In the Dominican Republic, there are four types of residency that you can pursue:

▶Provisional Residency (Temporary Residency) - Provisional or temporary residency is the first step for those seeking permanent residency. Temporary residents must renew every year.

▶Residency for Retirees - Retirees or pensioners who can prove they receive a minimum of $1,500 a month ($1,750 per couple) in pension or retirement income qualify for residency.

▶ Investment Residency (Domestic Investor) - The investment residency category is for individuals who invest at least US$200,000 in a company registered in the Dominican Republic, a Dominican bank or financial institution, or real estate.

▶ Rentista Residency (Foreign Investor) - The foreign investor category is aimed at individuals who earn a minimum of $2,000 a month from sources outside the Dominican Republic, such as a privately owned business, property rental, or investments.

Applying for residency in the Dominican Republic can be a complex process, and even small errors can cause significant delays. Here are the Top 5 Mistakes people commonly make:

1️⃣ Submitting Incomplete Documentation
Missing documents are a common reason for delays or rejections. You'll need everything from birth certificates to bank statements, and these documents will need to be notarized (if necessary), apostilled, and translated, in that order. Ensure all your paperwork is organized, accurate, and complete.

2️⃣ Applying for the Wrong Residency Type
With multiple types of residency available—temporary, permanent, and investor—choosing the right one is critical. Misunderstanding the differences, such as applying for temporary residency when permanent would be more suitable, can result in wasted time and effort. Consult an expert before starting the process.

3️⃣ Ignoring Residency Renewal Deadlines
Temporary residency must be renewed annually, and missing renewal deadlines can lead to fines or even loss of residency status. Many people overlook these dates, assuming they have more time. Stay organized and start the renewal process early to avoid unnecessary complications.

4️⃣ Failing to Legalize or Translate Foreign Documents
Foreign documents must be both apostilled in the issuing country and translated into Spanish by a Dominican consulate or a certified judicial translator from the Dominican Republic. Many folks have started considering second residency and citizenship as part of their diversification strategy. This strategy makes sense, given the political instability and uncertainty around the world these days.

As a foreigner navigating a legal process in the Dominican Republic, such as residency or marriage, it's crucial to understand the process of legalizing documents for submission to the government.

The process of legalizing a document will involve: 1.) notarization (if necessary), 2.) apostille, and then 3.) translation—in that order. Notarization of a document, if needed, is done before apostilling. Translation is the last thing that you do when legalizing a document.

Whether you seek anonymity, asset protection, or a structure for easy transfer of ownership, your choice should align with your investment goals or objectives. You may envision the property being used for commercial purposes like a hotel. Ultimately, objectives and goals will determine this decision.

The DR allows you to buy and hold your property in your personal name, a Dominican entity (EIRL or SRL), or a foreign entity (corporation or LLC).

However you decide to hold your property, you've got to consider two things: 1) How the entity is taxed and 2) The cost of setting up the holding entity and ongoing administrative costs.

For example, if you were to hold your DR rental property in a Dominican EIRL or SRL, your net rental income would be taxed at 27%. The exact property held in a foreign corporation would be taxed at the individual rate of 10%, as foreign entities are treated as individuals.

In many cases, it makes sense to keep it simple rather than set up some type of holding entity. The potential costs and tax implications are just not worth it.
