Tears of Joy today with the grant of our client's Subclass 100 Permanent Visas.

While every visa grant is special, some have a story behind them that highlights how tough the journey to Australia can be. This is one such story and it needs to be told because it is a story of enormous strength and absolute determination of the sponsor to fight for her family.

This story begins seven years ago with the lodgement of a Subclass 309. Within a year, this application is refused for the 1st time. By her own determination, the sponsor appeals this decision and mounts a successful defence at the Administrative Appeals Tribunal and the application is remitted back to the Department for reconsideration according to law.

However, in late 2018, the application is again refused but this time on PIC 4020 grounds – the brutality of this piece of awful prejudicial and grossly unfair legislation is fully evident by the as applied to this visa application. The sponsor again lodges an appeal.

Seeing the seriousness of PIC4020 – the sledge hammer - the sponsor sought legal advice. In November 2020 with notice of the hearing having already been issued and having lost confidence in the law firm representing her, the sponsor was referred to us by a community member and sought a further opinion. With the AAT Hearing fast approaching we sat down with her to understand the full circumstances and to determine what was the best approach.

Subsequently, we took on the AAT Appeal and immediately set about preparing our submission. In late January 2021 we along with our clients we attended the hearing where the client expressed herself with honestly and clarity that underpinned a successful outcome. Early February 2021 we get the news we all wanted - a positive decision and the application was again remitted to the Department for further determination.

This signalled stage two of our process which commenced with us immediately contacting the offshore Mission processing this application and provided them with a copy of the decision and our first request for priority processing is made.

This began a near 14-month campaign to get to today’s positive decision. It required constant emailing, further submissions, persistence and finally escalation to the highest level within that Mission to get to today’s outcome.

As a journey, we thank our clients for there trust in us and as the Director of Modern Migration, I want to say how very proud I am of our dedicated team of hardworking and intelligent professionals with whom none of this would have been possible.

Today now becomes day one of a new journey and future together for our clients as a family. We wish them every success for the future ahead.

SOUTH AUSTRALIA- 70 OCCUPATIONS WILL BE OPEN TO OFFSHORE APPLICANTS

To manage South Australia’s COVID recovery response, an additional 70 occupations will be open to applicants currently residing offshore from Tuesday 28 September 2021.

The minimum requirements for state nomination include at least 8 years work experience in the occupation or closely related occupation and a proficient plus English level. Full requirements for each occupation will be shown on South Australia’s Skilled Occupation List.

A new agriculture visa for workers from ASEAN nations is currently being negotiated.

The Minister for Agriculture, Drought and Emergency Management, David Littleproud said the announcement of a new seasonal agriculture worker visa will come as huge relief to the agriculture industry that has been crying out for a secure workforce.

Applications will likely start from November 2021 or early in 2022, subject to vaccination take-up in ASEAN countries.

📣 📣📣 2021-2022 Western Australia Skilled Migration Program Major Changes!!!

HIGHLIGHTS:
📌 Introduction to WA Skilled Migration Occupation List Schedule 1 and Schedule 2.
📌 Many occupations now added to WASMOL (including schedule 1 and schedule 2)
📌 There are separate experience requirements for schedule 1 and schedule 2.

Candidates may be nominated by the Western Australian Government under two streams:
✅ General
✅ Or Graduate.

🎯 Western Australian State nomination minimum requirements – GENERAL STREAM

👉 Requirements for WASMOL Schedule 1

• be currently residing in Australia.
• have an occupation listed as available and eligible for the intended visa subclass on the Western Australian Skilled Migration Occupation List Schedule 1
• be able to claim and give evidence of work experience in the Expression of Interest this requirement can be met through:
- at least 1️⃣ year of Australian work experience in the nominated (or closely related) occupation over the last 10 years; OR
- at least 3️⃣ years of overseas work experience in the nominated (or closely related) occupation over the last 10 years.
• Meet the minimum English language requirements.
• have a contract of employment for full time employment for at least 1️⃣2️⃣ months in the nominated or closely related occupation in Western Australia.

👉 Requirements for WASMOL Schedule 2

• be currently residing in Australia
• have an occupation listed as available and eligible for the intended visa subclass on the Western Australian Skilled Migration Occupation List Schedule 2
• meet the minimum English language requirements.
• have a contract of employment for full time employment for at least 1️⃣2️⃣ months in the nominated or closely related occupation in Western Australia.

🎯 Western Australian State nomination minimum requirements – GRADUATE STREAM

• be currently residing in Australia.
• have an occupation listed as available and eligible for the intended visa subclass on the Graduate Occupation List (GOL)
• have gained a Certificate III or higher qualification in Western Australia, including a requirement to have completed at least 2️⃣ years of full-time study in Western Australia at a Western Australian university, higher education provider, TAFE, registered training provider or English language provider.
• Demonstrate:
- at least 6️⃣ months of paid Australian work experience in the nominated (or closely related) occupation over the past five years. Applicants must enter work experience evidence in their SkillSelect Expression of Interest,
OR
- a contract of employment for full time employment in Western Australia for at least 6️⃣ months in the nominated (or closely related) occupation.
