August 17th is quickly approaching when buyer agent commissions will be removed from all MLSs nationwide!The first big brokerage, eXp Realty, is shaking up the real estate industry by stepping away from traditional broker-to-broker buyer agent compensation stated on listing agreements.I totally understand this standpoint from a CEOs perspective where you want to take all the risk off the table. It’s easy to Monday morning quarterback this thing, but when you are the CEO and you have to write $25M, $50M, and $100M checks to sellers and lawyers you may think differently. However, I think it is a little too far. I think the problem can be solved by doing two very easy things on listing agreements.1. Clearly separate listing and buyer’s agent commissions on your listing agreement and give sellers total control on what to put there. Falaya has been doing this since our launch. 2. This is the most important piece that I think most brokers aren’t thinking about. Brokers need to give sellers choice on whether to disclose the buyer agent commission prior to the agreement stage or openly advertise it before offers. This is key, because if not for the free will…. Sellers could come back and say you pushed them to inflate the commission down the road. The lawyers smell blood and cash in the water. It is what it is. The key to all of this is transparency and control. Two of Falaya core values. It’s official the real estate world is changed forever!
Buyer’s Agent commissions are no longer placed on the Lafayette MLS.
We listed a property yesterday right after the rules changed, and we have already received requests from agents wanting to know the buyers agent commission prior to touring.
Is disclosing this prior to the tours or offers in the best interest of our sellers from a negotiating standpoint point? I would say no.
What if the buyers agent was only going to ask for 2%, but you told them 3%. What if at the closing table the buyer says I can’t believe you offered 3%, I was only going to put 2% on this agreement. It’s a slippery slope, and agents could end up in a weird spot if they don’t take the right action today with standard operating procedures.
On an expensive house, the difference could be significant enough to land you in a lawsuit.
Agents need to create SOPs for listings today. What are you allowed to disclose? What did your seller agree to?
Buyers agent have to get rep agreements in place today, not next month. Agents need to get used to writing the commission your buyers agreed to on the purchase agreement.
The Genie is out of the bottle, and you will not get your commission from the listing agent. You will get your commission from your buyers through the buyer rep agreement.
