On Tuesday, 21st January, Austcham Lao PDR held it's Strategy Session for 2025 with all of our new and existing Board Directors. All in attendance were able to provide valuable input during the session and we were also fortunate to have Tony Campbell from Katalyst Partners as our Facilitator, also an AustCham member.

The session was followed by a dinner with The Australian Ambassador, H.E. Megan Jones and we discussed the various ways in which The Australian Embassy can partner with AustCham over the year ahead.

We look forward to continuing to serve our members in various ways as we begin a new chapter.

Business Environment Update from VDB Loi, member of AustCham Lao:

Flash Report on Amended Investment Promotion Law

The amended Investment Promotion Law No. 62/NA dated 28 June 2024 (“Investment Promotion Law 2024”) was published in the Lao Official Gazette and came into effect on 16 December 2024, replacing the Investment Promotion Law 2016 and the Law on Amendment of Article 12 of the Investment Promotion Law 2019.
The law was amended to better align it with the current economic and investment situation in the Lao PDR. We provide below an update of the key changes investors should be aware of.

Promoted Sectors and Zones

Article 9 of the Investment Promotion Law 2024 updates the promoted sectors and investment zones eligible for investment incentives from the Lao government, as shown below.

Promoted sectors

a. Eco-friendly and sustainable farming
b. Eco-friendly agro-processing (such as of animal feed, natural fertilizer, organic fertilizer, scientific fertilizer), handicraft industries, manufacturing of products for export and as a substitute for imported goods
c. Hospitals, pharmaceutical and medical equipment factories, and traditional medicine development
d. Education physical sports, human resource development, and skilled labor development
e. Those using of digital technologies, scientific research and development, and eco-friendly and sustainable innovations
f. Eco, cultural, and historical tourism
g. Public infrastructure development, such as construction of highways and rail systems, water supply management
h. Infrastructure development for promoting investment opportunities in special and specific economic zones
i. Logistics, dry port operation, state-to-state transit, and passenger transportation

Removed promoted sectors

The following sectors have been removed from the list of promoted business sectors:
• Rural area development and poverty reduction related sectors;
• Policy banks and micro-finance institutions; and
• Modern commercial centers and exhibition centers.

Other Legislations

Apart from the Investment Promotion Law 2024, there are a number of specific legislations that govern investment in the Lao PDR. They are as follows (not an exhaustive list):

• Decree on Special Economic Zones No. 188/GOL dated 7 June 2018
• Decree on Public-Private Partnerships No. 624/GOL dated 21 December 2020
• Instruction on Granting Investment Promotion Incentives on Corporate Income Tax and Rental Fees or State Land Concession Fees No. 0760/MOPI dated 14 May 2021

The above legislation will remain in effect barring any inconsistency with the provisions of the Investment Promotion Law 2024.

On Friday, 13th December, AustCham Lao, partnered with ALS Geochemistry, yet again, for their 2024 Christmas Party. This was also AustCham's final Sundowner for the year.

As in previous years, the Christmas Party turned out quite a crowd and we would like to thank Bob Gordon, Touni and team for putting this event together and for allowing us to share it with many of our sponsors and members.

Many of our members had the opportunity to bring with them their broader teams, families, partners and children. Once again, Sticky Fingers did a fantastic job with the catering and Santa Claus had a very busy evening indeed!

United Nation Expert Calls for Greater Protection of Cultural Rights in Laos

Laos is taking significant steps to preserve its cultural heritage and celebrate ethnic diversity through various government initiatives. However, challenges remain in fully protecting the cultural rights of marginalized groups, as highlighted by Alexandra Xanthaki, the United Nations’ Special Rapporteur in the field of Cultural Rights.

Xanthaki highlighted the need for more inclusive policies, especially from an international perspective. She further elaborated on her views during a United Nations press conference on 29 November in Vientiane, where she acknowledged the Lao government’s commitment to non-discrimination.

“I applaud both the commitment to development as this is indeed an important process to improve the socio-economic rights of the people,” Xanthaki said, praising the authorities for improving access to essential services such as health, water, food, and education. “I also applaud the emphasis on non-discrimination. I commend a society that in the face of such a troubled past wants to stay united.”

She further commended the preservation of certain cultural elements, like weaving, and the promotion of cultural festivals. However, she noted the lack of government funding to protect the cultural heritage of ethnic groups and called for a more structured dialogue between the state and these communities.

The rapporteur also acknowledged Laos’ efforts to integrate cultural rights into the core national legislation. She cited constitutional protections, including Articles 8, 23, and 45, which guarantee citizens the freedom to preserve their cultural heritage and pursue scientific, artistic, and cultural activities within legal boundaries.

“I did see a wonderful collage of different cultures and expressions in Laos,” Xanthaki observed. “But I did not see the government’s efforts to protect the right of everyone to continue to enjoy this cultural diversity in all its variety without interference.”
Xanthaki highlighted potential improvements in translating legal provisions into actionable policies, advising a balanced approach toward both economic and cultural rights.

Gaps in Cultural Rights Protection

Despite constitutional assurances, Xanthaki pointed out there is still room for improvement when it comes to anti-discrimination regulation in Laos. She emphasized that, from an international perspective, non-discrimination should involve implementing specific measures to protect marginalized groups, rather than simply treating everyone equally on paper.

“Equal treatment means treating equally those in the same situation, whereas a different situation may require different treatment,” she said.

Xanthaki also called for greater recognition of intersectional discrimination, where power dynamics based on ethnicity, social class, gender, and rural or urban backgrounds compound challenges for vulnerable groups.

“People facing more than one ground of discrimination are amongst the most disempowered and the most fragile. They are the ones affected by endless relocations due to development,” she added.

Unity and cultural diversity, Xanthaki stressed, must go hand in hand.

“Unity and solidarity have to walk together with cultural diversity. Both can go together and reinforce each other,” she emphasized.

Concerns Over Cultural Tourism and Misappropriation

While acknowledging efforts to preserve traditional practices, Xanthaki encouraged Laos to ensure that tourism respects both biodiversity and cultural diversity. She stressed the importance of protecting practices such as music performances and alms-giving ceremonies, which she noted may be at risk of losing their deeper cultural significance due to the influence of mass tourism.

“All these point towards the instrumentalization of cultural practices, which become disconnected from ways of life. Meanings and ownership of such practices are lost in the efforts to satisfy the customer,” she said.

The rapporteur praised local organizations such as the Traditional Arts and Ethnology Centre for their community research, intellectual property advocacy, and heritage training. She also commended Ock Pop Tok, an artisan social enterprise, for empowering women and welcomed government actions to protect traditional weaving from misappropriation.

Xanthaki highlighted the need for practical measures to support cultural rights in Laos. She encouraged the government to foster an environment where cultural diversity is actively protected and celebrated, not merely enshrined in legal frameworks.

“I also understand how difficult the issue of unexploded ordnance must be and how they impact the everyday life of people in the Lao PDR,” she acknowledged, tying cultural and socio-economic challenges to the broader struggle for inclusive development in the country.

Further Reflections on Cultural Rights and Development

“I would have liked to see reflection of the public bodies on how they can use the know-how of ethnic groups about the forests, about the flora, about development, about sustainability, because this is what they’ve been doing for a long time.”

Xanthaki also underscored the importance of recognizing the cultural diversity of ethnic groups and ensuring they have a voice in decisions that impact their lives. She noted that, for example, in the Luang Prabang Heritage Management Committee, only one out of 20 members represented the villagers, limiting their participation in decisions that affect them.

“These are very clear, also have human rights impact assessments, where they identify the specific, how projects impact cultural rights is recognized, is identified,” she added.

Xanthaki believes that Laos could be an international example of how to include marginalized groups in the cultural rights conversation.

Phongsavanh Insurance and MOK Co Ltd ink pact for insurance solutions

Phongsavanh Insurance (APA) Co Ltd and MOK Co Ltd, an exclusive distributor of BYD electric vehicles in Laos, have signed a strategic partnership to integrate comprehensive insurance solutions with every BYD purchase.

The signing agreement was held on December 5, signed by the CEO of APA, Mr Dean Robertson and the CEO of MOK, Mr Marco Mok.

Speaking at the signing ceremony, the CEO of APA, Mr Dean Robertson, said, “Today marks a significant milestone in our journey toward innovation and excellence. It is with great pride and enthusiasm that we gather here to celebrate the signing of a strategic partnership between BYD, a leader in electric vehicle technology, and Phongsavanh Insurance APA, a trusted name in insurance services.”

He raised that this collaboration displays their commitment to their customers.
“By joining forces, we leverage BYD’s state-of-the-art technology, exceptional servicing and repair services and Phongsavanh Insurance’s expertise in risk management to create a uniquely tailored experience for our clients,” he said.
“This partnership will not only enhance customer loyalty but also provide them with an added layer of assurance, differentiating us in a competitive marketplace, and it is also allowing our customers to drive with confidence, knowing they are adequately protected.”

CEO of MOK, Mr Marco Mok, noted that signing a strategic cooperation agreement between the two companies reflects their mutual trust and shared vision but also underscores the commitment to advancing Laos’ new energy vehicle industry.
“As the exclusive distributor of BYD electric vehicles in Laos, MOK Co Ltd is dedicated to championing green innovation and sustainable practices. We firmly believe that the adoption of new energy vehicles will not only enhance environmental protection but also improve travel quality and help build a brighter future for the Lao people,” he said.

He added that collaboration with APA is a significant milestone in its journey to offer professional services and support an extensive customer network.
