In Illinois, there are four specific circumstances under which a marriage can be declared invalid (formerly known as annulment). These include situations where:

1) One party lacked the capacity to consent to the marriage, such as mental incapacity or being under the influence of incapacitating substances;

2) One party is physically unable to consummate the marriage, and the other party was unaware of this;

3) Marriage to a minor was done without proper consent;

4) The marriage is prohibited, such as marrying a close relative or someone who is already married.

A: “I am frequently asked by clients whether they should be talking to their spouse outside the presence of their lawyers. We call this ‘kitchen table conversations.’ I like to tell people it’s fine to do that, just don’t overshare. Hold back, listen to what you’re hearing from your spouse, hold on to that, and report that to your lawyer to brainstorm what, if anything, to do with that information. Do not cut a side deal. Inevitably, it will come back and it will look like the lawyers are trying to make something out of nothing, when the reality is we are trying to make a whole package for you. Sitting down with Partner Cory E. Osh*ta, we asked one of your frequently asked questions. Q: What is the difference between a divorce and an annulment? A: “The difference between a divorce and an annulment is simple. The difference is a divorce means your marriage is ending and annulment means your marriage never really started. In order for your marriage to be valid, there has to be several different things and if these conditions aren’t present, it means your marriage was never valid. So, the things that would allow someone to annul their marriage is if one of the parties of a marriage could not give consent: they were forced, or they were under the influence, or they were under the age of 18 and didn’t have the consent of a parent. Another thing that may trigger the annulment of a marriage is if one of the spouses was unable to have sexual intercourse and this was not known at the time of the marriage. Another one is if the marriage was illegal, meaning if one of the parties was already married. So, those are some circumstances in which your marriage can be annulled because it was never actually legally formed.
