A little story...

Back in 1986, I was involved in a near fatal motorcycle accident. I certainly owed a huge debt of gratitude to all those people who worked hard to save my life and I knew that I had to find a way to pay it forward somehow.

In 1991, I decided to take a course at Pruner Ambulance (Now AMR) and qualified as a Certified EMT.

Since I spent a lot of time on the road due to my occupation, I found myself in many situations where I was fortunate enough to be of some meaningful assistance. The story below is one such instance.

On a bright sunny Friday afternoon in October of 1993, I was on my Yamaha RZ350 motorcycle, returning to the San Fernando Valley after dropping of a delivery in Ventura. As I got on the Southbound 101 on-ramp, I noticed that traffic was at a standstill. I split traffic for about 1/2 mile and saw that there had been a multi-vehicle accident on the bridge going over the Ventura River.

As I approached, I noticed the accident must have happened only minutes prior as there were no emergency personnel on the scene. I could see that things were a bit chaotic so I knew I had to stop and help. I could smell gasoline the noticed quite a bit of it on the roadway so I decided to stop about 100 feet away as to not ignite the fuel and then ran back to the scene.

There were several people injured so I began triage and found most of the injuries to be relatively minor...except for one. A woman in a green station wagon was pinned inside the vehicle on the passenger side and was in great pain. There were some bystanders attempting to get her out of the vehicle, which I knew would only make things worse, so I was able to identify myself as an EMT and asked that they not move the woman.

I knelt down beside the woman, took some vitals and asked her pertinent medical questions to ascertain her condition so I could relay that information to Paramedics when they arrived. I spoke with her and was able to calm her down as bystanders provided me with blankets to keep her warm and I applied traction to her head/neck to prevent any further possible spinal injuries.

A short time later, Paramedics and Firefighters arrived at the scene. I gave them a rundown of the woman's condition and proceeded to move out of the way so the professionals could go to work. One of the Firefighters must have noticed the EMT patch on my leathers and before I could leave...he handed me some latex gloves and asked that I continue to maintain traction on the woman's head/neck while they began the process of extraction.

After a few minutes, Firefighters were able to use the ‘Jaws of Life’ to free the woman and together we extricated her and secured her to a back board.

Having no reason to remain on scene, I made my way back to my motorcycle. When I got to my bike, I saw a Firefighter walking toward me and asking me to wait up. When he got to me...he reached out, shook my hand and said thank you for my assistance. I have to tell you...it was one of the proudest moments of my life. I mean...here this professional Firefighter walks all the way out to where I am to thank me...man that felt awesome.

As I was starting to ride off...I noticed a woman on the side of the bridge waiving me over to her. When I approached, I noticed she had a camera and a very large lens. She told me she was a reporter for the Ventura Star News and asked if I was a doctor. I told her that I was a Certified EMT and stopped simply to help out. She then asked me my name and I jokingly asked if I had made the front page. She giggled and simply said..."just check out tomorrow’s news paper."

Much to my surprise, I did make the front page...what a great feeling that was and I will never forget it.

I never intended to receive any notoriety for these things, I just wanted to pay it forward as I mentioned above. But the wonderful things I got in return made this day one to remember for the rest of my life.

In case you were wondering, my understanding was that while the woman in the station wagon had numerous and serious injuries, she recovered fully.

Service of Process in California...What is the true value of proper service?

When it comes to providing Service of Process in California, it is not unusual for perspective clients to first ask what our rate for serving documents will be, even before we get the pertinent information about the documents they need served.

While everyone wants to save a few dollars these days, this can be a double edged sword when it comes to serving process in California.

Having been a Professional Process Server in California for many years, I've been called in to testify in cases where the defendant has lost the case after a long legal battle and now their legal counsel is trying anything and everything to get the case dismissed for improper service.

Fortunately for our clients, Amstar Legal holds a very high standard with regard to proper service and record keeping and we will not lower our standards of service to our clients by attempting to compete with lower priced economy services.

The extra few dollars our clients paid Amstar in these cases, paid for itself a thousand fold when it counted most…when an attempt to quash a Service of Process we provided was unsuccessful.

Many do not realize that Service of Process is one of the most important aspects in any legal case and can quite literally make or break a case if successfully challenged. Imagine all the time, effort and money that would be lost if one had to start over due to how a legal document was served at the outset of the case.

Here’s the good news! Service, Locate and stakeout fees are recoverable costs (CCP 1033.5(4)(B). So why not get the best possible Registered Process Servers in California working for you. The few extra dollars you invest today could pay HUGE dividends if push comes to shove in your case.

What is NOT recoverable are bad serves conducted by inexperienced or low standard 'bargain' process servers and the significant frustration and financial loss this can create.

These were taken in 2002 at what is now known as the Auto Club Speedway in Fontana. There is a road course on the infield section of the super speedway.

I was there with the SVTOA, with whom I did some Racing Instructor duties. Pretty posh venue compared to Willow Springs or Buttonwillow Raceways in that the pit areas were indoors...with air conditioning and compressed air provided in each pit stall...awesome!

This was not a racing event per se...it was more a run what ya brung type of event...but you still had to pass tech for safety of course. Anyway, had a great time taking passengers around at speed.

Some good friends of ours are experiencing a very difficult situation. They operate a tutoring club in various locations including Fountain Valley, CA. Yesterday (8/19/13), an elderly man lost control of his vehicle and plowed into the tutoring center at approx. 12:30 P.M. - One of the victims is in critical condition and several others were seriously injured. We ask that you send your prayers for all the victims in this tragedy.

Process Servers - Commoditization vs. Solid Service Quality

With the economy the way it is, everyone is looking to cut expenses. Who can blame them? What with Los Angeles and other county courts shortening hours, closing venues and reducing services, we are witnessing historic but negative events here in California and elsewhere in the nation.

But let's just look at this for a moment. We've all heard the phrase "Penny wise & Dollar foolish", but that is just what is happening to the Service of Process industry in California and elsewhere. To me, this is a scary lack of forward thinking, considering an entire case can be wiped out months into the fray by a service of process that was done incorrectly.

It may come as a surprise to many that a person does not have to know the first thing about Process Serving to get registered. All you have to do is pay your fees, get fingerprints and be DOJ approved.

I've known servers who don't even know the basic rules for service and yet, they are busy busy busy, serving documents for Attorney's and others for fees that are too embarrassing to mention, but appears to be the only reason they get the work in the first place.

It amazes me when hundreds of thousands or even millions of dollars are at stake, but the people serving are hired based in large part for how cheaply they will serve legal process papers. This is what I feel is the root cause of some of these "Sewer Services" we've heard about, as Process Servers have been relegated to the status of a pizza delivery guy. In my opinion...this is a slap in the face of every Registered Process Server out there who takes their position and responsibility seriously as a legal professional and took the time to get training. Further, I feel it makes a bit of a mockery of the Judicial System as well.

So I have to ask the question. Just how motivated is someone going to be about preserving the integrity of the law when Registered Process Servers, one of the most important jobs in the legal process, are paid peanuts for there efforts.

So my message is this. If you're looking for a Process Server in Los Angeles or anywhere in the United States. Ask a few questions other than "How Much"...as the money you save with an inexperienced or under educated process server, could cost you more than you expect in the long run.
