Sponsors and applicants are encouraged to provide a comprehensive explanation letter outlining their circumstances and detailing their plans for returning to Canada. Key areas of focus should include:

✅Describing the circumstances of the
sponsor is not living in Canada- explain why and when he/she intends to return to reside in Canada once your visa is issued.
✅How long has the sponsor been living outside of Canada?
✅Preparations you and/or your sponsor made for your move to Canada? Provide documentary proof where possible.
✅If you have school-aged children, have you made inquiries with the local school board?
✅Will you and your spouse be both moving to Canada and residing together permanently?

On December 1, 2023, the application fees for foreign nationals applying to regain their status or return to Canada after being inadmissible will be adjusted.

These fees have been adjusted to account for the yearly rate of inflation since April 2018. They will continue to be adjusted annually for inflation every December 1.

Don't forget to include the correct fee with your application. Wrong fees can lead to an incomplete application and return of the application.

If you’re no longer using the email address you put on your 2020 interest to sponsor form, you’ll be able to tell IRCC your new email address using the Find your lost confirmation number page. A will be posted on October 23, 2023, for this.

Invitations will be sent to randomly selected potential sponsors from the remaining pool of submissions from 2020.

IRCC's goal is to receive 15,000 complete applications. Don't forget, you must submit your application by the deadline in your invitation to apply letter - there are no exceptions.

You’ll get the invitation about 1 to 2 weeks before the ceremony. The invitation will have the ceremony’s

✅time and date
✅Zoom link (for a video oath ceremony)
✅location (for an in-person ceremony)

💡Most applicants are invited to a video oath ceremony.

What happens at the ceremony?

✅take the Oath of Citizenship
✅get your citizenship certificate
✅sign the Oath or Affirmation of Citizenship form
✅sing the national anthem, O Canada

The Parents & Grandparents sponsorship program is opening in the fall of 2023!

IRCC is not opening a new interest form and will continue to pull from sponsors who submitted in 2020. This remains the same as the 2021 and 2022 years.

On October 10, 2023, IRCC will begin sending invitations to apply to 24,200 interested potential sponsors. Invitations will be sent over the course of 2 weeks.

If you are not invited to apply, consider the parents or grandparents super visa, which is a multiple-entry visa that is valid for up to 10 years. Super visas allow a stay in Canada for 5 years at a time, with the option to extend visits by up to 2 years at a time without leaving the country.

It's no secret that Canada is a top destination for international students.

Canada is on track to host approximately 900,000 international students in 2023! There are currently more than 807,000 international students who have study permits in Canada across all levels of education.

Anticipated reforms in the spring of 2024, come from a recent interview with Immigration Minister Marc Miller. He says the the concern around the skyrocketing number of international students entering Canada is not just about housing, but Canadians' confidence in the "integrity" of the immigration system itself.

While Miller shied away from the idea of a hard cap on the number of students entering Canada, a cap would certainly create challenges in obtaining study permits in Canada.

With school back in session those looking to start in the winter or spring semester should start applying for their study permits now and over the coming months!

In category-based rounds of invitations, IRCC invites candidates in the Express Entry pool who are eligible for a specific category established by the Minister to meet an identified economic goals. IRCC invites candidates to apply for permanent residence based on criteria such as

1. ability to communicate in a specific official language
2. work experience in a specific occupation
3. education

There are six separate categories for Express Entry candidates who meet specific criteria

1. Healthcare
2. Science, technology, engineering, and mathematics (STEM) professions
3. Trades, such as carpenters, plumbers, and contractors
4. Transport
5. Agriculture and agri-food

A recent report by the Globe and Mail states that IRCC is expecting that between 28 % and 31 % of Express Entry ITAs will be issued to candidates with recent work experience in certain STEM occupations.

So far, we've typically seen category-based selection draws have lower CRS scores.

IRCC required the applicant to demonstrate that she has sufficient and available financial resources to pay the first year tuition fee of $16,476.36 CAD, a minimum of $14,000 CAD to maintain herself and the Minor Applicant, and transportation costs to and from Canada.

The applicant provided: proof of funds on behalf of herself and the Minor Applicant, which included:

✅a mutual fund investment valued at approximately $35,000 CAD, which can be fully or partly liquidated at any time.
✅two letters from her employer, addressed to both the applicant and the Officer, approving a tuition bursary in the amount of approximately $3,000 CAD,
✅a letter from her husband indicating his willingness to financially support her throughout the program and evidence of his annual salary of approx. $23,000CAD

Decision💡

"The applicant required approximately $30,476.36 CAD per year plus travel expenses to and from Canada. She also demonstrated financial support from her spouse for the duration of her studies. Section 220 of IRPR states that “an officer ‘shall not’ issue a study permit unless, without working, students have sufficient funds to pay their tuition, maintain themselves and family members [in Canada], and transport themselves and family members home from Canada”

Pursuant to IRCC’s website, students must demonstrate sufficient funds for the first year of study, as well as $10,000 CAD for support.

Applicants can prove their funds through
✅bank drafts convertible to Canadian dollars,
✅tuition payments, and ✅letters from individuals providing the applicant with money, among others.

The website further notes, that “Officers should be satisfied…that the probability of funding for future years does exist”.

✅For instance, this can be demonstrated where an applicant’s parents are employed.

Reuniting loved ones is one of immigration Canada's fundamental pillars.

New measures to address labor shortages in Canada include:

✅faster temporary resident visa (TRV) processing times for spousal applicants (in 30 days with a 90% approval rate according to IRCC)
✅new and dedicated processing tools for spousal TRV applicants
✅a new open work permit for spousal and family class applicants
✅open work permit extensions for open work permit holders expiring between August 1 and the end of 2023

These measures support spousal applicants who have already applied for permanent residence in Canada.

Canada extends study authorization to work permit holders with no restriction on program length.

Prior to this, workers could only study in programs six months or less without the need to apply for a study permit.

This new measure will be in place for three years and applies to valid work permit holders and those who have submitted an extension of their work permit on or before June 7, 2023

Foreign workers can study full-time or part-time while their work permits are valid or until the expiration of the policy.

New Express Entry category-based draws to target those with work experience in specific fields!

Among the five occupation-specific categories, all candidates must:

✅have accumulated, at least 6 months of continuous work experience (in Canada or abroad) within the past 3 years in a single occupation listed as eligible.

✅meet all requirements in the instructions for that round.

Category-based rounds of invitations will rank candidates in the Express Entry pool who meet the category requirements and then invite top-ranking candidates to apply for permanent residence- your CRS score still matters!

The categories can change on a yearly basis so if you're not already part of the express entry pool, now is the time!

Pack your bags, you're going to Canada!

There are more than 50 countries that can enter Canada without a visa, although most require an Electronic Travel Authorization (eTA) if they are arriving by air.

The only exception is citizens of the United States who do not require an eTA or a visa to enter Canada unless they are moving to Canada to work or study.

This week we are all over Canada visa refusals!

The Chinook tool was piloted in processing offices in 2018 and officially launched in 2019. It purpose is to reduce the amount of time spent uploading and reviewing information on multiple screens in GCMS.

Federal Court has hinted at frustration with IRCC’s Chinook software, stating “the Officer’s notes consist largely of boilerplate statements that we see repeatedly in study permit decisions and that appear to be generated by the Chinook software.”

💡In Khosravi v. Canada (Citizenship and Immigration), 2023 FC,

I note that Ms. Khosravi’s application was “processed with the assistance of Chinook 3+”. I do not know if the shortcomings outlined above result from the use of this tool. I will simply say that the use of assisted decision-making tools does not relieve officers from the duty to fully consider an application, most importantly the study plan. If the use of such a tool gives the officer a truncated vision of the application, the resulting decision may well be unreasonable.

Many of the clients that come to us have had previous refusals to Canada and while we never like to see refusals, they are part of the reality of Canadian immigration.

There are a few things we do to ensure we are submitting the best possible reapplication, but by far the best first step in preparing for reapplication is....

💡Apply for the GCMS notes through an ATIP request. The request takes approximately 30 days and costs $5 CAD.

Why?

Applicants have the right to understand the basis of the Decision made on the application. The reasons, which should be provided in writing, must be clear, precise, and understandable. The reasons provided to the Applicant should reflect the assessment of the facts and evidence relied upon, the provision(s) of the Act and/or Regulations on which the Decision is grounded, and the reasoning for the conclusion reached by the decision-maker.

The GCMS notes will help you understand whether the above was done and in building legal arguments for your next application if the refusal grounds fall short.

A visa officer must consider numerous factors, including financial and personal ties to the applicant’s country of origin, past immigration attempts, overstaying in other countries, and any criminal past when determining whether an applicant meets the requirement of section 179.

If you have previously seen a temporary resident visa refusal, you are likely familiar with some of the standard check-list reasons:

✅Your travel history
✅Your family ties in Canada and in your country of residence
✅Length of proposed stay in Canada
✅Purpose of visit
✅Limited employment prospects in your country of residence
✅Your current employment situation
✅Your personal assets and financial status

When submitting a visa application, it may be beneficial to include a declaration from the applicant stating they understand the nature of temporary entry, and that they will not overstay in Canada.

You need to give your biometrics once every 10 years. You don't need to give your biometrics again until the 10-year period expires if you're applying for temporary residence.

Permanent residence applicants are required to enroll their biometrics in support of every application (even if the applicant has valid biometrics enrolled under the temporary resident stream)

How it works....

✅Pay the $85CAD biometrics fee at the time of application submission to avoid potential delays

✅After submitting an immigration application and paying the biometrics fee, those required to provide biometrics will receive a confirmation letter from the government that includes information on where to go to submit their fingerprints and photograph.

✅Individuals must take this letter and a valid passport to their closest biometrics collection site (by appointment only)

Some applicants may be exempt from the biometric collection requirement such as U.S. nationals applying for temporary status in Canada.

A closed work permit, also known as an employer-specific work permit, allows you to work in Canada according to the conditions associated with the work permit, such as:

The reality: you don’t need representation to complete a Canadian immigration process. Don’t get us wrong, having representation comes with its benefits, and in more complex matters, we would urge you to seek help.

✅ meet the education requirements for post-secondary, graduate or post-graduate studies (see below for details)

For post-secondary studies, the applicant must hold either a

👉degree (for example, associate, bachelor, master, doctorate) from a post-secondary designated learning institute (DLI) in Canada or an equivalent educational credential earned abroad; or
👉post-secondary diploma of at least two years from a post-secondary DLI in Canada or the equivalent credential from an overseas institution along with an educational credential assessment (ECA) report from an agency approved by Immigration, Refugees and Citizenship Canada (IRCC) to confirm Canadian equivalency.

For graduate or post-graduate studies, the applicant must hold a
