Latest EB-5 News...

USCIS has formally appealed to the courts to get the amount to be reinstated from $500k back to $900K.

With the EB-5 program still lapsed waiting for congress' approval for its continuity and the latest legal complications, no one can be certain what the appeal outcome will be.

There is a chance that in this short time frame between the program's continuity and pending the legal verdict, interested investors might want to consider investing $500K to lodge their application as soon as possible (before the appeal verdict). Of course, if USCIS wins the appeal, investors should be ready to top up their investment amount to $900K.

As the preparations for the application take time, investors are encouraged to start their preparations now by engaging an immigration lawyer as well as the gathering of documents necessary for their EB5 lodgement.

USCIS has made changes to its EB-5 program on its website following the judge ruling a few weeks ago. The minimum amount(in TEA) has been reduced from US$900K down to $500K. Here is the USCIS link:

The EB-5 program is still lapsed waiting for congress' approval for its continuity, meaning USCIS will not be accepting any applications during this period till the program reopens.
However, once and if the program continues, it is not clear if the USCIS would want to challenge/appeal against the judge's ruling.

In this short time frame between the program's continuity and the possible potential appeal, interested investors might want to quickly take advantage of the new reduced investment amount of $500K to lodge their application as soon as possible.

As the preparation for the application takes time, it would be advisable for investors to start their preparation now by engaging an immigration lawyer as well as the gathering of documents necessary for the lodgement.

The most popular investment immigrant visa program, the US EB-5 visa has lapsed effective today due to the lapse in Congressional authorization to continue the Program. As we wait for the authorization, there are more questions than answers within the industry from a historic event a few days ago.

A few days ago, there was a major upheaval in the EB-5 industry when a judge ruled that the US$900K/1.8M needed for the visa was not properly implemented. That means that the minimum investment amount is to be returned back to US$500K. Within the tight timeframe of those couple days, a few investors have taken advantage of the judge's ruling and lodged their EB-5 application. Whether or not, USCIS will accept their application remains to be seen.

While there is much speculation in the industry, no one can be sure what decisions and directions will be made. The general census is that Congress will again approve the extension and the USCIS will either appeal the judge's ruling or maintain the US$900K threshold.

For now, all we can do is sit and wait for the decisions to come in.

In a nutshell, there will be no need for quarantine for tourists from these countries with the required documentation
:
EU & Schengen Area countries, Australia, Northern Macedonia, United Arab Emirates, United States of America, United Kingdom, Israel, Canada, Belarus, Bahrain, New Zealand, Cuba, South Korea, Ukraine, Rwanda, Russia, Saudi Arabia, Serbia, Singapore, and Thailand.

Tourists will have to provide one of these documents:
– a vaccination certificate, stating that 14 days have passed since full vaccination for Covid-19, or
– a negative PCR test performed less than three days (72 hours), or
– a certificate stating that one has recovered from the coronavirus.

Eric Schmidt, Google’s Ex-CEO becomes the last few investors to be granted Cypriot Citizenship through the Cyprus' Citizenship Investment Program. Last month, Cyprus has decided to end the citizenship program unexpectedly on 1st Nov., due to recent political exploitation.

Although Cyprus is not offering citizenship by investment anymore, Cyprus is still offering their residency by investment. This permanent residency is different from the rest of the EU countries in that investors will not need to renew their permanent residency at all.

Cyprus' citizenship program will officially end on 1st November 2020.

It is sad to see one of the more promising citizenship programs in the world coming to an end because of a couple of politicians, among others, abusing their powers. One of the politicians had tendered his resignation, while the other will abstain from his duties pending an investigation.

We believe that this decision, although disappointing, was a decisive action against corruption which is essential to demonstrate the country’s commitment to transparency and to restore credibility.
