Did you know? UK Students may still be eligible for Universal Credit

Universal Credit is a monthly payment provided by the UK Government through the Department for Work and Pensions (DWP) to assist with living costs for those who earn a low income or are unemployed. While full-time students are generally ineligible, exceptions apply across England, Scotland, and Wales (separate guidance applies in Northern Ireland under the Department for Communities).

You may qualify for Universal Credit if you are a full-time student and:
*Are aged 21 or under, in full-time non-advanced education, and do not have parental support.
*Are responsible for a child.
*Live with a partner who is eligible for Universal Credit.
*Have reached Pension Credit age and live with a younger partner who qualifies.
*Have received a Migration Notice to move to Universal Credit.
*Are disabled and were assessed as having limited capability for work before starting your course and receive qualifying disability benefits (e.g., PIP, DLA, or Attendance Allowance).

Students in full-time non-advanced education without a student loan or maintenance grant may also qualify, provided they are available for work. Additional eligibility rules apply if you’re under 19.

-You’ll receive £25 for each 7-day period where the average temperature in your area is zero degrees Celsius or below.

This week, we celebrate a remarkable success led by Mr Shakir Hussain and his team.

Our client approached us in September 2024 for an Indefinite Leave to Remain (ILR) application under Appendix FM of the Immigration Rules. Unfortunately, their visa had already expired, making them an overstayer.

Understanding the urgency, Mr Hussain ensured the application was submitted within 12 days, staying within the 14-day allowance after visa expiry.

A few weeks after submission, the client informed us of a pressing personal matter requiring urgent travel to their country of nationality. Since leaving the UK would automatically withdraw their application, Mr Hussain and his team took immediate action.

Through consistent communication and providing supporting evidence to the Home Office, they successfully expedited the process. Against the odds, the Home Office granted the ILR application within 6 weeks – far quicker than the usual 12-month timeframe for such cases.

Success Story Saturday: A Journey to ILR

This week, we celebrate a wonderful success story led by Dr Chiara Mancuso and her team.

Our client, a South African national, entered the UK in 2017 as a dependent on her husband's Tier 2 visa. Despite some challenges and incorrect applications along the way, she came to us for advice when faced with a long wait for Indefinite Leave to Remain (ILR).

After carefully reviewing her case, Dr Mancuso advised applying for ILR under the Skilled Worker category, despite the client’s current visa being under a different route. Drawing on Home Office guidance, the team argued that her initial entry as a Tier 2/SW partner and her continuous residence in the UK met the criteria.

The Home Office initially argued that our client was not eligible for ILR and asked us to withdraw the application. We challenged their grounds, referencing their guidance and the immigration law. Ultimately, the Home Office accepted our arguments and granted the client ILR.

We are delighted to have helped our client achieve this important milestone, and we thank her for trusting us with her journey.
