JobKeeper Update

豪州財務省は8月15日より有効となる、現状のJobKeeperの該当従業員（Eligible Employees）条件の緩和に関する改正法を発表しました。こ

JobKeeper該当従業員条件の緩和

JobKeeperの給付条件を満たしている事業主は7月1日付の雇用状況を基準とする新たな緩和条件が適用され、新規でJobKeeperの該当となる従業員に関しては8月3日からのFortnight分よりJobKeeperの対象、つまり、9月にATOより補填される額から給付を受けることができます。

改正法Coronavirus Economic Response Package (Payments and Benefits) Amendment Rules (No 7) 2020 によると、8月3日以降のFortnightに新たに対象にできる従業員条件は以下です：

- 2020年3月1日以降に新規で雇用がされ、2020年7月1日の時点でも継続勤務されている方：（フルタイム、パートタイム）

- 既存の従業員で3月1日時点では対象条件に当てはまらなかったものの、7月1日付では対象となる方：（カジュアルで勤務、7月1日時点で長期カジュアル（原則12か月以上）とみなされる方など）

注意：該当者が永住者、国民、ニュージーランド人特別永住者(Special Category Visa Holder)でない場合は引き続き対象になりません。(一時ビザ保持者は対象外)

この改正法は2020年8月15日より施行され、対象となるFortnightは2020年8月3日からとなります。改正法では新条件を満たせば新たに給付対象者を追加することができます。

既に給付対象になっている従業員に関しては特にアクションは必要なく、継続給付が可能です。

いったん退職、離職をした後に該当期間内に再雇用された従業員の場合、他の事業者にてJobKeeperの給付を受けていない場合は対象になります。改正法により新規に給付対象従業員ができた場合、JobKeeper開始時同様Nomination Formを署名、保管する必要があります。新しいNomination Form（https://www.ato.gov.au/assets/0/104/300/362/561f35fc-a8aa-46d2-8c76-e334d24baaad.pdf）

ATOのサイトでは改正法下での雇用主条件employer eligibility や従業員条件確認employee test requirements の紹介をしています。8月3日以降のFortnightから該当する従業員（7月1日テスト条件をクリアした方）に関して、事業主は8月31日までに既存の2週間あたり＄1,500の最低額を8月3日のFortnightから支給、ATOへのSTP経由でのレポートをすれば9月からの払い戻し（8月分）が可能になるとあります

新規の該当者がいる場合、8月31日までに8月3日からの 給与をFortnightあたり最低でも＄1,500に修正し（通常それ未満の場合）STPを通してATOに通知を終わらせる必要があります。またNomination Formも署名の上、保管が必要です。

More employees are now able to access JobKeeper following implemented changes to the JobKeeper employee eligibility rules. The key date for assessing which employees are eligible for JobKeeper is now 1 July 2020.

新しい刺激策、JobKeeper Payment

今回の刺激策は対象となる事業に対し、条件に該当する従業員一人に対し2週間当たり＄1,500の支給を最大6か月するというものです。現時点でわかっている点、ご報告いたします。

概要:
- 対象となる従業員一人につき2週間（Fortnight）につき一律＄1,500を支給し、対象従業員の給料として充てる。（該当従業員の以前の給与レベルに関係なく一律）

- 従業員数の算定は2020年3月1日基準。仮にその日以降解雇をした場合でも3月1日時点の人数が有効です。

- 3月30日より希望事業主はこちらのATOサイトより希望登録を開始できます。https://www.ato.gov.au/general/gen/JobKeeper-payment/

- 支払い開始は5月1日からで1か月ずつ1か月遅れで支給されます。尚、計算開始日は3月30日です。

- 手続きの詳細は必要な細かな情報についてはATOより追ってリリースされますのでお待ちください。

- 従業員のいない事業主、自営業者にも適用されるとの発表です。 (具体的な適用条件は未発表です。)

- 支給される額は事業主にとっての課税所得となりますが、給与としての支払いになりますので、全額経費対象になります。また、JobKeeperの支給額を給与として従業員に支給される際に、通常通り9.5％のスーパーの納付を行うかどうかは任意と発表されております。

対象となる事業者
- 中小企業であり、売り上げが前年同期に比べて30％以上おちていること。 (具体的にどのように算出され、どのように報告を行うかは政府発表待ちです。)

- 上記リンクより希望をだすこと。

- 要請を受けてからATOに3月1日時点での対象となる従業員情報をATOに提供すること。

- 対象となる従業員1人に対し最低でも＄1,500（税引き前）が支払われること。(もし、該当者の給与帯がこれより多い場合、不足分は事業者負担。少ない場合は最低でも＄1,500の給与支給となります。)

- 対象となる従業員すべてにJobKeeper Paymentを支給している旨を報告すること。

- 毎月対象となる従業員状況をATOに報告すること。

対象となる従業員: (すべて満たす必要があります)
- 現在雇用されている、または既に解雇、ないし再雇用がされている：かつ
- 対象となる事業者に3月1日時点で雇用されていた：かつ
- 16歳以上である：かつ
- フルタイム、パートタイム、カジュアル（12か月以上勤務）：かつ
- オーストラリア国民、永住者、Protection ビザ、Special Visaで10年以上滞在、またはSC444ビザニュージーランド人のみであること（したがって多くの一時ビザ、学生、ワーホリ、TSS、457での滞在者は現時点対象外です）：かつ
- 他の雇用主からJobKeeperを受領していないこと。

現在のところ、細かな手続き詳細は発表されていません。とりあえずはこちらのATOリンクより事業の基本情報をATOに報告し、希望を出しておくことをお勧めいたします。 https://www.ato.gov.au/general/gen/JobKeeper-payment/.

Prime Minister announced that starting from mid night tonight (16 March 2020), in addition to current travel restrictions, all international arrivals including Australian citizens and permanent residents are required to self-isolate for 14 days upon arrival.

It appears that there is no unified individual cash hand outs like what happened during GFC. However, 6.5 million social security, veteran and other income support recipients (including family tax benefits) are set to receive $750 one-off payment.

ITALY is now added to travel ban list of countries to Australia. This will take effect as of 6pm this evening 11 March 2020. Current restrictions on China mainland, Iran and South Korea remain.

Travel Restriction Updates:

The current restrictions from mainland China to Australia is still in place til 7 March 2020. This will be reviewed again this week.

The same but a new restriction has been placed to Iran as of 1 March 2020.
