Key Date - 7th December 2024

According to the Department of Home Affairs (DHA) website, the Temporary Skill Shortage (TSS) Subclass 482 will replace the new Skills in Demand (SiD) visa on 7th December 2024.

Occupations will be consolidated into one single occupation list under the Core Skills Occupation List (CSOL).

More details will be released on the 7th of December, 2024 by DHA.

IMMI Visa application charges increase!
Effective immediately from 1st July 2024, the majority of Departmental fees have been increased. Meanwhile, many visa application charges have been increased to align with the 2024-2025 CPI of 2.75%. Student visa applicant charges (VAC) are the main talking point, as there has been a 116% increase in VAC from $740 to $1600 for the primary applicant. The Department provided the following reason for the massive increase:
"This increase is intended to better align the cost of the VAC with the value gained by Student visa holders accessing Australia’s high-quality education system and access to the Australian labour market, including with limited work rights as a Student visa holder."

Whatever the reason might be.
The fact is that studying in Australia has now become even more expensive. Only the very wealthy can afford it!

Change to conditions 8107, 8607 and 8608 for visa Subclass 482, 457 and 494.
From 1st July 2024, these visa holders will have up to 180 days at a time or a maximum of 365 days across the entire visa grant period to find a new sponsoring employer if they stop working for their existing sponsor.
Additionally, these visa holders can work for other employers during this time and engage in work that is outside their nominated occupation.

"Ending - 'visa hopping' in the migration system."
From July 1, 2024, Visitor visa holders will no longer be able to apply for a Student visa (Subclass 500) while in Australia.

The new provision will also affect Temporary Graduate Subclass 485 visa holders preventing them from applying for a Student visa.

The government's new move aims to tighten the Student visa system and make it even more difficult to access.

We expect significant revenue drops from Educational providers.

These changes are part of the Government's strategy to reduce the "Net Overseas Migration" number.

An increase to the Temporary Skilled Migration Income Threshold (TSMIT).
From 1 July 2024, the TSMIT will increase from $70,000 to $73,150.

This will hurt many small businesses seeking to recruit overseas employees due to shortage in local workforce. Many migrants will also miss out on the sponsorship opportunity.

2024-2025 Migration program
The government announced the new Migration Program for the 2024-2025 financial year on 14 May 2024. Below are some key points from the program.

1- Total places will be set at 185,000 for the year
2- More focus on Employer Sponsored visas (subclass 482, 494 & 186). An increase from 36,825 to 44,0000.
3- Huge reduction in Skilled Independent visa Subclass 189 with a reduction of almost 50% from 30,375 places to 16,900.
4-Business Innovation & Investment Program Subclass 188, previously targeting wealthy business operators, will be CLOSED permanently from July 2024 to all new applications.
5-Work experience for Temporary Skill Shortage Subclass 482 will be reduced from two years to one year from 23rd November 2024.

Legislative Instrument LIN 23/072
Removal of advertisement on the Workforce Australia website for the Labour Market Testing (LMT) process of Subclass 482 and Subclass 494.

The Workforce Australia website has gained notoriety for being one of the least user-friendly recruitment platforms available. Registering as an employer on their site is frequently more challenging than the actual task of finding an employee.
Triumph Migration expresses appreciation for the Department of Home Affairs' amendment and eagerly anticipates the imminent elimination of Labor Market Testing (LMT) in the near future.

EXPECTING major changes for TSS Subclass 482 and TRT stream for ENS Subclass 186 from 25th November 2023!

Some important highlights expecting to change:
*All TSS visa holders under the short-term stream can now be nominated under Subclass 186 of the Temporary Residence Transition (TRT) stream.

*TSS visa holders only need to be on the visa for 2 years with the same employer to be nominated for Subclass 186 TRT.

*Removal of the number of Short-stream TSS can be lodged in Australia (onshore). Applicants can now lodge as many TSS short-term streams in Australia as they wish to.

A Broken Immigration System - under review.
The Hon MP Clare O'Neil addressed with the National Press Club on 27th April 2023 the urgent need to "fix" our broken immigration system. We want to highlight some significant upcoming changes, which we expect to start taking effect from 1st July 2023.
1) Temporary Skilled Migration Income Threshold raised from $53,900 to $70,000 from 1st July 2023. There are mixed responses regarding this change. We are thrilled for the sponsored applicant. However, the increase means fewer employers can now afford to sponsor overseas workers under the new threshold salary.
2) Removing Labour Market Testing (LMT) for employer-sponsored visas (Sub482/494). LMT has always been a very costly process for employers and has very little value in the immigration process.
3) Move from the Genuine Temporary Entrant (GTE) criterion to a Genuine Student Test for student visa subclass 500. We are looking forward to the new amendment as the current GTE is very subjective, and often, student visas are refused based on the officer's mood rather than the actual information provided.
4) More permanent pathways for temporary skilled visa holders. A very welcoming change to give people more certainty about their future in Australia.

The above are only a few items suggested in the Review Of The Migration System Final Report 2023. A total of 38 items were recommended in this report.

Allowable work hours increased from 1st July 2023.
International students' work hours will be increased from 40 to 48 hours per fortnight from the 1st of July 2023.

From 1 July 2023, international higher education graduates with eligible qualifications will be granted an extra two years of post-study work rights. The allowable work hours cap for international students will be increased from 40 hours to 48 hours per fortnight.

-Four years to SIX years for ALL Doctoral Degrees

New: Direction no. 100 - Order of Consideration - Certain Skilled Visas came into effect on 28th October 2022.
Some important highlights of Direction no. 100 as below:
1) Priority Migration Skilled Occupation list has now been removed
2) New priority for consideration for nomination and visa application

The Albanese Labor Government will increase the duration of the post-study work rights of international students. This amendment might be introduced as early as next year for select degrees in areas of verified skill shortages:
*Two years to four years for select Bachelor's degrees
*Three years to five years for select Masters Degrees
*Four years to six years for select PhDs.

We anticipate more details to be released toward the end of 2022.
Looks very promising for the future of International students under the Labor Government.

As announced today the 2022-2023 Migration program will increase from 165,000 places to 195,000. A very humanitarian decision by our compassionate Labor Government. A long waited decision.
To reduce the current delays in visa processing, the Albanese Labor Government has allocated $36.1m in funds for visa processing to support hiring additional staff over the next nine months.
