Hey everyone!

This is to let you know that the Visashop team is taking a much-needed break and heading back to the homeland to visit family and friends and fill our souls.

Don't worry—we'll be back in two weeks to help you with all your immigration and visa needs. In the meantime, our receptionist will take all your calls and emails. All urgent matters are managed to date; those who can wait have solid strategies and are happy to wait for our return.

However, for any urgent work between August 8th and 27th, I highly recommend you find an alternative Immigration law practitioner. We will not be working from August 8 until August 28, which is only 14 business days (so no panic!) 😅

We are back in the office on Wednesday, August 28.

Hi all,

The only constant in Immigration law is change!

From today, July 1st, 2024, there are several fees increases across the board number of visa categories.

VISA FEE INCREASES

1. Employer Nomination (PR) Subclass 186 visa has increased from $$4,640 to $4,770
2. Employer Nomination (Temporary Visa) Subclass 482 visa (Short term stream) has increased to $1,495
3. Employer Nomination (Temporary Visa) Subclass 482 (Medium to Long Term Stream) has increased to $3,115
4. Defacto Partner Visas have increased to $9,095 (for both onshore and offshore applications)
5. General Skilled Migration Subclass 189 and State Sponsorship Subclass 190 have increased to $4,770
6. Subclass 494 Regional Visa has increased to $4,770
7. Administrative Appeals Tribunal Fee has increased to $3,496 per applicant (each)

MINIMUM SALARY FOR 482 WORKERS:
For those applying for the subclass 482 visa, assuming all key criteria is met, the new minimum salary threshold as set by Immigration is now $73,150 plus superannuation

VISA CONDITION CHANGES
Changes to Visa Conditions 8107, 8607 and 8606.
Condition 8107 = Work Limitation
Condition 8607 / 8606 = must only work in nominated position.

The regulations have been updated to for temporary workers on the previous 457, 482 and 494 visas from July 1.

These visa holders now have 180 days (up from 60 days) to either find an alternative employer to change over to OR make arrangements to depart Australia

In summary, from today July 1st, sponsored workers (Subclass 482 and 494) can change employers and work for alternative employers in occupations other than what their visa was granted for. The purpose of this is to ensure that workers can financially support themselves throughout the process.

Hi everyone,

The Government has announced reforms to support genuine international students and ensure visas are granted to those who truly want to contribute to Australia's growth.

From July 1st, 2024, certain visa holders will be prevented from applying for a student visa while onshore, maintaining the integrity of the Australian education system. This means an applicant cannot go from any of the below listed visas to a student visa onshore (e.g. from a visitor visa to a student visa)

These are visa subclasses:

Subclass 485 (Temporary Graduate)
Subclass 600 (Visitor)
Subclass 601 (Electronic Travel Authority)
Subclass 602 (Medical Treatment)
Subclass 651 (eVisitor)
Subclass 988 (Maritime Crew)

The objective is to stop "visa hopping" preventing people from using and abusing the student visa pathway as a means to access other visa types. This takes effect from July 1st, 2024.

Legislative Updates Summary - Ministerial 99 to Ministerial 100 simplified.

This summary highlights key elements of recent Legislative Instruments on visa cancellations re Ministerial Direction 99, which no doubt you have heard in the media regarding the release of detainees into the community.

The new Ministerial direction 110 is to strengthen the visa cancellation system to better reflect community expectations” after a spate of cases of visa cancellations of non-citizens who committed very serious offences as a result of being released from indefinite detention post a high court ruling.

Ministerial Direction 110 (MD 110), signed on 7 June 2024, focuses on visa refusal and cancellation under section 501, focused on community protection as the primary factor. It replaces Ministerial Direction 99 as of 21 June 2024.

1. Key Changes in Ministerial Direction 110 reflects Safety Priority

New Item (2): The safety of the Australian community is the highest priority.

2. Amendments and Removals

Previous Item (5) now (6): Removed final sentence, emphasising less tolerance for non-citizens based on time in Australia.

Previous Item (6) now (7): Removed final sentence, highlighting the severity of conduct like family violence.

New Item (8): Serious conduct, such as family violence, justifies visa refusal or cancellation even without measurable risk.

3. Decision-Making Considerations
Primary Consideration

Item 7,(2): Greater weight on community protection.
Protection of the Australian Community

Item 8.1: Highlights commitment to safeguarding the community from non-citizens' criminal activities or serious conduct.
Nature and Seriousness of Conduct

Item 8.1.1: New clause includes consideration of impact on victims and their families.

4. Ties to Australia

Item 8.3: Decision-makers must consider non-citizen's ties to Australia, focusing on residence duration and social links, especially for those who arrived as young children.

Community safety is the highest priority based on the above.

MIGRATION SYSTEM REFORMS - SEE BELOW SUMMARY

The Government will provide a total of $18.3 million over 4 years from 2024–25 to further reform Australia’s migration system to drive greater economic prosperity and restore integrity.

MIGRATION FUNDING INCLUDES:

$15.0 million over three years from 2024–25 for information and education activities to provide migrant workers with accurate and appropriate information about workplace safeguards, protections and compliance measures related to migration laws.

$1.9 million in 2024–25 to conduct a data-matching pilot between the Department of Home Affairs and the (ATO) Australian Taxation Office of income and employment data to mitigate exploitation of migrant workers and abuse of Australia’s labour market and migration system (Budget paper 2, p 136)

TEMPORARY MIGRATIN
482 VISA - EMPLOYER NOMINATION SCHEME

Temporary Skill Shortage (subclass 482) visa - The Government will also reduce the work experience requirement for the Temporary Skill Shortage (subclass 482) visa from two years to one year for all applicants from 23 November 2024 onwards (Budget paper 2, p 136). This was originally 3 years if you were unqualified and 2 years if fully qualified. Going to one year's work experience is a massive reduction in the actual experience required for the subclass 482 visa under the employer nomination scheme.

PERMANENT MIGRATON

The Government will set the 2024–25 permanent Migration Program planning level at 185,000 places and allocate 132,200 places (around 70 per cent) to the Skill stream.

From 2025–26, the Government will extend the planning horizon for the permanent Migration Program from one year to four years. (Budget paper 2, p8)

Government actions are estimated to REDUCE net overseas migration by 110,000 people over the forward estimates from 1 July 2024. Net overseas migration is forecast to approximately halve from 528,000 in 2022–23 to 260,000 in 2024–25 (Budget paper 1, p 24) - Basically this just means back to original figures.

There is additional funding to address tribunal massive backlogs, reforms to refugee settlement services, replacement of the global talent visa, improvement of border force operations, compliance, cyber security to name but a few.

Hopefully I have made sense of it for all our valued clients! 😅

Changes have arrived.

1. Regulation 5.19 of the migration regulations now expands access to the transition streams of Subclass 186 visas for ALL subclass 482 and 457 visa holders, regardless of the stream in which the visa is held.

2. Reduces the length of the eligibility period required for approval of a nomination in the transition stream from the last 3 out of 4 years to the last 2 out of 3 years.

3. Amalgamates all lists, ensuring that applicants under the TRT (Transition) stream are not disadvantaged if their occupation is removed from the relevant occupation list.

4. Removes the limit on the number of Subclass 482 visa applications in the Short-term stream that can be made in Australia.

Summary

People with 482 visas on the short-term list can now apply for a new subclass 482 onshore. They can apply for more than 2 subclass 482 visas.

People on subclass 482 or the old 457 visas can transition to permanent residency regardless of the stream (short-term list, medium to long-term list or regional list) as long as they meet the criteria of being with the same employer, on the same visa, in the same occupation for a minimum of 2 years. There are still exemptions for legacy 457 visa holders.

The timeframe to transition is reduced to 2 out of the previous 3 years (excludes any unpaid leave), and the applicant MUST work for the same employer, on the same visa, in the same occupation to be eligible to transition to PR. This was previously 3 out of 4 years.

Covid Concessions is GONE! .....Covid concessions will end on 26th Feb 2024.

More clarification to come as the week goes by, but I'll update here accordingly.

We have the latest employer nomination changes coming into effect on Saturday the 25th of November, 2023. However, we must wait a bit longer because, as we know only too well in immigration law, the devil is always in the details.

Get ready to learn what lies ahead for employers and visa applicants alike. Our belief and expectation is that this will make it easier for everyone, but we shall wait and see. 🤓

I'm attending a seminar early next week to get clear, definitive responses to many unanswered questions. This will allow me to interpret and simplify the changes for you to clarify what they mean and how they impact different clients in different scenarios.

Hi everyone!

Welcome Change! - What is changing?

The Department of Home Affairs has set November 25th, 2023 for Employer-Sponsored Permanent Residency Program changes. This is welcome news for all temporary visa holders of the subclass 482 visa. The planned changes ensure all temporary skilled workers have a clear pathway to PR (Permanent Residency)

Nominated occupations will no longer be assessed against "skilled migration occupation" lists.

Applicants on the SHORT TERM LIST can lodge a 3rd-year subclass 482 visa onshore, providing a pathway to PR.

The timeframe to have worked in a nominated position with the sponsoring employer will be reduced from 3 years to 2 years before the nomination.

There is an age exemption for REGIONAL MEDICAL PRACTITIONER applicants and for high-income earning applicants aged 45 years or older.

All applicants must continue to work in the occupation nominated for their TSS visa to be eligible for ENS TRT after two years and meet all other legislative requirements.

Why is it changing?

Current PR pathways are limited, which resulted in too many "permanently temporary" visa holders in Australia.

To attract skilled workers to Australia, the government will create clear pathways to PR for all Temporary subclass 482 visa holders, providing more certainty to employers and temporary visa holders.

When is it changing?

From 25th November onwards, all Temporary Skill Shortage (TSS) 482 visa holders will be able to gain access to permanent residency under the 186 Temporary Residence Transition (TRT) stream of the ENS (Employer Sponsored Scheme) visa program.

Nominated applicants must have held their TSS (Temporary Skilled Sponsored) visa for two out of the last three years before application.

* These changes are subject to the approval of regulation changes.

This Instrument removes the requirement for employers wishing to sponsor overseas-trained doctors on Subclass 482 and Subclass 494 visas to provide Health Workforce Certificates (HWC) or Health Workforce Exemption Certificates (HWEC) for the following medical occupations:

General Practitioner (253111)
Resident Medical Officer (253112)
Medical Practitioner (nec) (253999)

These amendments are made to recognise the widespread shortages of medical doctors Australia-wide, remove the administrative burden on health workforce certifiers, and streamline visa processing for employers and visa applicants.

This Instrument amends LIN 19/048:- Specification of Occupations – Subclass 482 Visa, 2019 and LIN 19/219: Occupations for Subclass 494 Visas, 2019.

This Instrument commenced on 16 September 2023 and applies to unfinalised lodged nominations.

Migration (Removal of health workforce certificate requirements) Amendment Instrument (LIN 23/065) 2023

This Instrument removes the requirement to provide Health Workforce Certificates (HWC) for employers wishing to nominate the following medical occupation for Subclass 186 and Subclass 187 Temporary Residence Transition (TRT) and Direct Entry (DE) streams:

This is to confirm that VETASSESS (the skills assessment authority for trades and partner of Trades Recognition Australia) has placed a "pause" on accepting new applications for seven trade occupations.

From September 25th, which is Monday next week, VETASSESS will pause acceptance of new applications for assessment for the following trade occupations:

• Chef, ANZSCO Code 351311
• Cook, ANZSCO Code 351411
• Diesel Motor Mechanic, ANZSCO Code 321212
• Motor Mechanic (General), ANZSCO Code 321211
• Fitter (General), ANZSCO Code 323211
• Electrician (General), ANZSCO Code 341111
• Metal Machinist (First Class), ANZSCO Code 323214.

In agreement with Trades Recognition Australia (TRA), They will not accept new applications for these occupations to enable them to deal with the high volume of backlogged applications. There is also the issue of a shortage of assessors to do the formal assessments.

Hi all,

As you would probably know, the COVID 408 visa ceases this Saturday, 2nd Sept 2023. Our phones are exploding, so I thought it best to put this here.

From September 2nd, 2023, which is Saturday, the Pandemic Event visa will only be open to applications from existing Pandemic Event visa holders.

Current Covid visa holders can apply for a subsequent Covid visa after 2 September 2023 until the program is fully closed in February 2024.

All other visa holders will be ineligible for the Pandemic Event visa from 2 September 2023.

It was bound to happen eventually. This visa was introduced during COVID-19 when international borders were closed and remained open to address skill shortages nationwide.

Hi everyone,

It is confirmed that Under the UK-Australia Trade Agreement, there is an exemption from Labour Market Testing (LMT) for Temporary 482 visa applications when the applicant is a UK citizen or permanent resident. This exemption applies to all natural persons who are not covered by the International Trade Obligation (ITO) categories.

The legislative instrument can be found here https://www.legislation.gov.au/Details/F2023C00507

This means employers do NOT have to advertise positions for at least 28 days before lodging a 482 nomination if the visa applicant is a UK Citizen! Good news for English applicants 👍

Proud to be Irish and super proud of this event! It was beyond amazing to see so many young NT Irish Association Irish enjoy the weekend! Excellent venue, beanbags throughout the venue, talent, food trucks, incredible volunteers and organisers to make it a smashing weekend of music, dance, poetry, culture, heritage and laughter, doing what the Irish do best, live, laugh and love! ☘️☘️

We have taken some time to reflect after our amazing weekend of céilí agus ceol.

Our community came together and created an impact that stretched far and wide - the craic was mighty!
The inaugural NT Irish Music Festival 2023 solidified the need for continuous cultural connections in the NT. Igniting a huge excitement for the future of the festival.

Every event is organised and brought together by different contributors - we would like to publicly acknowledge those today:
