"USCIS has reached the congressionally mandated H-2B cap for the second half of FY 2024, affecting petitions for new cap-subject H-2B workers. However, exemptions remain for certain categories, including current H-2B workers seeking extensions or changes to employment terms, fish roe processors and technicians, and workers in the Northern Mariana Islands and Guam.
What does this Mean?
For employers in the Northern Triangle countries of El Salvador, Guatemala, Honduras, and Haiti, among others, USCIS will begin accepting petitions from April 1, 2024, to Sept. 30, 2024, starting on March 22, 2024. This presents a crucial opportunity for businesses seeking workers from these regions to secure visas.
Additionally, returning workers, regardless of nationality, have access to supplemental visa allocations. USCIS will accept petitions for 19,000 returning workers for the early second half of FY 2024 (April 1 to May 14) starting on March 22, 2024, and for 5,000 returning workers for the late second half of FY 2024 (May 15 to Sept. 30) starting on April 22, 2024.
Employers interested in utilizing these supplemental visa allocations are urged to act promptly to secure the needed workforce.
