The Government of Canada has introduced significant changes to the Spousal Open Work Permit (SOWP) program, which impacts spouses and common-law partners of international students and foreign workers. The updates, effective January 21, 2025, are part of efforts to address housing affordability and rising costs of living by limiting temporary resident numbers.

Key Changes for Spouses of International Students:
Eligibility Narrowed:
Spouses are now only eligible for SOWPs if the international student is enrolled in:

Master’s programs lasting 16 months or more.
Doctoral programs.
Select professional degrees, including Medicine, Dentistry, Law, Nursing, and Engineering.
Exclusions:
Spouses of students in undergraduate or college programs are no longer eligible for SOWPs.

Key Changes for Spouses of Foreign Workers:
Occupation-Based Eligibility:
Spouses of foreign workers can now apply for SOWPs only if the principal worker is employed in:

TEER 0 or 1 occupations.
Select TEER 2 or 3 occupations with labor shortages in priority sectors, such as healthcare, education, and natural resources.
Work Permit Duration:
The principal worker must have at least 16 months remaining on their work permit at the time of the spouse's application.

Additional Changes:
Dependent Children:
Dependent children of foreign workers are no longer eligible for family open work permits.

Transition Provisions:

Permits issued under the previous rules remain valid until expiration.
Applications submitted before January 21, 2025, will follow the old rules.
Family members already in Canada may renew their permits if they meet the original eligibility criteria.

Nearly 50,000 international students, issued study permits for higher education in Canada, were reported as “no-shows” by colleges and universities, according to the Canadian government data from spring 2024 under the International Student Compliance Regime. Among them, 20,000 were Indian students.

This figure, accounting for 6.9% of all international students tracked by Immigration, Refugees, and Citizenship Canada (IRCC), has raised concerns about the effectiveness of Canada’s compliance system for international students.

India remains the largest source of international students in Canada, with 427,000 Indian students enrolled in Canadian institutions as of August 2024.

In the same month, IRCC revealed that over 10,000 fake student acceptance letters were discovered during reviews of 500,000 documents. Reports indicated that 80% of these fraudulent documents were linked to students from Gujarat and Punjab.

The Northwest Territories Nominee Program will reopen on January 16, 2025, at 9:00 a.m. MST. Applications, submitted via the online portal, will be processed on a first-come, first-served basis, with incomplete submissions rejected.

For this intake, 100 complete applications will be accepted across streams:

Francophone Stream: 10 applications

Employer-Driven Stream: 45 for Entry Level/Semi-Skilled and 45 for Skilled Worker/NWT Express Entry combined

This ensures a diverse workforce to meet regional labor needs. Streams will pause once their quotas are filled. Nominations have grown from 77 in 2020 to over 300 in 2024.

IRCC to implement restrictions on family Open Work Permits in January 2025

Effective January 21, 2025, family open work permits (OWPs) for international students will be restricted to the spouses or common-law partners of students currently enrolled in

Master’s programs that are 16 months or longer in duration;

Doctoral programs; or

Select professional and eligible programs (listed below).

Prior to this change, a master's program did not have to be 16 months or longer in duration in order for the student's spouse to be eligible for a SOWP.

In addition to this, family OWPs for foreign workers will be limited to spouses or common-law partners of those working in

Training Education Experience and Responsibilities (TEER) 0 occupations;

TEER 1 occupations; and

Select TEER 2 or 3 occupations* in:

Natural and applied sciences;

Construction;

Healthcare;

Natural resources;

Education;

Sports; and

Military sectors.

*A full list of eligible TEER 2 and 3 occupations will be published by IRCC on January 21, 2025.

For spouses of foreign workers to be eligible under these rules, the foreign worker must have at least 16 months remaining validity on their work permit when their spouse applies.

Dependent children of foreign workers will no longer be eligible for family OWPs.

Previously, inadmissible foreign nationals would be required to pay approximately $1,500 upon their subsequent attempt to return to Canada. That fee will soon become slightly more than $3,800 for those who leave the country unescorted and just over $12,800 for those escorted by Canadian officials.
