Immigration authorities extend Chinese mainland residents' business travel in Hong Kong, Macao to 14 days

China's immigration authorities announced that, starting from May 6, Chinese mainland residents who travel to Hong Kong and Macao on business trips will be able to stay for up to 14 days per visit, a significant increase from the previous limit of seven days

The extension, which will greatly facilitate business exchange between Chinese mainland and the two regions, is included in an array of new measures to streamline the immigration process and facilitate international exchange, advancing the country's high-level opening up.

The new measures also include easing procedures for issuing passport and facilitating easier travel for Chinese mainland residents to visit Hong Kong and Macao, which allow Chinese mainland residents to apply for business travel permits to Hong Kong and Macao at immigration bureaus countrywide, rather than only at registered locations before.

Experts noted that the new measures would help boost the economies of Hong Kong and Macao, creating new business opportunities and inject vitality into their development.

Facilitating travel for the mainland residents to Hong Kong and Macao will stimulate economic activity and increase demand across tourism, retail, hotels and dining sectors, driving economic growth of Hong Kong and Macao, Liang Haiming, Chairman of the China Silk Road iValley Research Institute, a Hong Kong based research institute, told the Global Times on Sunday.

The initiatives focus particularly on simplifying travel for business professionals and talent from the mainland, which is expected to generate more business opportunities in Hong Kong and Macao, as well as enhancing the local talent pool and promoting cross-regional knowledge exchange, said Liang.

"Chinese mainland-based skilled workers may bring new momentum into innovation and development of Hong Kong and Macao," Liang said.

More business people and skilled workers will likely drive local commercial, and cultural exchanges with the international community, which is anticipated to increase foreign investment, boost foreign trade and more, Liang noted.

The new measures will allow multiple entries to Hong Kong and Macao for skilled talent from Beijing and Shanghai, granting them exit-entry permits valid for one to five years with each stay not exceeding 30 days. The new policies also include issuing multiple-entry visas to Macao for various activities such as exhibitions, medical treatment, and cultural performances.

Additionally, the National Immigration Administration will pilot online applications for replacing or reissuing passports and exit-entry permits for traveling to and from Hong Kong and Macao in 20 mainland cities including Beijing, Shanghai, and Guangzhou.

With the further integration of the Guangdong-Hong Kong-Macao Greater Bay Area, and the launch of new travel policies, interactions among residents of the three areas are becoming increasingly convenient, leading to closer economic ties.

For instance, the Hong Kong-Zhuhai-Macao Bridge border control announced that, as of 4 pm on Saturday, the bridge has recorded over 10 million vehicle runs.

Hong Kong: Immigration update | October 2023

In brief

In the chief executive's 2023 policy address ("Policy Address"), which was delivered on 25 October 2023, the Hong Kong government announced initiatives to attract and retain talents by expanding the coverage of universities under the Top Talent Pass Scheme (TTPS); facilitating business travel to mainland China; relaxing visa requirements for Vietnamese, Laotian and Nepalese talents; reactivating the Capital Investment Entrant Scheme (CIES); and establishing the Vocational Professionals Admission Scheme (VPAS) pilot program.

To continue to retain, nurture and seek talents, as well as to strengthen labor training and enhance productivity in Hong Kong, the Hong Kong government announced the following immigration measures in the Policy Address:

Immigration measure
Details
Expanding the coverage of universities under the TTPS
From 1 November 2023, the list of eligible universities under the TTPS has been expanded to include eight institutions from mainland China and overseas, making a total of 184 institutions.

In addition to the existing 176 institutions, the TTPS includes (i) five institutions in the QS World University Rankings in the discipline of hospitality and leisure management, namely EHL Hospitality Business School, Swiss Hotel Management School, Les Roches Global Hospitality Management Education, Glion Institute of Higher Education and Hotelschool The Hague; and (ii) three universities from mainland China, namely Wuhan University, Xi'an Jiaotong University and Harbin Institute of Technology.

The TTPS allows qualifying foreign, high-income talents and graduates from top universities to receive a two-year visa, allowing them to work or establish a business in Hong Kong.

Facilitating business travel to mainland China
From 26 October 2023, foreign employees working for companies registered in Hong Kong are eligible to apply for multiple-entry business visas to mainland China at the China Visa Application Service Center in Hong Kong. The visa is valid for two or more years with expedited processing.
Relaxing visa requirements for Vietnamese, Laotian and Nepalese talents
From 25 October 2023, Hong Kong has relaxed visa policies by (i) allowing Vietnamese talents eligible to work in Hong Kong under various talent admission schemes, including the General Employment Policy, Quality Migrant Admission Scheme and Top Talent Pass Scheme, (ii) establishing "multiple-entry visas" for Vietnamese business and travel to Hong Kong, valid for two years or more, with each stay lasting a maximum of 14 days, subject to qualifying eligibility criteria; and (iii) allowing Laotian and Nepalese talents to work, receive training and study at universities funded by the University Grants Committee.
Reactivating CIES
Under the newly reactivated CIES, eligible foreign investors who invest HKD 30 million or above in assets such as stocks, funds and bonds can apply for entry into Hong Kong. These assets do not include investment in real estate.

The Hong Kong government is expected to provide more details of the CIES by the end of this year.

Establishing the VPAS pilot program
Non-local students admitted from the 2024/25 admission cohort onwards are allowed to stay in Hong Kong for one year after graduation to look for a job relevant to their disciplines. The VPAS is expected to run as a pilot scheme for two years.
As the above new immigration measures pave the way for additional new talent pools, employers are advised to be aware of the latest immigration policies and regulations to ensure that their new overseas hires have the proper immigration status prior to commencing their employment. Furthermore, both employers and employees are also advised to consider relevant legal and tax implications when arranging cross-border assignments for their overseas hires who come to Hong Kong to work and travel to mainland China for business.

Lastly, employers are also reminded of the requirement to first prioritize hiring locally to fill job vacancies. Overseas candidates who possess special skills, knowledge or experience that are not readily available in Hong Kong may then be considered and apply for work under the appropriate admission schemes.

Not more than 20 hours per week: Full-time non-local postgraduate students to be temporarily exempted from restrictions on taking up part-time jobs

To enhance learning and enrichment opportunities for international students, the Government announced today (October 26) that, starting from November 1, full-time non-local postgraduate students would be temporarily exempted from the restrictions on taking up part-time jobs. The arrangement will be implemented on a trial basis for two years.

Currently, eligible students who have been approved to come to Hong Kong to study in full-time locally accredited local programmes at the postgraduate level will be individually issued a "No Objection Letter" (NOL) by the Immigration Department (ImmD), allowing them to take up part-time employment on campus for not more than 20 hours per week, curriculum-related internships during semesters or summer jobs. The Chief Executive's 2023 Policy Address announced a two-year suspension of the restrictions with effect from November.

A Government spokesman said, "The trial arrangement will allow more room for these students to look for jobs during their studies to enhance their experience and understanding of working in Hong Kong, and further increase their incentive to stay in Hong Kong for their development after graduation."

The ImmD will arrange briefing sessions for the relevant institutions within this week to introduce the arrangement, and subsequently issue to eligible students through their institutions new NOLs setting out the suspension. Eligible students are not required to submit applications separately. Students approved of visas/entry permits on or after November 1 will also be issued with the updated NOLs.

Increase in Minimum Allowable Wage and food allowance for foreign domestic helpers

The Government announced today (September 29) that the Minimum Allowable Wage (MAW) for foreign domestic helpers (FDHs) in Hong Kong will be increased by 3 per cent, from $4,730 to $4,870 per month.

In addition, under the Standard Employment Contract for hiring FDHs, employers are required to provide FDHs with food free of charge. At present, the vast majority of employers provide free food to FDHs. Employers may, however, choose to pay a food allowance in lieu. The food allowance will be increased by $40 from not less than $1,196 to not less than $1,236 per month.

The new levels of the MAW and food allowance will apply to all FDH contracts signed on or after tomorrow (September 30).

A Government spokesman said, "The Government reviews the MAW for FDHs regularly. In accordance with the established practice, we have carefully considered Hong Kong's general economic and labour market conditions over the past year, as well as Hong Kong's near-term economic outlook in this year's review. Taking into account the above, the affordability of employers and the livelihood of FDHs, the Government has decided to adjust the MAW. The Government has also reviewed the food allowance in lieu of free food, and decided to increase the allowance level."

FDH contracts signed today or before today at the existing MAW of $4,730 per month and with food allowance of not less than $1,196 per month will still be processed by the Immigration Department (ImmD), provided that the applications reach the ImmD on or before October 27 (Friday). This arrangement will give employers sufficient time to send the signed contracts to the ImmD for completion of the necessary application procedures.
