Employer Nomination Scheme visa:
186 Direct Entry Stream

The subclass 186 visa is a Permanent Resident visa which is available for qualified overseas workers who meet the requirements for one of the streams.

Requirements 186 Direct Entry Stream:

1. Have an eligible occupation that is provided by the Department of Home Affairs. https://immi.homeaffairs.gov.au/visas/working-in-australia/skill-occupation-list
2. Have relevant work experience unless exempt. The applicant is required to have at least 3 years of relevant work experience in the nominated occupation.
3. Licensing, registration, or membership: The applicant must be licensed, registered, or a member of a professional body if it is mandatory in the state or territory the applicant intends to work in.
4. Have a positive skill assessment
5. Be nominated by an Australian employer whose business is actively and lawfully operating.
6. The applicant must be under 45 years of age when he or she applies unless the applicant is eligible for the exemption policy.
7. Have at least competent English: Competent English (homeaffairs.gov.au)

Advantages of Direct Entry Stream:

1. One-step Permanent Migration Pathway
2. The employer is required to pay a one-off $3,000-$5,000 Skilling Australians Fund Levy, which can be cheaper overall than SAF for both the 482 then the 186 transition.

Disadvantages of Direct Entry Stream:

1. It needs the applicant to have at least 3 years of working experience in the nominated occupation before making an application.
2. It needs the applicant to have a positive skill assessment.

CIVIL PARTNERSHIP REGISTRATION

To apply for a Partner Visa as a de facto partner, the applicant must demonstrate at least 12 months of cohabitation with their Australian partner in the period immediately prior to lodging the visa application. However, you would be exempt from the 12 month requirement if you register your relationship in an Australian state or territory. You would still need to show that you are living together but not necessarily for 12 months.

Registration provides legal recognition as a couple under the state law and as well as being beneficial for immigration purposes. Usual requirements include:

Both partners must be 18 years old or over
Must not be in a relationship as a couple with another person – in particular they must not be married, in a de facto relationship or in a registered relationship
Must not be related by family.
Same s*x and different s*x couples can register their relationship.

Registration is available in NSW, QLD, Victoria, SA, the ACT and Tasmania and the main requirements are listed below for these states.

NSW – Registered relationship under s.4, Relationships Register Act 2010
NSW residents can register via Registry of Death Birth and Marriages. At least one partner must live in NSW. It will take 28 days to receive your certificate after you have registered your relationship.

Victoria – Registered Relationship under s.10(3)(a) of Relationships Act 2008
Relationships are registered through Births Deaths and Marriages Victoria. Persons who are in a registrable domestic relationship or a registrable caring relationship may apply to the Registrar, in a form approved by the Registrar, for registration of that relationship if one of the persons in the relationship lives in Victoria and that each of the persons in the relationship is not married or in a registered relationship and is not in another relationship that could be registered.

QLD – Civil Partnership under s.5 of Civil Partnerships Act 2011
At least one partner must have lived in Queensland for at least 6 months and you must provide evidence of this. You can apply by post and processing time to register relationships is 10 days. Cost of your registration certificate would be $43.50.

Tasmania – Significant Relationship under s.4 of Relationships Act 2003
You can apply by post or in person with the Tasmania Department of Justice. It will take 28 days to receive your registration certificate. Both partners must be residents of Tasmania. Application fees are $179.08.

ACT – Civil Partnership under s.6 of Civil Partnerships Act 2008
Civil partnership registration can be obtained via Access Canberra. At least one of the partners to a must live in the ACT. Two forms of evidence of residency must be provided. You can apply in parson or by post. However if you apply by post, at least one applicant would still need to present identification at the post office. There are no fees for civil partnership registration.

South Australia (SA)
Registered Relationship under s.6 of Relationships Act 2008
Relationships are registered through Births Deaths and Marriages South Australia. At least one partner must live in SA. It will take 28 days to receive your certificate after you have registered your relationship.

Northern Territory (NT)
Relationship registration not available

Western Australia (WA)
If you are resident of WA you can register your de facto relationship, however it is not recognised for migration purposes.

CHANGES FROM JULY 2023

Higher Income Threshold for Employer Sponsored visas
The Government has increased the Temporary Skilled Migration Income Threshold (TSMIT) from $53,900 to $70,000 from 1 July 2023.

Work & Holiday Makers
Papua New Guinea (PNG) joins Work and Holiday (visa subclass 462) On 1 July 2023, PNG became the newest partner country to join the Working Holiday Maker (WHM) Program.

Increase in Visa Fees
Visa application charges (VACs) have increased in line with the 2023-24 forecast CPI.

All Temporary Skill Shortage (TSS) SC 482 visa holders will be eligible for ENS visas sponsored by their employers.

Direct Australian citizenship for New Zealand citizens

From 1 July 2023, student visa holders will be restricted to 48 hours of work a fortnight

Subclass 485 visa
Extended Stay for Subclass 485 Visa Holders
Graduate Work stream visa applications lodged from 1 July 2023 need a qualification relevant to an occupation on the
skilled occupation list​. They also need a skills assessment in the nominated occupation.

No GTE for Student visas
Automatic 485 visa grants after student visas
A Parent visa lottery
No Labour market testing for employer sponsored visas
Simplifying the visa system to reduce the number of visa categories.
Occupation list approach will be reformed and skills recognition process to be reformed.
Changes to the skilled points test for skilled permanent residency visas and a newly designed Global Talent visa program
