WE WON at the Tribunal 🙌
Review a Student Visa Refusal
1. Juan from Colombia received a student visa refusal notification on 1 April 2023.
2. Upon advice from his education agency, he came to see us on 10 April 2023.
3. Couple of days later we submitted his application for review with Administrative Appeals Tribunal.
4. In April 2024 we commenced collecting additional supporting evidence confirming that Juan is a genuine student in Australia taking his studies seriously.
5. On 1 July 2025 we received an invitation to appear before the Administrative Appeals Tribunal to give evidence and present arguments relating to Juan’s case.
6. On 25 July 2024 at the Hearing, the Tribunal remitted the application for a Student visa back to the Department for reconsideration, with the direction that Juan meets the Genuine Student Requirements.
7. Juan is happy because he can stay in Australia and continue in his studies, and he will also receive 50% of the AAT application fee as we won his case.

From 1 July 2024, visa conditions 8107, 8607 and 8608 are changing for the following visas:
📌Temporary Work (Skilled) visa (subclass 457)
📌Temporary Skill Shortage visa (subclass 482)
📌Employer Sponsored Regional visa (subclass 494)
Holders of these visas who stop working with their sponsoring employer will have more time to find a new sponsor, apply for a different visa or arrange to depart Australia.
These visa holders will have up to:
🧷180 days at a time, or
🧷 a maximum of 365 days in total across the entire visa grant period.
During this time, visa holders can work for other employers. This includes work in occupations not listed in their most recently approved sponsorship nomination.

STUDENT VISA REFUSAL
In case of a #studentvisarefusal , you normally have 2 options:
Option 1️⃣
The Department cannot consider your visa application any further.
However, in many cases you have the right to request the Administrative Appeals Tribunal to review the refusal decision.
But you need to act fast – you only have 21 days from the date you received the refusal notification letter to apply to AAT.
While your review is in progress, your bridging visa, which was granted when you applied for the student visa, will remain valid. This means you can stay in Australia legally while awaiting the outcome of the review and you can study and work.
Option 2️⃣
You pack your things and you leave the country.
If you decide not to apply for a review, you will have 35 calendar days to leave Australia.
