Made aware that another large local management company is closing, overstaffed, with properties either being sold or converted to long-term rentals. Saturation of the market, and inflation( higher mortgage rates, etc.,) are considered to be the factors. Single-owner properties, if not the main income and smaller management companies are better positioned . We survived Covid and will get through this...

Interesting posting regarding POA's in FloridaHOA Bill of Rights (House Bill 919) - Do you know them? Effective October 1, 2023, the Florida Senate has revised the requirements for the governance and regulation of HOAs:
1. Require all notices for homeowners’ association board meetings to specifically identify the agenda items for the meetings;
2. Revise the requirements for the association’s use of a member’s e-mail to send notices, including allowing a member to designate an address different than the property address for all required notices;
3. Require that, if a homeowners’ association collects a deposit from a member for any reason, including to pay for expenses that may be incurred as a result of construction on a member’s parcel or other reason for such deposit, such funds must not be comingled with any other association funds, the member may request an accounting of such funds, and the association must remit payment of unused funds within 30 days after completion;
4. Provide that an officer, director, or manager who accepts kickbacks is subject to monetary damages under s. 617.0834, F.S., relating to the conditions imposing civil liability on the officers and directors of corporations and associations not for profit;
5. Provide that an officer or director must be removed from office, and their access to official records denied, if charged with the crimes of forgery of a ballot envelope or voting certificate used in a homeowners’ association election, theft or embezzlement of association funds, destruction of or refusing to allow inspection of association records, if such records are accessible by association members, in furtherance of any crime; or obstruction of justice;
6. Require directors and officers of an association, including a developer-controlled association, to disclose specified activities which may pose a conflict of interest;
7. Clarify that a developer’s appointment of an officer or director does not create a presumption that the officer or director has a conflict of interest with regard to the performance of his or her official duties;
Revise the notice requirements for imposing and collecting fines, including providing members notice of how to cure a violation, if applicable; and
8. Provide criminal prohibitions related to fraudulent voting activities that are punishable as first degree misdemeanors, including preventing members from voting, and menacing, threatening, or using bribery to directly or indirectly influence or deter a member from voting.

If you suspect you are being maliciously fined, your money is going towards kickbacks or you identify ridiculous/unjustifiable costs estimations on the budget, you have a right to object to fines levied!

Levying fines is a tactic frequently used to silence resident voting power and prevent members from serving on Committees on the trumped-up grounds of 'owed HOA Assessments'.

Another tactic used is to sign e-mails as collectively "The Board" of the HOA to minimize accountability and individual responsibility of officers. It is clear in the Bill of Rights members have a right to challenge individual Board members and their conduct and report suspicious wrongdoing.

The Senate is very clear on standards for Fines, Suspensions and Liens; Enforcement of Covenants and Rules; Financial Reporting & Accounting; and the Education and Training of Officers.

Many HOAs provide a 'budget' with 'unjustified' numbers. These documents do not meet SEC or Financial Accounting Standards Boards guidelines. For example, my HOA 'budgeted' $26,000 for mulch in 2024 and the Board 'approved' it. Yet all houses are responsible for their own gardening. This in addition to $111, 999.15 for Landscape Maintenance; $8000 for Tree Enhancements and $7553 for Annual Flowers. $32,400 was budgeted for security services and security services equipment - yet we do not have manned security or a security cabana. The Board has 'approved' all these.

Florida Homeowner rights have been subjugated, exploited and disregarded for years. As a result of HOA fraud, the government is making changes.

Recently booked and paid for a 7 bed house/ pool for 14 guests. Short story . The ' Hosts' claimed they did not manage/own the property . Airbnb should have verified that property was live , active BEFORE ACCEPTING BOOKING AND PAYMENT !! Left our 14 guest stranded until we booked on another platform.
Airbnb's policy should be re-evaluated as the resolutions offered were not timely, totally ineffective . Overall appalling

What are the new eligibility requirements?

1. Acceptance rate: 95% or higher (previously 90% or higher)

• But don’t forget – you can regain Premier Host status at any time during the year as soon as you meet eligibility requirements.

If I lost Premier Host status, do I have to wait a full quarter to rejoin?
