On January 21, 2018 3 members of a site I own (Airlinebuzz.com), that already had a discussion group and an official facebook presence and page created a duplicate discussion group on facebook. The group is called the “The Airline BUZZ” and uses the copyrighted and trademarked name and slogans including “the buzz” on a daily basis throughout the group and the posts.
I have approached one of the group creators and moderators to be added as a moderator since the group was using my copyrighted material and intellectual property, he refused. It is his position and apparently the position of the other moderator/creators that they have the right to use my copyrighted material and intellectual property as their own because they disapprove d of the way the original and official site was being run. The member who I approached actually had a moderator role on the original site yet he never approached me with his concerns and is still in fact a moderator on the original site.
The only way to remove any trace of all of the copyrighted property from the unofficial facebook discussion group would be to completely shut it down since the copyrighted property has been used daily since the beginning.
I believe this unofficial group not only confuses members (and potential members), but it also distracts and degrades the value of the brand and the copyrights that I have owned since the original site’s inception in 2002.
As the rightful owner of the brand and copyrights since 2002 I felt it only fair that I have a hand in moderating a group using my brand without obtaining my permission first. I was willing to allow the group to continue under a shared control arrangement to as to now discount their work and efforts yet they have refused.
I don’t have the desire or patience for a legal fight over the use of my copyrighted name and intellectual property thus I am now selling the brand and domains. I have had a few offers over the years from travel sites and I am now going to openly sell with a condition of the sale that the new owner legally pursue the moderators and creators of the unofficial group in civil court for copyright violations.
