USCIS Requirements to become applicants of the K1 FIANCEE VISA. Update - 2019 For any couple who is thinking about going the route of getting a K1 Fiance(e) visa from the Philippines to the USA, you need to know the USCIS requirements. Only U.S. Citizens can Petition an Alien Fiancee, Green Card Holders are not qualified until they become Naturalized U.S.Citizens. The rules are strict even for U.S.Citizen sponsors, so make sure you understand how USCIS operates before trying this alone. - Both must have met in person & spent quality time together. Then you must file your I-129F Petition for Alien Fiancee before two years has gone past since your meeting in person date. - Both must be of a legal age according to their Country, or states rules for marriage. - Both must be free to “marry”. If applicable you must provide certified divorce decrees, annulment paper work or death certificates of “ALL” previous marriages. - Both should follow IMBRA guidelines if either has committed certain crimes crimes at anytime of their lives even if records had been sealed or expunged by a judge or court. - Both the sponsor & beneficiary must have not exceeded the aloud times of using the K1 Fiance(e) Visa. - Certain types of attempts & denials either with US or other Country Embassies in getting visas need further looking at. - The sponsor must meet the USCIS poverty guidelines & tax filing guidelines. - Both sponsor & beneficiary must have at least met & filed the I-129F Petition all within two years. - The beneficiary must be able to get a passport. - The beneficiary must be able to provide certified birth certificates. - The beneficiary must be able to provide NBI Clearance & if applicable other Country police records. - The beneficiary must be able to provide a civil status certificate of proof of singleness (CENOMAR). - The beneficiary must be able to pass a US Government clinical examination in Manila Philippines. St. Luke’s. - The beneficiary must be able to attend CFO – SMELF or PRISM pre-departure orientation seminar. - The beneficiary must be able to read, write & speak the English language.
