**Governments decisive action to end "Visa Hopping" migration system**

A key commitment outlined in last year's Migration Strategy. This strategy aims to close the loopholes allowing temporary visa holders, particularly international students, to indefinitely extend their stay in Australia.

Key Measures:

1. Visitor Visa Restrictions:

From 1 July, Visitor Visa holders will no longer be able to apply for Student Visas while onshore. This measure addresses the increasing trend of individuals using visitor visas to circumvent strengthened offshore student visa integrity measures. Over 36,000 applications were made through this pathway from 1 July 2023 to the end of May 2024.

2. Temporary Graduate Visa Restrictions:

Temporary Graduate Visa holders will also be restricted from applying for Student Visas onshore. This change follows findings from the Grattan Institute’s "Graduates in Limbo" report, which highlighted that 32% of Temporary Graduate Visa holders return to study to extend their stay. The government aims to encourage these graduates to secure skilled jobs and pursue permanent residency or leave the country, reducing the phenomenon of 'permanently temporary' residents.

3. Supporting Changes:

- Post-Study Work Rights Reduction: Temporary Graduate Visa holders will face significantly shorter post-study work rights.
- Age Limit Reduction: The maximum age limit for these visa holders will be reduced from 50 to 35 years.
- Increased English Language Requirements: Stricter English language requirements, implemented in March, will also apply.

These measures are designed to support the government’s plan to halve net overseas migration by the next financial year, ensuring a more strategic and planned migration system.

** New Legislation for Australia's International Education Sector Announced today! **
Next week, the Albanese Government will introduce legislation allowing the Minister for Education to set an allocation for the maximum number of international student enrolments based on sector advice.
Enrollment caps for vocational education will be informed by the Minister for Skills and Training.
• Prevent education providers from owning education agent businesses.
• Suspension of applications for registration from new international education providers and of new courses from existing providers for periods of up to 12 months.
• Require new providers seeking registration to demonstrate a track record of quality education delivery to domestic students before they are allowed to recruit international students.
• Cancellation of dormant provider registrations to combat misuse.
• Ban on recruitment by providers under serious regulatory investigation.
• Improve the sharing of data relating to education agents.
• Ban on agent commissions for student transfers to prevent unethical practices.
Release of the draft International Education and Skills Strategic Framework to guide sustainable and managed growth, emphasizing quality and integrity. Universities exceeding the international student cap must provide additional purpose-built student accommodation.

From 10th May 2024, Increase to the Financial Capacity Requirement for Student and Student Guardian visas.
You may be required to show Higher Funds now due to changes in legislation about the financial requirements depending on your education provider assessment level rating.
