We are glad to announce that the litigation team of Metaxas & Associates Law Firm, led by Senior Associate, Mrs. Xenia Gkaitatzi has successfully represented Elpedison, one of Greece’s leading electricity suppliers, in a high-stake case before the Athens Court of First Instance. The case involves a class action brought by over 80 claimants, including consumers and consumer associations, challenging the legality of adjustment clauses in energy supply contracts.

This complex and highly significant case has far reaching consequences for the Greek Energy Market. The judgment issued in favour of our client, Elpedison, dismisses the relevant class action and accepts the legal approach that was analyzed in an Expert Legal Opinion drafted by the Μanaging Partner of our Law Firm, Prof. Dr. Antonis Metaxas.

The Court issued Decision no. 1146/2024, which annulled the Transitional Security Supply Fee ("MTAE") imposed on photovoltaic (PV) energy producers. The Court accepted the argument that the fee’s differentiation coefficient was not properly aligned with legal criteria, impacting disproportionally photovoltaic (PV) energy producers. This decision sets an important precedent, with wider implications for the renewable energy sector in Greece.

Το Δικαστήριο εξέδωσε την υπ' αριθμ. 1146/2024 απόφαση, με την οποία ακυρώθηκε το Μεταβατικό Τέλος Προμήθειας Ασφάλειας («ΜΤΑΕ») που επιβλήθηκε στους ανεξάρτητους παραγωγούς φωτοβολταϊκής ενέργειας. Metaxas & Associates Law Firm latest Legal Update regarding RAAEY's Decision No. E-181/2024, issued on 04.09.2024, addressing crucial regulatory issues concerning the curtailment of energy injection from RES plants by network operators (HEDNO, IPTO). This decision on interim measures granted by RAAEY determines that both HEDNO and IPTO have been violating several provisions regarding their obligation for transparency and non-discriminatory practices, in compliance with national and EU regulations, including Regulation (EU) 2019/943.
