment of service. It is safer, because it ensures that all communications are carried out in a controlled environment. It is faster because the analysis will be based on updated information, since, as there are very old

🟡 The agency believes that, with the new platform, it will be able to "eliminate some applications that no longer correspond to the interests of the person who submitted them, because they may have moved to another country". In this way, AIMA adds, it will be possible to make vacancies available to more people and more quickly.
🟡For Expressions of Interest submitted by citizens of Brazil and Portuguese-speaking African Countries (PALOP), the fee to be paid to AIMA remains at 56.80 euros. Immigrants from other countries will have to pay 397.90 euros each. According to the agency, these fees are exactly the same as those charged at service desks.

‼️A4 HIGHWAY CLOSED IN THE MIRANDELA AREA (TRAS OS MONTES) AFTER COLLISION OF TWO TRUCKS WITH ONE DEATH ‼️

🟡Highway 4 (A4) has been closed since around 6h00 this Wednesday between Mirandela and Vila Real, due to a collision between two trucks.
According to Civil Defense, one of the vehicles caught fire, causing a injured person and a death.

🟡A source from the Trás-os-Montes Sub-Regional Land Command told that the alert was given at 5:53 and that it occurred in the direction of Mirandela-Vila Real, at kilometer 138.
According to the Mirandela firefighters command it was a rear-end collision, supposedly one of the trucks was stopped on one of the highway lanes and the other collided with it.

🟡The A4 remains closed both ways, with authorities cleaning the road and investigating the circumstances of the accident.

🟡"It's a bad solution to close the station," chanted the protesters, holding banners against the long-announced end of the rail link to the city centre.

🟡More than 200 people gathered in the early hours of this Sunday, shortly after midnight, to say goodbye to the last train that left Estação Nova, in the centre of Coimbra, which is closing after 140 years.

🟡About 15 minutes before the last train, people were already gathering at Estação Nova (also known as Coimbra-A), some shouting slogans, such as "It's a bad solution to close the station", and holding some banners against the long-announced end of the rail link to the city centre, planned in the Mondego Mobility System (SMM) project, with articulated electric buses running on a dedicated channel.

🟡Around midnight, the mayor of Coimbra, José Manuel Silva, also arrived at the station, booed by some of those present, who insisted on also making the last trip from Coimbra-A to Coimbra-B, accompanied by several members of his executive and members of Metro Mondego, including its president, João Marrana.

🟡Almost drowned out by people's shouts, the mayor explained that the SMM project is a decision that "was taken and consolidated" before taking office in 2021.

HISTORY
Coimbra Railway Station, also known as Coimbra-A or Coimbra-Cidade, and popularly called Estação Nova, is an interface of the Lousã Branch Line, which serves the city of Coimbra, in Portugal.

It was opened by the Royal Portuguese Railway Company on 18 October 1885. Since 1864, Coimbra has been served by a station on the Northern Line. However, the opening of a branch line between this station and Coimbra-A station allowed the railway to be brought closer to the city centre. At the time of the opening of Coimbra-A station, there were already plans to build a railway line between Coimbra and the interior of its district (as far as Lousã and Arganil).

Coimbra-A Station technically ceased to be a terminus in 1906, with the inauguration of the Coimbra–Lousã line; however, for decades, many train services began and began their journey here.

In 1931, the current passenger building was opened, designed by the architect Cotinelli Telmo.

🟡The migration agency will resume, on January 15, the residence authorization processes, with family reunification, for people who have invested at least 500 thousand euros in Portugal.

🟡The Agency for Integration, Migration and Asylum (AIMA) will reopen, as of January 15, the process of regularizing residence permits for investors who invested resources in Portugal through Golden Visas.
🟡 According to a statement sent in recent days to citizens who fall under the Investment Residence Permit Regime (ARI) and published on the agency's website, it will be possible to submit documentation online, including that of family units.
🟡AIMA promises that decisions on applications will be made within a maximum of 90 days, counting from the date of submission of the documents.

🟡In 2023, Golden Visas for the purchase of real estate in large urban centers and coastal areas were abolished, but the Government maintained investments in funds, in the productive sector and in the recovery of homes in the interior of the country and historic properties. “Portugal needs to attract productive investments, and Golden Visas are a good instrument”, points out solicitor Elisa Hachem. “These investors are also important for revitalizing smaller cities, where there are many abandoned and destroyed properties”, she emphasizes.
🟡According to the rules defined by AIMA, investors will be able to choose, electronically, the service point where they will have their biometrics taken and the necessary documents submitted. They will also have the right to define the day, month and time to be received at the agency's offices. It is important to note that some of those who applied for Golden Visas do not live in Portugal, as there is an obligation to spend only seven days per year in the country. Therefore, AIMA will allow the process, up until the collection of the investors' biometric data, to be conducted by legal representatives in Portugal. All scheduling information will be confirmed via email.
🟡According to the 2024 rates, AIMA will charge 605.10 euros (R$3,873) for receiving documents from each investor. The residence permit, when issued, will cost 6,045.20 euros (R$39,000) per unit. “These are high amounts compared to what is charged for other residence processes,” acknowledges Elisa Hachem. In the case of citizens of the Community of Portuguese Language Countries (CPLP), the fee is 56.80 euros (R$364). For other nationalities, the cost is 398.80 euros (R$2,553) per person.

🟡 The AIMA met on Monday (23/12) with consular representatives from 12 countries and representatives of the migration agency aimed to clarify how the process of regularizing immigrants in Portugal is going.

🟡 Since September, AIMA has been racing against time to resolve the approximately 450,000 pending applications for residency in Portugal. To this end, 20 service centers were opened in various parts of the country, which have been serving as bases for receiving the immigrants called and collecting their biometric data. According to calculations by AIMA president Pedro Portugal Gaspar, of the stuck applications, more than 150,000 are currently being processed and 108,000 will be called again after being rejected.

🟡 Diplomats from the countries present at the meeting are concerned that the regularization process will end up being rushed, since there is a deadline for the backlog to be cleared: June 2025.
🟡 Representatives from the countries even offered to establish possible partnerships with AIMA to provide information about their citizens. For the Portuguese agency, the meeting “was very fruitful, since it allowed for closer relations with representatives of more than half of the migrant population in Portugal.”
