The 90-day minimum rental obligation is just an attempt to discourage owners and property managers. Such constraints pose a burden on those who just want to rent out their homes for some additional income while they are not using them. TIARA invites the City of Tybee to be mindful of the consequences of this rule and reconsider.

As our Tybee Alliance continues to advocate for the rights of residents, businesses, and property owners across our island, it’s important to recognize the many ways in which the imposed ordinances lack basic logic.

One of the requirements of the 90-day rental rule, where property owners must successfully rent their homes for a minimum of 90 days to retain their vacation rental permit or have it permanently revoked, is that the listing must also be at “full market value.”

This is a strange and inconsistent rule because there is no clear definition for what is considered “full market value”. This tricky wording is just one of the many examples of city governments doing anything they can – sensical or not – to take away the rights of owners.

As a , we need to band together against these increasingly strict ordinances. Confusing language and harsh statutes create a minefield amid these regulations where residents can unwittingly step on and see their retirement hopes go up in smoke.

Vacation rentals generate $4 million in income each year for . Now, as the city government is revoking with harsh restrictions on vacation rentals, who will foot the bill for this massive decrease in local revenue?

With no clear plan or path, the future for residents seems murky – especially for those whose businesses rely on visitor spending to keep running.

Vacation rentals are a significant source of revenue for the local economy on . With the city of Tybee continuing to restrict operations with increasingly unjust legislation, who will foot the bill when the annual $4 million in generated by disappears?

Providing fewer accommodation options limits access to the island, meaning less foot traffic and spending at local shops and businesses. Who will cover the losses that local business owners face that mainly cater to tourists? Or, when those shops are forced to close, who will cover the city’s lost tax revenue?

Tybee residents want to know the city’s plan for recovering millions of dollars in lost revenue in an attempt to turn our welcoming vacation island into a private one. Will the locals be left to foot the bill, or will the services and infrastructure be left to crumble?

Although no plan has been presented, residents and business owners deserve an answer and clear insight into our future.

Tybee Alliance filed a second lawsuit in the Superior Court of Chatham County to challenge the legality and enforceability of short-term rental ordinances.

Our coalition of local businesses and residents, Tybee Alliance, filed a second in the Superior Court of Chatham County to challenge the legality and enforceability of short-term rental ordinances adopted by the Mayor and City Council.

We asked the court for a declaratory judgment that the regulations approved on October 13, 2022, are invalid because they are not in accordance with the Constitution, the Georgia Code, and the City’s Charter.

Neither of the two ordinances was presented in written final form before implementation. Both were orally amended at the same time as the motion for approval and then revised following the meeting. This process directly conflicts with the City Charter, which requires every finalized ordinance to be introduced in writing.

The Georgia Supreme Court has also held that municipal governments must strictly follow specific practices when passing a local ordinance – which is why we are holding the council accountable for failure to follow procedure. In the name of transparency and open government, this farce cannot be allowed to masquerade as sound public policy.

Short-term vacation rentals are an extremely important part of the economy of . In 2021 alone, created $4.2 million of tax revenue, which was more than half of the money generated by the hotel/motel tax.

Almost half goes to the city’s general fund, which includes administration, public works, and public safety. A further 20% goes to marketing the island and generating more tourism in a self-sustaining cycle.

After months of collective effort to negotiate in good faith with Tybee Island officials, we feel that no substantial progress has been made and we have no faith that further fruitless negotiations will prove beneficial to our effort to protect property rights, subvert government overreach, and safeguard a vital foundation of the Tybee Island economy.

This morning, The Tybee Alliance filed a lawsuit against the City of Tybee Island challenging the legality of existing Short-term Vacation Rental ordinances.

After months of collective effort to negotiate in good faith with Tybee Island officials, we feel that no substantial progress has been made, and we have no faith that further fruitless negotiations will prove beneficial to our effort to protect property rights, subvert government overreach, and safeguard a vital foundation of the Tybee Island economy. ode, and the City’s Charter. Should the City Council enact further unlawful restrictions, we will add the problematic amendments to the lawsuit we filed this morning.

We’ve had enough.

After over a year of a moratorium on permits for STR’s, the City is now only one vote away from adopting even further unnecessary and arbitrary restrictions. The City has already amended its STR ordinance eight times since it was initially adopted in 2016. Enough is enough!

Homeowners can no longer sit idly by while their rights are taken away by three members of the City Council, who have stubbornly ignored feedback from the majority of property owners and stakeholders.

Filed in the Superior Court of Chatham County, the lawsuit seeks injunctive relief and declaratory judgment to defend property rights and stop the abuses heaped upon STR owners by the City. The lawsuit specifically petitions the Court to declare the existing ordinances invalid and unenforceable because they are inconsistent with the Constitution, the Georgia Code, and the City’s Charter. Should the City Council enact further unlawful restrictions, we will add the problematic amendments to the lawsuit we filed this morning.

Tybee Alliance is a 501 (c) (6) that was formed to create an alliance of stakeholders interested in the responsible growth and economic viability of Tybee Island. Our coalition is composed of full-time Tybee residents, Tybee business owners, realtors, homeowners, short-term vacation rental managers, and so many more.

Given the events and discussions at last night's council meeting regarding STRs, we need support for property rights more than ever.

𝐓𝐈𝐀𝐑𝐀 𝐬𝐮𝐩𝐩𝐨𝐫𝐭𝐬 enactment of a short-term vacation rental ordinance which is legal, equitable and enforceable.

𝐓𝐈𝐀𝐑𝐀 𝐬𝐮𝐩𝐩𝐨𝐫𝐭𝐬 the clarification of occupancy limitations for overnight usage of two adults per bedroom plus two additional adults.

𝐓𝐈𝐀𝐑𝐀 𝐬𝐮𝐩𝐩𝐨𝐫𝐭𝐬 the City’s proposed definition of an adult as any person over the age of fifteen years old for the purposes of this ordinance.

𝐓𝐈𝐀𝐑𝐀 𝐬𝐮𝐩𝐩𝐨𝐫𝐭𝐬 City enforcement of nuisance ordinances for violations related to noise, trash, parking and disorderly conduct.

𝐓𝐈𝐀𝐑𝐀 𝐨𝐩𝐩𝐨𝐬𝐞𝐬 codification of a numerical cap particularly when the cap is based on subjective, unvalidated numbers. Adoption of a cap necessitates inclusion of language which addresses the re-permitting of properties that currently have STVR permits. A temporary extension of the moratorium would be a preferable alternative to adoption of a numerical cap provided that new owners of properties that currently have an STVR permit must be allowed to re-apply for a permit during this period. This would address owners’ concerns regarding re-permitting and would avoid disruption of future guest reservations which are already booked.

Should the City Council elect to include a numerical cap on permits, 𝐓𝐈𝐀𝐑𝐀 𝐬𝐮𝐩𝐩𝐨𝐫𝐭𝐬 inclusion of language to create a path for the new property owner of an existing STVR in good standing to re-apply for a permit and to provide assurance that the City will grant the new rental permit even if the numerical cap has already been reached. To that end, 𝐓𝐈𝐀𝐑𝐀 proposes:

Re-permitting upon transfer of ownership; Under section 34-261 add the following:

On Thursday night, the Tybee City Council took a step toward passing new short-term vacation rental (“STVR”) regulation which include some wins for property owners and businesses, as well as some areas that still need some work. Thank you to everyone who spoke at the Council meeting, called or emailed Council Members, and submitted formal comments to the City.

𝗧𝗵𝗮𝗻𝗸𝘀 𝘁𝗼 𝘆𝗼𝘂𝗿 𝗲𝗳𝗳𝗼𝗿𝘁𝘀, the Council increased the occupancy level to the industry standard of “2 adults per bedroom plus 2.” 𝗧𝗵𝗲𝘆 𝗵𝗲𝗮𝗿𝗱 𝗳𝗿𝗼𝗺 𝘆𝗼𝘂 𝗹𝗼𝘂𝗱-𝗮𝗻𝗱-𝗰𝗹𝗲𝗮𝗿 𝗮𝗻𝗱 𝘃𝗼𝘁𝗲𝗱 𝘁𝗼 𝗳𝗶𝘅 𝘁𝗵𝗮𝘁 𝗮𝘀𝗽𝗲𝗰𝘁 𝗼𝗳 𝘁𝗵𝗲 𝗽𝗿𝗼𝗽𝗼𝘀𝗲𝗱 𝗼𝗿𝗱𝗶𝗻𝗮𝗻𝗰𝗲.

Unfortunately, the critical issue of transferability of permits when a property is sold or transferred has not been fully addressed yet. Thanks to your education efforts, the Council understands the importance of transferability, but they are not sure how to deal with it equitably yet and their current approach creates some problems. We plan to provide the Council and staff with examples of what works well in other communities in hopes of addressing this critical matter over the next two weeks prior to passage of the ordinance.

The proposed ordinance also contains a temporary cap of 760 permits in certain residentially-zoned areas. The cap will sunset in June or sooner if the Council adopts more specific language. Of course, there are still many details to be worked out, so we will continue to follow this process closely and communicate with you.

Tybee Island vacation rental owners and management firms support fair, equitable, enforceable regulations for short-term vacation rentals. The Tybee City Council must take the time to fully consider this complex issue and base decisions on sound data or they risk damaging our biggest and most vital industry on Tybee: 𝙩𝙤𝙪𝙧𝙞𝙨𝙢.

If your business relies on visitors spending money on Tybee, then the Tybee City Council needs to hear from you! Please speak up now to the City Council Members and tell them not to kill Tybee tourism with a punitive, unenforceable, unequitable anti-STVR ordinance. The issue has been fast-tracked to go before Council on October 28th, so speak up now and tell them to slow down and get it right!
