According to the Immigration Act of 2002, ZEP holders have until 30 June 2023 to apply for a mainstream visa. This is subject to meeting the minimum qualifying criteria and meeting the requirements for an alternative visa category.

No further concession will be allowed, and as such, ZEP holders will no longer be able to extend their permits in terms of this special dispensation.

The Zimbabwean special dispensation started in 2009 and was called the Dispensation for Zimbabwe Permit ( ). This allowed Zimbabweans who were residing in South Africa, to legalise their status for work, study or legal business without prejudice. This dispensation was issued for a five-year period.

Currently, the issued in 2017 are valid until 30 June 2023, following the 6-month extension announcement made by the Minister of the Department of Home Affairs on 2 September 2022.

Zimbabwean Exemption Permit (ZEP) holders should take advantage of the 6-month extension granted by the South African government to apply for a mainstream visa or exemption. This is according to Marisa Jacobs, Managing Director at Xpatweb, an expatriate and international mobility services firm.

A ZEP holder only has to look at the limiting conditions reflected in their passport to realise the benefits of applying for a visa. First, they do not have the right to seek permanent residence in South Africa, regardless of how long they remain in the country.

Applying for a visa for which they qualify presents the possibility of one day enjoying permanent residence.

ZEP holders have been granted a grace period to 30 June 2023 to apply for a visa under an alternative category (subject to minimum qualifying criteria).

The Department of Home Affairs ( ) granted a final extension to 30 June 2023 for all individuals holding a Zimbabwean Exemption Permit ( ). The minister, Dr Aaron Motsoaledi, reiterated the point that the exemption will not be extended again, and this provides an opportunity for employers to retain their Zimbabwean employees legally.

With the countdown until 30 June 2022 underway, employers are encouraged to support their ZEP holder staff by submitting their application as soon as possible heeding the call by the Minister.

The process to apply for any of the above visa categories can be administratively burdensome and costly where you get it wrong. This is where proper planning and experience of the visa process, along with a solid relationship with DHA is worth its weight in gold, as it will greatly improve the probability of a successful application.
