Upcoming Changes to the Accredited Employer Work Visa (AEWV) – March 2025

From 10 March 2025, several key updates will be introduced to the AEWV to improve flexibility for employers while ensuring fair pay for migrant workers.

Key Changes:
✅ No More Median Wage Requirement – Employers must pay at least the minimum wage ($23.50 from 1 April 2025) and the New Zealand market rate.
✅ Reduced Work Experience Requirement – Minimum 2 years of experience instead of 3.
✅ Simplified MSD Engagement – Employers hiring for low-skilled roles (ANZSCO Level 4 & 5) must declare they engaged with MSD but no longer require formal approval.
✅ Longer Visa Duration – AEWV holders in low-skilled roles will now get 3-year visas.
✅ Higher Income Threshold for Supporting Children – Increased to $55,844 per year for new applications.
✅ Updated Skill Levels – Certain roles (e.g., cooks, nannies, fitness instructors) now recognized as higher-skilled (ANZSCO Level 3).

Additional Updates:
📌 Interim Visas (April 2025) – Work rights expanded for AEWV applicants waiting for visa decisions.
📌 Median Wage Updates (28 February 2025) – New thresholds:

Supporting a partner: $26.85/hour
Sponsoring parents: $33.56/hour

WORKING REMOTELY FROM NEW ZEALAND

From 27 January 2025, visitors to New Zealand on a visitor visa or NZeTA can legally work remotely for an overseas employer or client while in the country. This applies to tourists, family visitors, and long-term visitor visa holders.

These new conditions mean that tourists can stay in New Zealand as a digital nomad and keep in touch with work back home, without breaching their visa conditions.

Both visitor visa recipients and people who enter with an NZeTA (New Zealand Electronic Travel Authority) will receive these conditions.

Visitor visa holders must not:
- work for a New Zealand employer
- provide goods or services to people or businesses in New Zealand
- do work that requires them to be physically present at a workplace in New
Zealand.

SUMMER PEAK PROCESSING UPDATE

Immigration New Zealand (INZ) has announced that they are currently in the middle of its busiest time for processing visitor visa applications and has decided over 130,000 applications since September 2024.

They continue to process visitor visa applications for the 2024 — 2025 summer period as they receive them. To have the best chance of receiving a timely decision on your visa, INZ strongly encourage that all travellers to submit their application as soon as possible. To help avoid delays with the visa application, make sure to submit a complete application with all the necessary documentation.

INZ recommend that you allow 4 weeks for visa processing. Applications that are missing supporting documents or English translations are more likely to be declined.

ALLOCATION PRIORITIES FOR ACCREDITED EMPLOYER WORK VISA (AEWV).

Immigration New Zealand has announced that processing of AEWV applications in an efficient and timely manner continues to be a top priority.

INZ are committed to improving visa processing times, as they are aware on the importance of this is to all the customers.

They have been working to improve AEWV processing times, but have mentioned that there is more work to be done. INZ want make sure that they are doing everything they can to be as efficient as possible in their approach to the AEWV.

The current focus is how they can use their people and processes to make efficiencies in the system.

That is why INZ have made some deliberate changes to group applications. They allocate these to a specific team to assess them at the same time – such as where there are large groups of applications from the same sector or location, or the applicants are in similar situations.

Applications that include the required evidence and documentation will be prioritised.

Major Announcement by INZ📣‼

OPEN WORK RIGHTS FOR PARTNERS OF MIGRANT WORKERS FROM 2 DECEMBER 2024.

The Government is making changes to provide open work rights to more partners of migrant workers, allowing them to work for any employer. This will help families stay together, and attract and retain the workers New Zealand needs to fill gaps in sectors facing skill and labour shortages.

From 2 December 2024, open work rights will be available to:

(-) all partners of Accredited Employer Work Visa (AEWV) working in an Australian and New Zealand Standard Classification of Occupations (ANZSCO) Level 1-3 role and earning at least NZD$25.29 an hour (80 percent of the standard median wage)

(-) partners of AEWV holders earning at least $25.29 an hour if they were already supporting a partner for a work visa on 26 June 2024

(-) all partners of Essential Skills work visa holders earning at least $25.29 an hour.

Furthermore, open work rights will be available to partners of AEWV holders working in an ANZSCO Level 4-5 role:

(-) earning at least $47.41 an hour (150 percent of the standard median wage), or

(-)earning at least $31.61 an hour in a role on the Green List and meeting the Green List requirements for that role, or

(-) earning at least $25.29 an hour (80 percent of the standard median wage) and meeting the requirements of a role in the Transport or Care Sector Agreements (or the wage specified in the sector agreement, whichever is higher).

ANZSCO grades occupations according to skill level. ANZSCO skill levels range from 1 to 5, with 1 being the most skilled and 5 being less skilled.

INZ Announcement📣‼ Good News for Samoa.

NEW VISA APPLICATION CENTRE OPENING IN SAMOA,

INZ announced that a new Visa Application Centre will open in Apia, Samoa on Monday 4 November 2024, offering visa application services through Immigration New Zealand’s (INZ) partnership with our specialist provider, VFS Global.

The opening of a Visa Application Centre (VAC) in Apia will enhance the service offerings for INZ’s Samoan clients, featuring an application lodgement service available from Monday to Friday, between 09:00 and 16:00. The existing INZ Apia office counter, which currently operates for just 1 hour each day, will close on Friday, 1 November 2024.

From Monday 4 November 2024, customers wanting to submit paper visa applications in person can do this through the Apia VAC. A VAC service fee of WST90 per application will apply.

INZ Announcement on Accredited Employer Work Visa (AEWV)📣‼

KEY INFORMATION ABOUT THE AEWV.

Accreditation applications opened on 23 May 2022, Job Check applications opened on 20 June 2022 and work visa applications opened on 4 July 2022.

As at 09 October 2024 Immigration New Zealand (INZ) has approved 128,380 AEWV applications since the scheme opened, and there are currently 29,033 accredited employers and 84,028 AEWV holders.

On 7 April 2024, changes were announced to the Accredited Employer Work Visa scheme. These include:

- Introducing an English language requirement for migrants applying for low skilled ANZSCO level 4 and 5 roles.

- A minimum skills and work experience threshold for most AEWV roles.

- For roles that fall into the ANZSCO level 4 and 5, employers will need to engage with Work and Income before approval to bring in migrants will be granted.

- Reducing the maximum continuous stay for most ANZSCO level 4 and 5 roles from 5 years to 3 years.

- Disestablishing the franchisee accreditation category and for these businesses to apply to bring in workers from overseas through the standard, high-volume, or triangular employment accreditation.

INZ Announcement Update!!📣‼

CHANGES TO THE MIGRANT EXPLOITATION PROTECTION WORK VISA.

From 31 October 2024, the ability to be granted a second MEPV will be removed. This means that, if anyone has an initial MEPV, and applies for a second MEPV on or after 31 October, their application will be declined.

Migrants who have made a credible report of exploitation will still be able to be granted a MEPV of up to 6 months, or until the expiry of their current visa (whichever is lesser) to allow them to leave the exploitative situation and remain lawfully in New Zealand while they find a new job.

People whose initial MEPV expires up to and including 30 November 2024, will have until 30 October to apply for a second MEPV if they wish to do so.

Other changes include:

(-) clarifying that situations involving lawful employment terminations, non-payment of final wages due to liquidation and redundancies do not meet the definition of migrant exploitation
(-) refining the definition of migrant exploitation to specify that exploitation must be linked to a genuine employment relationship.

The summer holiday months are an incredibly busy time for Immigration New Zealand (INZ). There is an increase in volume of visa applications from people who want to spend Christmas and New Year's with their loved ones in Aotearoa New Zealand, or want to explore the beautiful country.

INZ had made an announcement that anyone who is planning to travel to New Zealand for Christmas should submit their application no later than 15 October 2024. If you are travelling in the New Year, including Chinese Lunar New Year, you should submit your application no later than 15 November 2024.

Applications submitted after these dates may not be processed in time for your intended travel date.

Accredited Employer Work Visa (AEWV)

The AEWV is the main temporary work visa in New Zealand.

It is designed to ensure New Zealanders are first in line for jobs and makes it easier for employers to hire skilled migrants where genuine skill or labour shortages exist.

The Accreditation Process - before employers can invite a worker to apply for an AEWV they must apply to INZ for employer accreditation, advertise the role if they need to, and apply for a Job Check.

Under the AEWV there are a range of verification steps at the application process through the accreditation, Job Check and work visa steps, as well as post-accreditation checks.

INZ constantly review and adjust their settings to ensure they are fit for purpose and strike the right balance between bringing in the migrants that New Zealand needs and protecting the integrity of the immigration system.

It also helps combat migrant exploitation by ensuring only employers who are accredited can hire migrant workers.
