IMPORTANT UPDATES:

Waiver applications: Applicants with waiver applications pending as of 30 November 2023, have been granted a blanket temporary extension until 30 June 2024. This is to allow time for the Department of Home Affairs to process the pending applications and for the applicants to be able to collect their outcomes and submit their relevant visa applications. Applicants who wish to abandon their waiver applications and depart South Africa will be able to do so on or before 30 June 2024 without being declared undesirable.

Long-term visa applications: Applicants with pending long-term visa applications as of 30 November 2023 have been granted a blanket temporary extension on their current visa status and conditions until 30 June 2024. Applicants who wish to abandon their visa applications and depart South Africa will be able to do so on or before 30 June 2024 without being declared undesirable.

Short-term visa applications: Applicants who have applied for a renewal of their short-term visa (90 days or less) but have not yet received their renewal visa outcome by 23 February 2024, must depart South Africa on or before 29 February 2024 to avoid being declared undesirable.

Appeal applications: Applicants with pending appeal applications on negative decisions for long-term visas have been granted a temporary extension on their current visa status and conditions until 30 June 2024. Applicants who wish to abandon their visa applications and depart South Africa will be able to do so on or before 30 June 2024 without being declared undesirable.

CAPE TOWN INTERNATIONAL AIRPORT BEST IN AFRICA FOR NINTH YEAR IN A ROW

South Africa has now enabled the same remote working incentive as roughly 50 other countries, including Australia, Brazil, Cayman Islands, Dubai, Germany, Portugal, Namibia and Mauritius, to mention some popular destinations.

The success of the remote worker visa speaks to attracting high earners to contribute to the South African economy and without taking local jobs.

QUALIFYING CRITERIA TO GET A REMOTE WORK VISA
This visa type is issued to an individual and not the foreign employer. However, the individual must be employed by a foreign entity, which means the employer cannot be a South African company.

The following criteria is noted in the Regulations –

- That the applicant will be conducting work for a foreign employer on a remote basis;
- That such remote worker earns no less than R1,000,000.00 per annum;
- Where the visa is issued for a period not exceeding 6 months within a 12-month period, the foreigner will not be required to register with the South African Revenue Services (SARS); and
- Where the visa is issued for a period longer than 6 months within a 12-month period, the foreigner must register with SARS.

Once you’ve identified the visa type, gather the necessary documents. These commonly include a completed application form, valid passport, travel itinerary, financial statements, invitation letters (if applicable), and any specific documents based on the visa category.

Step 3: Schedule an Appointment
Visit the VFS Global website to schedule an appointment at the nearest VFS office. Select the visa category and book a convenient date and time for submitting your application. Ensure you have all required documents before your appointment.

Step 4: Visit the VFS Office
On the scheduled date, visit the VFS Global office with your complete set of documents. The staff will assist you with the application submission process, verify your documents, and collect biometric data if required (such as fingerprints and photos).

THE DIRECTIVE ISSUED BY THE DHA INTRODUCES THE BELOW MEASURES WITH IMMEDIATE EFFECT:
1. For foreign nationals awaiting outcomes on their waiver applications:
Visa holders with pending waiver applications as at 30 November 2023, will receive a temporary extension until 30 June 2024. This extension allows the DHA to process their applications and enables applicants to receive their decisions and apply for appropriate visas. Visa holders who need to travel but are awaiting the outcome of a waiver application, will be allowed to exit and re-enter South Africa at a port of entry up to and including 30 June 2024, without being declared undesirable. However, applicants from countries that are not visa exempt who travel out of South Africa with a waiver application receipt, are required to apply for a port of entry visa which would allow them re-entry into South Africa.

2. For foreign nationals whose visa applications are still pending:
Long-term visa holders (for work, business, study, relatives, and accompanying spouses) whose applications remain pending as of 30 November 2023, will be granted a temporary extension until 30 June 2024, meaning maintaining their current visa status. However, these foreign nationals are restricted from engaging in any activities beyond those permitted by their existing visa conditions. Visa holders who need to travel but are awaiting the outcome of a long-term visa application, will be allowed to exit and re-enter South Africa at a port of entry up to and including 30 June 2024, without being declared undesirable. However, applicants from countries that are not visa exempt who travel out of South Africa with a long-term visa application receipt, are required to apply for a port of entry visa which would allow them re-entry into South Africa.

3. For foreign nationals whose appeal applications are still pending:
Visa holders who have appealed a negative decision on an application for a long term visa will receive a temporary extension until 30 June 2024. Visa appeal applicants who need to travel but are awaiting the outcome of an appeal application for a long-term visa, will be allowed to exit and re-enter South Africa at a port of entry up to and including 30 June 2024, without being declared undesirable. Applicants from countries that are not visa exempt who travel out of South Africa with an appeal application receipt, are required to apply for a port of entry visa which would allow them re-entry into South Africa. All appeal applicants are required to produce a copy of the rejection letter with a receipt for the appeal application on departure and re-entry into South Africa.

4. For short-term visa holders with visas valid for less than 90 days:
Short term visa holders who have applied for a renewal of their visa but have not receive the renewal outcome by 23 February 2024, will be required to make the necessary arrangements to depart from South Africa on or before 29 February 2024.

The above measures only apply to foreign nationals that have been legally admitted into South Africa and who have submitted an application via VFS Global on or before 30 November 2023.

The Critical Skills list is updated regularly to reflect the changing needs of the South African economy. In the latest update, which was published in the Government Gazette on October 2, 2023, two new occupations were added to the list:

Registered Nurse – Veterinarian
Registered Nurse – Veterinary Nurse

ZEP Permits Extended Until 31 December 2023

The Minister has extended the validity of ZEP permits (Zimbabwe Exemption Permits) by another 6 months until 31 December 2023. This will allow holders to make waiver and visa applications and await their outcomes (Home Affairs has recently noted that up to 1 500 applications by ZEP holders were being received per day), and also to grant time for the three court cases that challenge the discontinuation of the ZEP regime, to take their course. Although the extension does not provide them with any certainty as to their future in South Africa, it does bring some relief to Zimbabweans who would have otherwise had to leave the country by the end of the month. Those who have not yet applied for waivers or visas can now still do so until the end of the year.

Against previous trends, the Department of Home Affairs has been granting waivers to ZEP holders who are in secure employment, who study or who otherwise qualify for another visa. If you would like to find out what your chances for a mainstream visa are, please get in touch with our team.

Kindly note the below changes for TRV and PRP applications as of 13th April 2023

Immigration Directive No. 05 of 2023 regarding Police Clearance, Medical and Radiological Reports

1. Radiological Reports no longer required for any visa or PRP applications.

2. Medical Reports no longer required for any visa or PRP applications.

3. Police Clearance only required for the last 5 years where the applicant resided longer than 12 months in a different country. Any applicant who changes status and has been residing in the Republic for the last 5 years only requires a South African PCC. No PCC from Country of Origin or other country required unless if the applicant had been there longer than 12 months in the 5 years prior to submitting their application.

The Department of Home Affairs will introduce adjustments for applications for Spouse and Life Partner visas and permanent residency starting on February 1, 2023.

Here are the changes:

The applicant must go to VFS with their South African spouse or life partner on the day of submission, i.e., both the applicant and their South African spouse or life partner must be present at the VFS appointment.

The letter of support must be signed by the South African spouse or life partner in front of VFS representatives. The letter cannot be signed in advance by the spouse or life partner.

Two original passport photos for the applicant and their South African spouse or life partner are required as part of the application.
