COMING SOON - SKILLS IN DEMAND VISA

Australia will introduce a new 'Skills in Demand visa' in late 2024, featuring 3 pathways aimed at attracting skilled workers.

This visa is likely to replace the existing 482 - Temporary Skilled Shortage visa. The 482 pathway falls under the Employee Sponsorship Visa and allows the applicant to live and work in Australia for up to 2-4 years. It can also lead to Permanent Residency in Australia, but this is dependent on your stream and occupation.

This is what you need to know about the 'Skills in Demand' visa:

1- Specialist Skills Pathway: For highly skilled professionals earning over AUD 135,000. This pathway excludes trades and manual labor, offering fast-tracked processing within 7 days.

2- Core Skills Pathway: Targeting skilled workers in critical shortage occupations, requiring a minimum income. Applicants must be on the Core Skills Occupation List.

3- Essential Skills Pathway: Designed for workers in essential roles earning below AUD 70,000, focusing on filling critical workforce gaps through labor agreements.

It's important to note that each skills assessment is different, and that some skills assessments may take longer to process due to the complexity and nature of the applicant's occupation nominated.

PR PATHWAYS FOR ACCOUNTANTS IN AUSTRALIA

1. You must have completed a relevant bachelor's degree or higher qualification.

2. You must have proficient English or have completed the "Accounting Professional Year program" to apply for skills assessment.

3. You must be under the age of 45.

4. Achieving 65 points does not guarantee an invitation. It is very challenging for Accountants to obtain PR with the current required points to receive an invitation for the subclasses 189, 190 and 491 visas.

For example, the cutoff from the ACT matrix points dated 27 November 2023 shows that Accountants who scored 150 points were invited to apply for subclasses 491 and 190 (Under the Canberra Resident stream).

Speak with your employer and see whether they can offer you employer sponsorship under the subclasses 482 or 186 visas. These are the most secure options for Accountants to obtain their pathway to permanent residency.

Australian Immigration Changes from 1st July 2024:1. Australia's minimum wage increase: Starting 1 July 2024, Australia'...
15/07/2024

Australian Immigration Changes from 1st July 2024:

1. Australia's minimum wage increase:

Starting 1 July 2024, Australia's minimum wage is set to rise by 3.75%!

This means a new rate of $24.10 per hour or $915.90 per week.

If you’re an international student, remember you can work up to 24 hours per week during the semester and unlimited hours during holidays.

Casual employees also benefit from an extra 25% loading, making those part-time hours even more rewarding.

2. The 482 and 494 visa holders update:

Starting 1 July 2024, working conditions for Sponsored Workers on 482, and 494 visas are extended to 180 days instead of the current 60 days to find a new sponsor.

This applies to visa holders who resign or are fired with a maximum of 365 days in total across the entire visa grant period.

During this time, visa holders can work for other employers, even in occupations not listed in their most recent sponsorship nomination.

3. Visitors and Graduate visa holders update:

Starting on 1 July 2024, the new rules will prevent onshore Visitor and Temporary Graduate Visa holders from extending their stay in Australia through Student Visas.

These measures aim to reduce the total amount of overseas migration and address the misuse of loopholes in the migration system, promoting a more strategic and streamlined approach to skilled migration in Australia.

4. Student visa fee increase:

Starting 01 July 2024, Australia has increased student visa fees from $710 to $1,600 AUD.

This significant rise impacts international students aspiring to study in Australia.

5. Update on Temporary Graduate Visa:

The age limit for the Post-Higher Education Work stream (former Post-Study Work stream) subclass 485 visa stays at 50 for Master's (research) and PhD holders, effective 1 July 2024.

6. Work Holiday Visa for Filipinos:

From 1 July 2024, Filipino passport holders aged between 18 to 30 can apply for the Australian Work & Holiday Visa.

This exciting opportunity is subject to specific eligibility and application requirements.

If you are a national from Timor-Leste or the Pacific Island, then this video is for you!

The Pacific Engagement visa is actually a first-of-its kind Australian permanent resident visa available to eligible candidates from the Pacific Island and Timor-Leste.

This is the first time Australia has introduced such a system for migration, similar to the United States Green Card lottery.

As such, people were chosen via a random ballot selection process.

The Pacific Engagement visa pre-application ballot for Pacific island and Timor-Leste nationals opened for registrations on 3 June 2024 and have now closed to all new registrations.

If you have been selected, submit a Pacific Engagement (subclass 192) visa application as soon as you possible. Bamyan Lawyers can assist you with your visa application lodgement.

19/03/2024

The Australian government is introducing a new student visa requirement called the “Genuine Student Requirement” (GS) which will take effect on 23 March 2024.

1. What is the Genuine Student Requirement (GS)?

The GS will be replacing the existing “Genuine Temporary Entrant” (GTE) requirement from 23 March 2024. The GS aims to assess your genuine intention to pursue quality education in Australia, separating your desired study plans from any potential future migration goals.

2. What should you expect with the GS Requirement:

-> Streamlined application process: No more lengthy 300-word statements! The GS focuses on targeted questions that delve into your background, study choices, and motivations for choosing Australia as your study destination.

-> Focus on your study goals: Be prepared to explain why you’ve chosen your course and how it aligns with your future career aspirations.

-> Transparency on post-study options: The application will clearly state that while post-study pathways to permanent residency exist, they are limited. As a genuine student, you must also demonstrate your commitment to complying with visa regulations/conditions.

3. Important Dates and Considerations:
-> The GS requirement is planned to commence for Student visa applications lodged on or after 23 March 2024.

-> Applications submitted before 23 March 2024 will still be evaluated under the current GTE system.

-> The GTE requirement remains in place for Student Guardian visa applicants.

4. Potential English Language Changes:
The announcement also mentions potential adjustments to English language requirements for student visas. We will elaborate more on the above once we receive further information from the Department of Home Affairs.
