The Court of Appeal of Venice - Civil Section, accepting the arguments of the foreign company, completely rejected the application for opposition to the recognition of a foreign arbitration award pursuant to art. 840 Code of Civil Procedure,
In particular, the Court ruled that:
✅ There had been no violation of the arbitration agreement, (pursuant to art. V co. 1 lett. C. New York Convention of 1958).
✅ There had been no violation relating to the constitution of the arbitration panel,
(pursuant to art. V co. 1 lett. D. New York Convention of 1958).
✅ There had been no violation of the right of defense of the party against whom the award was enforced
(pursuant to Article V letter B. New York Convention of 1958).
✅ The recognition or ex*****on of the award would not have been
contrary to public order
(pursuant to art. V co. 2 lett. B. New York Convention of 1958).

🗂️🗄️DIFFICOLTA' TECNICO- ORGANIZZATIVE
&
🇪🇺 MANDATO D'ARRESTO EUROPEO

⛓️👮‍♀️ Un cittadino straniero viene arrestato in Italia in forza di M.A.E. con l'accusa di aver commesso una rapina aggravata.

👩🏻‍⚖️ Viene celebrata l'udienza di convalida dell'arresto.

✈️ Il soggetto presta il consenso al trasferimento al Paese d'origine e il Giudice dispone la custodia cautelare in carcere in attesa del trasferimento.

📚 L'art. 23 della Legge n. 69/2005, relativa al mandato d'arresto europeo e alle procedure di consegna tra Stati membri dell'UE, prevede che:
"La persona richiesta in consegna deve essere consegnata allo Stato membro di emissione entro dieci giorni 1️⃣0️⃣ dalla sentenza irrevocabile con cui è data esecuzione al mandato d'arresto europeo […]".

⏱️ A causa di "difficolta tecnico- organizzative"🗂️🗄️ non imputabili all'arrestato, non è stato possibile effettuare il trasferimento nei termini previsti.

🔐 La Corte ha disposto l'immediata liberazione del detenuto.
