So today when the ordinance officer was here he told me someone was coming out of my shed last time he was out here he asked if I knew the guy was out there and I said no I was at work but he has some tools in my shed and has permission to be there He says probably making m**h. Now how is that OK to make statements like that about someone with no proof of anything even remotely close to that. Who else does he talk about this way. It's just so unprofessional so someone was making m**h in my shed someone with no drug charges or convictions ever. Seems very unlikely to me.I guess if you don't like someone you can just say anything about them wow just wow and this is who is sneaking around in our yards without permission this is who opens gates and ignores no trespassing signs who breaks the law on a regular basis this has to stop really this is just nuts

ordinance man stopped over and almost acted human . You can tell a lot about whos running the township by who they hire . If you need a retired police officer to enforce local ordinances you have issues . they are used to dealing with criminals all day every day so don't expect someone with any kind of professionalism to come walking up.

I'm moving out of Hagar township no longer feel safe here . With the townships obvious harassment. Just cant do it anymore this Ordinance officer is very threatening and always turns his body cam off . My place is posted and gated yet he has been in my yard at least 30 times in 2 years . I have no privacy and to be honest I just don't feel safe. The township preaches health of the community but one look at their own property and you know that's BS. I will be posting plenty of videos showing just how bad it is . You can make your own judgement .

it would seem that if they cant fly around and take pictures that walking around with a camera would not be allowed its. Just common sense really . if you are collecting evidence to use against someone you should have a warrant.

Drone Surveillance and the Fourth Amendment: A New Case

In a recent decision, the Michigan Court of Appeals held that persons have a reasonable expectation of privacy in their property against drone surveillance conducted without a warrant or pursuant to a recognized exception to the warrant requirement. The case, Long Lake Township v Maxon, involved a civil zoning dispute in which the Township used a drone to take aerial images of the Maxon property without consent or any other specific legal authorization.

The Court of Appeals found that drone surveillance of private property is necessarily more intrusive and “qualitatively different” than the use of airplanes and helicopters permitted under California v Ciraolo and Florida v Riley. The Court noted that drones can fly at lower altitudes and hover in place, allowing them to collect more detailed images and information about private property.

The Court also found that the use of low-altitude unmanned drones to conduct targeted surveillance of private property is more like the use of thermal imaging devices found to be a “search” in Kyllo v United States. In Kyllo, the Supreme Court held that the government’s use of a thermal imaging device to monitor the radiation of heat from a home was a Fourth Amendment search. The Court reasoned that the government’s use of the thermal imaging device was a physical intrusion into the home’s curtilage, which is an area around the home that is considered to be part of the home itself.

The Court of Appeals in Long Lake Township v Maxon found that the Township’s use of a drone to take aerial images of the Maxon property without consent was a similar physical intrusion into the Maxon property. The Court also noted that the existing law in Michigan recognizes a reasonable expectation of privacy and other legal protections against drone misuse.

OK so what does talking to someone have to do with breaking a ordinance. My code enforcement officer keeps saying as long as talk to him I'm good .But I don't need more friends so I get a citation when if I was just nicer and talked to him I would not get one That sure seems like select enforcement and a violation of the law to me. I'll consult an attorney about this one I'm tired of messing with him Tried talking to his boss doesn't seem to be going anywhere

Getting tired of telling this ordinance man to stay of my property. The man just ignores no trespassing signs and gates and continues on to try to collect evidence against me . Seems like he would know better being a ex berrien country sheriff. Maybe they dont look up current law and decisions coming down from higher courts . He will figure it out I guess
