Question: Do I need plans for a carport/lapa/swimming pool?
Answer: You need plans for pretty much everything, especially if it has a roof, such as a carport as well as boundary walls over 1,8 meters high. Even internal alterations to your house.

Q. Where do I start? Builder, friend or professional?
A. Only a SACAP registered professional is allowed to submit building plans. Your builder, friend or uncle does not know ALL of the bylaws and regulations as the professional does.

Q. Should I not get quotations from the builder first?
A. By all means discuss budget rates with a builder but never accept a quotation until you have an approved plan to confirm EVERYTHING that is being quoted on.

Q. How do I go about submitting a plan to my local council?
A. Your SACAP professional will know all the requirements of your local building control. They will have all of the required paperwork for approval, submit the plan for you and see that it is approved.

Q. I have built without plans. Can i make it legal?
A. Yes you can. Your SACAP professional will inspect the building and inform you if you need to make changes or if it complies with regulations. Plan submission and approval proceeds as normal.

Q. What are the cost implications for illegal buildings?
A. If you submit plans before getting notification from building control, you will have to pay an engineer to certify that the building is structurally sound. If you receive notification of illegal buildings before submitting plans, you will be liable fo
r a fine of over R500-00 per day until plans are approved.

Q. What must plans be submitted for?
A. Pretty much everything, including internal changes to your house, anything with a roof such as a carport or lapa, boundary walls, swimming pools and extensions to your house.

Fines for illegal buildings. I have frequently emphasised the need to submit plans for additions and alterations to your property regarding insurance, selling the property, etc. Councils are now implementing fines for illegal buildings. For example, from 6 October 2022, Ekurhuleni building control are fining owners of illegal buildings who do not take steps to legalise their buildings with fines ranging from R500 to R5000 per day. Thats right - per day! Other municipalities have or will shortly follow suit as required by law.

I visited a prospective client today and the only advise I could give him was to demolish the granny flat he built for his mom and start again. This is because he took the advise of a builder who had no clue of the building regulations.
With all due respect to the many competent builders out there, there are many more builders who have no idea of the regulations. Their job is to build, not to design. They would also like to start your job now rather than wait for plans to be produced and approved at council. Any responsible builder will not build until he has approved plans to work from.
The national building regulations is a full A4 lever arch file. Plus town planning regulations can change from suburb to suburb, never mind from town to town. Plus the recently introduced energy efficiency regulations. And then what about the clauses buried in your title deed?
If you are contemplating doing some building work on your home, get some professional advise before you start. Phone your local building inspector, he"s there to help you, Phone an architect, technician or draughtsman. They should not charge to visit you to give you advise and a quotation.
Remember, you have to have approved plans for everything, including carports, thatch lapas, swimming pools and, boundary walls.
In accordance with recent legislation, banks may only finance a bond if the seller can produce approved plans for every structure on their property.
I get many panic calls from sellers nowadays asking me to make their additions legal. Invariably there are problems with these jobs because homeowners have taken bad advice from their builder. It costs more money to fix and often they loose the sale because of the time it's taken to fix the expensive mistakes. or maybe they can't even make it legal - hundreds of thousands of rands down the drain!!!
