The Monroe County Board of County Commissioners amended Monroe County Ordinance 014-2020 to add stricter penalties for non-compliance of wearing facial coverings, a mandatory three-day closure for cleaning and disinfection of business establishments with an employee who test positive for COVID-19, and the ability for county or municipal code compliance officers to issue a notice to appear or civil citation upon observation of a violation along with local law enforcement.

Monroe County requires all persons over the age of six to wear a facial covering whenever away from their home and unable to engage in social distancing, whether indoors or outdoors. Every person over the age of six who is away from his or her residence shall carry a face-covering capable of immediate use.

The ordinance requires operators and employees of business establishments to ensure customers comply within the establishment. A face covering MUST cover the nose and mouth and may include a face mask, homemade mask, or other cloth, silk, or linen covering, such as a scarf, bandana, handkerchief, or other similar cloth covering. There is an exception for those seated at a restaurant while eating or drinking, and for gym and barbershop patrons. Exceptions can be found at www.monroecountyem.com/covid19.

The mandatory facial covering directive applies throughout Monroe County and the municipalities, but the municipalities may impose additional restrictions. Key West does have a stricter facial covering requirement for those to wear a facial covering regardless of social distancing while outside the home.

A law enforcement officer may arrest or issue a notice to appear for any knowing and intentional violations committed in his or her presence or through an arrest warrant. Violations shall be prosecuted by the State Attorney of the 16th Judicial Circuit. A person found in violation may be punished by up to 60 days in the County jail and/or a fine of up to $500.

The amendment allows a county or municipal code compliance officer, as well as a law enforcement officer, upon observation of a violation by a person who does not immediately put on a face-covering after receiving a warning, to issue a notice to appear or civil citation to appear in County Court. Any person or business establishment prosecuted under this subsection and found in violation of this ordinance may be punished by a fine of up to $500. Code officers can also issue an administrative notice of violation with fines of up to $1,000 for a first offense and $5,000 for a repeat offense. Each day a violation of this ordinance occurs is considered a separate offense.

In addition to the facial covering amendments, each operator of a business establishment must close to the public that establishment for at least 3 days if the operator or an employee of the establishment tests positive for COVID19. Before reopening, the operator must disinfect the premises of the business establishment according to guidelines provided by the Centers for Disease Control and the Department of Health. Any operator or employee exposed to the positive employee must quarantine and/or isolate for 14 days from the date of the last contact with the infected employee or until a valid negative test for COVID19. The closure provision does not apply to essential businesses as defined by Executive Order 20-91, as amended.

“Because of the continued threat of COVID-19 in areas outside of Monroe County, not allowing visitors back to the Florida Keys will still be in place throughout May, and potentially longer given the state of the virus,” county officials said in a statement.

Coronavirus Update for Florida Keys:

Earlier this week, the first confirmed coronavirus patient in Florida was interviewed by a Sarasota/Bradenton iHeart radio station. While the person’s name was kept confidential, the information the 61-year-old Manatee County male communicated on-air matched that reported to the Florida Department of Health. Specifically, the man reported that he believes he contracted the disease during a Key West stay that ended Feb. 9, 2020.

The health department conducted an epidemiological investigation, but found no evidence to support that it was contracted in Key West. Because no other confirmed coronavirus cases have emerged on the island and the incubation period from this case has passed, there is no epidemiological evidence that the patient’s infection originated in Key West.

As of Thursday morning, there are no confirmed cases of the virus in the Florida Keys and there are no people in the Keys currently under investigation, according to Bob Eadie, the administrator and health officer for the Florida Department of Health in Monroe County, who added that the risk for coronavirus transmission in the Keys is low at this time.

It is important to understand that the coronavirus situation is extremely fluid and changing on a daily basis.

• The health and safety of Florida Keys visitors and residents are a top priority.

• There have been no confirmed cases of coronavirus in the Keys and currently there are no potential cases being investigated, according to Bob Eadie, the Keys’ top health official.

• There are no travel restrictions to and from the Florida Keys at this time.

• Keys county and municipal officials are prepared and continue to prepare to aggressively deal with coronavirus, if needed. Officials and the Keys medical community are on high alert to respond, if necessary.

• Cruise ship passengers traveling to the port of Key West are aggressively screened for symptoms of COVID-19 before boarding and are monitored while onboard. All cruises that dock in Key West originate from U.S. ports.

Rowell’s Waterfront Park – at mile marker 104.5 on the Overseas Highway in Key Largo – is reopening this morning, Sept. 20.

The 8-acre, kid- and dog-friendly park along Florida Bay, has been closed for the past few months due to its use as a staging site for Hurricane Irma marine debris that is being cleared from canals.

The park is still being used as a staging site, but only a small portion on the northeast side is being used. That area has been fenced off and the rest of the park, including the waterfront, now can be used by the public.

Rowell’s is reopening as a passive park, with picnic tables, benches, a place to swim (at your own risk) and a launch for kayaks, canoes and standup paddleboards. Boats and personal watercraft are not allowed. Admission to the park is free.

The park will be open seven days a week, from 8 a.m. to 30 minutes after sunset.

For more information about the County’s parks and the available amenities, go to the County’s website:
