Short Term Rentals are back on the agenda with very little notice. The Quality of Life committee is meeting on Monday, September 16 ( TOMORROW). A live stream is available. The meeting is scheduled to start at 9AM and will be available on Channel 16. The STR Update is the second agenda item, so it likely will be brought up a bit after the 9AM start. If you are not receiving Chad West's newsletter, we encourage you to sign up. He is one of the three members who voted against the ban last year.

An analysis found nearly 11,000 short-term rentals in Houston. There were more than 60,000 emergency calls in the vicinity of those properties over the past year.

THIS JUST IN!

Our Appellate court date is 9/10/24, 2pm. The hearing will be held at the Merrill Hartman Courtroom at the George L. Allen Sr Courts Building and is open to the public.

The format will be lawyers for both sides arguing the merits of their cases for 20 minutes on each side and then a 5-minute wrap-up from the City of Dallas. No witnesses will be called.

Following our injunction win in December allowing us to continue operating, the City of Dallas filed an appeal to have that decision reviewed by another court (Appellate). We are waiting on a date for the appeal hearing later this summer. Check back here for the latest updates!

CHECK INTO FORWARD DALLAS...

The Dallas City Plan Commission ( CPC) has come out with a proposed new zoning framework to guide future growth that is currently being circulated for public input. Of note is that several residential neighborhood changes are being proposed:

Auxiliary Dwelling Units by right (garage apartments/pool cabanas)
Smaller minimum lot sizes
Duplex, Triplex, and Fourplexes allowed in vacant lot areas
Apartments up to nine units allowed in vacant lot areas

The next opportunity to provide input to the CPC is 5/9 from 6-9 at City Hall.

PLANO BANS NEW SHORT TERM RENTALS If you ever needed a better reason to donate to the DSTRA legal fund. Here it is: The Plano City Council voted on Monday to pass citizen-proposed short-term rental regulations after hearing testimony from several members of the Texas Neighborhood Coalition's Plano chapter. The ordinance, which was drafted by the group, bans new short-term rentals in single-family neighborhoods.

Overwhelming City data shows 80% of short-term rentals operate without any 311 or 911 calls, that they have limited measurable impact on neighboring communities and there is no evidence of a city-wide impact. STRs deserve their place in Dallas and should not be banned.

CAN WE RENT A ROOM OUT OF OUR HOUSE AS AN STR?

Yes, you can rent a room inside your home as an STR. You will need to look at each platform's requirements to make sure you qualify. You will also want to make sure that it will work with your lifestyle and schedule. Short-term rentals are a lot of work to do RIGHT and we encourage our membership to run responsible, well-managed STRs.

The new registration ordinance passed 6/14/23 allows one room allowed per property. However, note that that is on hold due to the injunction.

WHY DO WE HAVE TO PAY HOT?

By law, the State requires us to pay HOT even though we are not hotels. It is automatically deducted by Airbnb and remitted to the State on every reservation.

By law, the City also requires us to pay HOT, though it is not automatically deducted/remitted by the platforms. You have to set up yourself or
submit payment on a monthly basis:

WHAT IS HOT?

HOT is Hotel and Occupancy tax and is assessed by the State of Texas and by the City of Dallas. HOT money can only be used for tourism and promotion, it cannot be used for code enforcement or any other State/City expenditure.

HOT money in Dallas supports institutions such as the DMA, Fair Park and the convention center.
