* Important information regarding NHR changes*

After much speculation and the possibility of Portugal’s NHR tax regime shutting abruptly on 31 December 2023, the Portuguese government has just announced a transitional period for non-habitual resident (NHR) applications that will run from now until 31stDecember 2024, if by 31 December 2023 the applicant is considered officially registered as tax resident in Portugal and applies for NHR thereafter. It is therefore important to take action prior to 31 December 2023.

This welcome clarification comes after weeks of uncertainty and will reassure those who had planned to move full time to Portugal in the near term under the NHR that they can still apply in the coming weeks for the programme and take advantage of this very attractive tax planning option.

Currently the Portuguese NHR regime offers significant tax breaks for certain groups moving full time to Portugal, including workers, investors, retirees, and digital nomads.

However, uncertainty still surrounds the changes that may be made to the NHR regime since national elections will be held in Portugal on 10th March 2024 and the incoming government may then revise the NHR programme again.

Depois de muita especulação e da possibilidade de o regime fiscal dos RNH em Portugal ser encerrado abruptamente a 31 de dezembro de 2023, o governo português acaba de anunciar um período de transição para os pedidos de residente não habitual (RNH) que decorrerá até 31 de dezembro de 2024, se até 31 de dezembro de 2023 o requerente for considerado oficialmente registado como residente fiscal em Portugal e solicitar o RNH posteriormente. Por conseguinte, é importante tomar medidas antes de 31 de dezembro de 2023.

Este esclarecimento bem-vindo surge após semanas de incerteza e irá tranquilizar aqueles que tinham planeado mudar-se a tempo inteiro para Portugal a curto prazo ao abrigo do RNH, garantindo-lhes que ainda podem candidatar-se ao programa nas próximas semanas e tirar partido desta opção de planeamento fiscal muito atractiva.

Atualmente, o regime português de RNH oferece benefícios fiscais significativos a determinados grupos que se mudam a tempo inteiro para Portugal, incluindo trabalhadores, investidores, reformados e nómadas digitais.

No entanto, ainda existem incertezas quanto às alterações que poderão ser introduzidas no regime dos RNH, uma vez que se realizarão eleições nacionais em Portugal a 10 de março de 2024 e o novo governo poderá então rever novamente o programa dos RNH.
