Paano ang paglilipat ng titulo ng nabiling lote mula sa isang subdivision project na nagbebenta ng "raw lots" na nabili nila sa isang online offer sa pamamagitan ng straight installment na pagbabayad?

Sagutin natin ito ayon sa elemento ng Real Estate Practice:

Raw Lots - ito ang katawagan ng marami sa lote na ibinibenta sa murang halaga, dahil walang development na ipatutupad at hindi naayon sa batas ng gobyerno ang paraan ng bentahan o transaction.

Installment - mayroong batas na nagtatakda para sa installment ng nabiling real estate sa Pilipinas na umiiral at may bisa pa rin hanggang sa ngayon.

Subdivision Project - ito ang scheme ng lote na ibinibenta batay sa cutting na 100 square meters (more or less) na karaniwang ipinakikita ng mga sellers sa kanilang mga buyers ng lote na kadalasan ay saklaw ng kabuuang ektarya o higit pa.

Irrigated/Irrigable Lands - iwasan ang pagbili ng mga "raw lots" na sakop nitong irrigated/irrigable lands dahil non-negotiable for conversion ang mga lupang nasa ganitong klasipikasyon o hindi pinahihintulutan ng batas na ito ay gawing isang pamayanan o residential community.

Pagpapatitulo - kung galing sa isang scheme subdivided lots or "raw lots" ang nabili ay dadaan pa rin ito at dapat idaan pa rin sa sa tamang proseso ang bentahan kung tawagin DEVELOPMENT na itinatadhana ng batas bago ito maililipat sa pangalan ng mismong buyer ng lote.

Para protektahan ang mga buyers sa nakakatukso murang halaga ng lote ay maaaring sangguniin ang RA 9646, PD 957, BP 220, RA 6657 at ibang administrative orders at applicable na batas kaugnay ng isinasagawang subdivision project o maaring kumunsulta sa isang licensed/registered Real Estate Practitioner bago bumili ng lote na pinapangarap.

You can only call it clean title IF;

โญ• Owners that appears in the title of the property are still ALIVE & CAN SIGN documents
โญ• NO disputes attached in the title AND โ€œcertified true copyโ€ of the title.
Please take note of the โ€œANDโ€ because not all disputes are printed in the original title itself. Thus, it is very important to request for the latest certified true copy of the title.
โญ• All real estate taxes are paid on time. Always request for latest real estate tax clearance.
โญ• The owners are married (on or after 1987) The property is considered conjugal even if only one property owner is in the title. Both should sign sale documents. Should the property owner dies, heirs should file and pay for the estate tax of all the properties.
โญ• The property estate taxes are not yet paid, the property cannot be called โ€œCLEANโ€.
โญ• Magkaiba po ang real estate tax na binabayaran ninyo annually at ang estate tax (BIR FORM 1801) You only pay estate tax if the owner in the title is already dead. Penalties (like big penalties) apply for late filing.
