NZ Stream 189 permanently closed

Migration Amendment (Subclass 189 (Skilled—Independent) Visa in the New Zealand Stream) Regulations 2023 - F2023L00853

This amendment permanently closes the Subclass 189 (Skilled – Independent) visa in the New Zealand Stream to new primary applications.

Partners and dependants of primary applicants may still join an undecided application.

From 1 July 2023, New Zealand citizens holding a Subclass 444 Special Category visa who arrived in Australia after 26 February 2001 and who have been living in Australia for four years or more will be eligible to apply directly for Australian citizenship by conferral.

They will no longer need to hold a permanent visa, making the New Zealand stream of the Subclass 189 (Skilled – Independent) visa unnecessary.

Non-NZ citizens partners of SCV 444 holders who attain Australian citizenship will be able to continue on SC 461 visas until that current visa expires. If they wish to remain in Australia after that expiry, a partner visa or other relevant visa will be required.

This change comes into effect on 1 July 2023.

✅Northern Territory - Changes offshore nomination criteria

The Northern Territory Government (MigrationNT) has recently made some changes to its offshore nomination criteria.
The key changes are:

----reduced work experience requirement (one year down from 3 years for most occupations)
----more occupations added to the Priority Occupations Stream (now 198 occupations)
----expansion of the Family Support Stream to enable regional provisional (subclass 489, 491 and 494) visa holders and those who hold bridging visas after having applied for regional permanent residency (subclass 887 and 191) visas to support family members applying for nomination.

Today, the Albanese Government has announced it will abolish the Administrative Appeals Tribunal (AAT) and replace it with a new administrative review body that is user-focused, efficient, accessible, independent and fair.

The current processing times for migration matters (sometimes up to 5 years) was evidence alone that the current system was sadly not achieving its intended goals.

Remember, matters currently before the AAT will be unaffected by these changes and we look forward to the Government's planned consultations on the design of this new body in the coming months.

Australia is facing "staggering" skills shortages, according to a new National Skills Commission report, which shows occupation shortages doubled in 2022 as the labour market tightened.

The Skills Priority List shows registered nurses, software engineers, and care workers are in most demand, with construction managers, childcare workers and motor mechanics also near the top.
