You are holding a cup of coffee when someone comes along and bumps into you or shakes your arm, making you spill your coffee everywhere.

Why did you spill the coffee?

Wrong answer, you spilled the coffee because there was coffee in your cup.

Due to insistent demand..

To be eligible to sponsor a 491 visa applicant, the sponsor must be:

18 years of age or older;

Usually resident in a designated regional area of Australia;

An Australian citizen, an Australian permanent resident or an eligible New Zealand citizen; and
an eligible relative of you or your partner.

An eligible relative can be one of the following:

a parent
a child or step-child
a brother, sister, adoptive brother, adoptive sister, step-brother or step-sister
an aunt, uncle, adoptive aunt, adoptive uncle, step-aunt or step-uncle
a nephew, niece, adoptive nephew, adoptive niece, step-nephew or step-niece
a grandparent, or
a first cousin

In determining whether the sponsor is usually resident in a designated regional area of Australia, the Department will consider the sponsor’s actual physical residence, that is, where the sponsor physically sleeps and has their usual abode.

The Department will likely request evidence such as

rates notices or rental agreements,
leases,
utility bills,
address on the electoral roll, and
tax returns.

A sponsor who has been living in a designated regional area on a temporary visa but has only recently acquired permanent residence may still satisfy the ‘usually resident’ requirements.

491 Family Sponsored Visa provides a Pathway to Permanent Residence

The 491 Family Sponsored Visa provides a direct pathway to permanent residence after 3 years of holding the visa.

Those who continue to live and work in a designated regional area of Australia will be eligible to transition to the subclass 191 visa.

You must have had a taxable income at or above the specified income threshold, currently $53,900, for at least 3 years while holding the 491 visa in a regional area.

You will be asked to provide your Notice of Assessments issued by the Australian Tax Office and evidence of your residence for this 3 year period.

It is essential that you remain in a regional area of Australia for the entire 3 years, otherwise you will not be eligible for permanent residence.

The Family Sponsored stream of the 491 Visa is a great option for those with an eligible relative living in a designated regional area of Australia and provides a direct pathway to permanent residence.

The Family Sponsored stream of the Skilled Work Regional (subclass 491) Visa is a provisional 5-year visa for skilled workers under the age of 45 in regional Australia.

It provides a direct pathway to permanent residence after 3 years from the date of grant, provided that you meet certain income and residence requirements.

As the name of the stream suggests, you must be sponsored by an ‘eligible relative’ which must be first approved before you may be granted the visa.

The 491 is a points-based visa and requires an invitation from the Department of Home Affairs in order to apply for the visa.

We write on behalf of the Jewish community, which shares your pain at the knowledge that citizens of the Philippines and members of the Filipino community are grieving in the aftermath of October 7, when 2500 Hamas terrorists stormed into Israel and massacred 1400 civilians representing over 40 countries and nationalities, including your own.

No words can assuage the grief and the anguish that people of goodwill across the globe feel as we grapple to come to terms with the carnage that was perpetrated on that terrible day, and the traumatic impact that it continues to have on all our communities, wherever we may reside.

In that spirit and in the spirit of our shared humanity, the NSW Jewish Board of Deputies and Executive Council of Australian Jewry are organising a solidarity vigil to be held in Sydney on Sunday, November 12 at 11 am.

Our objectives are to honour every one of the victims of the massacre and every one of the countries whose nationals were murdered, injured or taken hostage, and to demand the immediate release of all the hostages.

We would be deeply honoured if members of the community would attend the vigil as representatives of your country and of your ethnic community.

We are extending this invitation to representatives of all the countries whose nationals were impacted by the atrocities of October 7 and we urge you to accept and to bring your national flag and Australian flag.

If you are a temporary Australian visa holder, you might wonder whether you can legally start a business in Australia.

While most temporary Australian visas do not expressly restrict you from starting a new business, starting a business on a temporary visa may still be tricky.

For instance, you must be aware of the conditions of your temporary visa.

The Department of Home Affairs may cancel your visa for breach of a condition if your visa prohibits you from undertaking work (including starting a business).

This outlines temporary Australian visas that allow holders to start a business.

Student Visa holder

If you are on a student visa (subclass 500), you must study full-time while your course is in session.

Under Australian visa conditions, you can work up to 48 hours per fortnight (as of 1 July 2023).

If you only spend 20 hours a week working on your business, technically, you comply with your visa conditions.

However, it can be difficult to accurately calculate the number of hours you spend working on your business.

You will also need to ensure that you:

meet your course requirements;

maintain adequate health insurance; and

do not breach your visa conditions.

Temporary Graduate Visa

As a holder of the temporary graduate visa (subclass 485), you are allowed to work without restrictions on the number of hours.

You may start a business and engage in entrepreneurial activities, provided you comply with your visa conditions.

Take note that even if the Graduate Work stream requires a visa applicant to have a qualification relevant to an occupation on the skilled occupation list, engaging in business activities in a completely unrelated industry from your occupation is prohibited.

Employer-Sponsored Visas

You may be on an employer-sponsored visa (such as subclass 457 and 482 or 494).

In this instance, you must work only in your nominated occupation and for your approved employer as per condition 8607, unless your occupation is exempt.

This means you are not required to work solely for your approved employer.

However, you must continue to work in the nominated occupation.

In these circumstances, you may be able to start a business if you will still be working in the nominated occupation.

Generally, if you are a sponsored worker, nothing prevents you from establishing a business and only becoming a shareholder.

However, you must be careful to refrain from actively participating in the management and operation of the business, as this may fall under the umbrella of engaging in work.

For example, suppose you are in a nominated occupation as a chef sponsored by restaurant X.

You can start your own business (restaurant Y) and be a shareholder.

Nothing is preventing you from enjoying and receiving income from restaurant Y.

However, under condition 8607, you cannot work for restaurant Y.

In reality, you may need to spend time working on your business while employed in the nominated occupation.

However, be mindful that you could be breaching your visa if you do so.

We recommend seeking legal advice as circumstances are assessed on a case-by-case basis.

How Can I Start a Business in Australia?

After reviewing your visa conditions, you should check the national requirements for starting a business in Australia.

To start trading, you must apply for an Australian Business Number (ABN) and Tax File Number (TFN) to lodge your tax returns.

Starting a Company

A company is a beneficial business structure that protects you through ‘limited liability’.

Limited liability means creditors cannot take your personal assets if your business falls into debt.

It also allows you to allocate portions of the business to your business partners or investors depending on their contributions.

A company structure is also beneficial from an investment standpoint.

As you only have temporary working rights, investors might only want to invest in your business if you have a company structure.

The investors are guaranteed that their rights remain in the company even if they subsequently leave the country.

Additionally, it also provides them with certainty over their returns.

Suppose you choose to run your business through a company structure.

You must formally incorporate a company through the Australian Securities and Investments Commission (ASIC) register.

ASIC requires that at least one of the directors of your company will need to be an Australian citizen or resident.

Issues to Consider

Tax Issues

You may be under a different tax rate as a temporary visa holder.

Again, the company structure might be favourable as it roughly has a 30% flat tax rate in Australia.

However, if you distribute company income to yourself, you may have to pay tax at a rate applicable to your circumstances.

Business Longevity Issues

One of the most crucial things you must consider is how you intend to run your business when your temporary visa expires.

When your visa expires, you must leave Australia immediately.

Therefore, it is essential to consider the kind of business you want to set up.

Consider whether it is a business you can easily take overseas and run from anywhere or whether it requires you to be in Australia.

You must assess these issues before setting up your business.

For example, setting up an in-person shop in Australia and leaving it behind when your visa expires would not be ideal.

Suppose you intend to continue running your business from overseas.

You will need an Australian business partner to run matters in Australia.

However, any income or dividends you receive from the business will incur tax in Australia.

Alternatively, if you plan to sell your business when your visa expires, you must find a suitable buyer in advance.

Settling a business sale in Australia can take up to two weeks.
