Effective January 24, 2024 - IRCC halts the intake of any new study permit applications to Canada until March 31, 2024 as Provinces are developing a process to provide an attestation letter.

Exemptions
* a minor child applying to study in a primary or secondary school (kindergarten to grade 12)
* a student applying for a Masters, PhD or other post-graduate program
* a student applying to extend their study permit

It’s a crime set up “marriage of convenience” or say a fake marriage just to allow your sponsored spouse or common-law partner to immigrate to Canada.

Immigration officers know how to detect false marriages and there are serious criminal charges that includes:

• IRCC may take legal action against you with a fine of up to 100,000, imprisonment for up to 5 years or both

• not allow your sponsored spouse or common-law partner to enter Canada for five years

• deport your sponsored spouse or common-law partner from Canada

Don’t let a marriage of convenience, inconvenience you. No matter the reason, its not worth the risk.

Effective June 6, 2023 eligible travellers from these 13 countries can travel visa-free to Canada. Travellers from these countries who have either held a Canadian visa in the last 10 years or who currently hold a valid United States non-immigrant visa can now apply for an eTA instead of a visa when travelling to Canada by air.

Low-risk travellers from following 13 countries will be able to skip a visa application.

Express Entry candidates will now be selected for permanent residence through a new system known as the “targeted draw” that is category-based selection.

This year 2023, the following six categories are targeted:

1) French-language proficiency
2) Work experience in healthcare occupations
3) Work experience in Science, Technology, Engineering and Math (STEM) occupations
4) Work experience in trade occupations
5) Work experience in transport occupations
6) Work experience in agriculture and agri-food occupations

On Wednesday, Immigration Minister Sean Fraser kicked off the highly anticipated “targeted draws” to pick immigrants with experience and skills in five particular sectors, covering 82 occupations.

The new Immigration Appeal Division Rules have now come into force. The new Rules will apply to new immigration appeals and all pending appeals.

The new Rules, which replace the old Rules introduced in 2002, will modernize the appeal process and help to ensure the IAD resolves appeals effectively, fairly and in accordance with the law.

The new Immigration Appeal Division Rules, come into force on January 14, 2023.

Key changes are as below:

APPEAL RECORDS

- For sponsorship and residency obligation appeals, the Minister has 60 days to provide the appeal record. It was 120 days in the old Rules.

- For removal order appeals and Minister's appeals, the Immigration Division or the Minister has 30 days to provide the appeal record. It was 45 days in the old Rules.

TIME LIMIT FOR DISCLOSURE

- The time limit for a party to provide documents in support of their appeal is 60 days after receiving the appeal record (Rules 24(1) and 26)

- If a party does not provide any documents or notify the IAD that no documents are being provided, the Rules set out new consequences including declaring the appeal abandoned (Rule 30)

- The time limit for a party to provide documents in response to evidence provided by the other party is now 30 days before a hearing (Rule 27).

WITNESS INFORMATION

- The time limit for a party to provide witness information is changed to 30 days before the hearing rather than 20 days before the hearing. The witness information must also now include a brief statement of the purpose and substance of the testimony, which is a new requirement (Rule 55).

CONFIDENTIALITY

- Documents used in an informal resolution process are no longer confidential and can be used later in the appeal. However, any matter discussed in an informal resolution process remains confidential (Rules 66 and 67).

REQUEST TO CHANGE HEARINGS

- The factors considered when deciding an application for a change of date and time of a proceeding have been modified. An application to change date and time must also be made at least three working days before a proceeding instead of two working days unless the application is made for medical reasons (Rules 90 and 91).

Parent/Grandparent permanent residence sponsorship 2022

New sponsors will not be able to apply for year 2022 intake rather IRCC will send 23,100 invitations to apply, only to sponsors who have previously submitted interest to sponsor parents in year 2020.

This is important to note that 155,313 potential sponsors are waiting in queue and if this selection trend continues in coming years, it may take over 6 years to clear existing backlog untill new prospective sponsors piling up over the years will get a chance to apply under this category.

This selection trend is possible to continue considering, IRCC recently allowed supervisa holder parent/grandparents to enter Canada for an extended period of 5 years.

IRCC extends temporary distance learning measures for postgraduate work permit (PGWP)

International students who study online outside Canada or who submit their study permit application no later than August 31, 2022, will continue to complete up to 100% of study program online without affecting their PGWP eligibility. Starting September 1, 2023, any study time completed outside Canada will be deducted from the length of their post-graduation work permit, regardless of when a student began their studies.

The following apply to new International students starting study from September 1, 2022, to August 31, 2023:

- No more than 50% of the credits earned can be completed outside Canada to remain eligible for a PGWP.
- Studies completed online from outside Canada starting on September 1, 2023, will be deducted from the length of a future PGWP.

Super Visa Enhancement Program- 5 year stay for parents & grandparents

Effective July 4, 2022, Enhancements to the super visa program for parents and grandparents include:

- Increasing the length of stay for super visa holders to 5 years per entry into Canada with an option to extend stay for another 2 years while in Canada.

Effective April 30, 2022, IRCC is increasing fees for all permanent residence applications including economic, permit holder, family and humanitarian classes. This increase is part of fees increase policy made in year 2020 announcing that fees would increase every 2 years to adjust for inflation.
