If you are in the midst of a divorce and cannot agree on several issues with your soon to be former spouse, a family court may have to step in and make decisions for you. This can lead to a custody plan you do not favor or a division of property that isn’t what you had hoped for.

Going this route as opposed to mediation can negatively impact you because…

❌ The trial can involve presenting highly personal and disparaging information in open court.

❌ The trial can delay a divorce.

❌ Your legal fees can increase significantly if you need to go to trial.

Work with Irwin & Irwin to determine if mediation could be an option for you.

There is a common misconception that spousal abuse ONLY includes physical violence from one spouse to another. However, this is not the case. Spousal abuse includes any form of violence or harassing behavior that makes the victim feel fearful for their safety and wellbeing.

Spousal abuse includes actions like punching walls, verbal threats, harassing calls/texts, social media threats and more. If you or someone you know needs legal help navigating the court system and bringing justice to an abuser, contact us today.

In California, custody of a child will be determined by making decisions that are in the best interest of the child. Some of the conditions that judges consider include:

☑️ The health, safety, and welfare of the minor child.

☑️ Any history of abuse committed by the person seeking custody against a family member.

☑️ The nature and frequency of contact between the parents and the child.

☑️ Dru and alcohol use by either parent.

California law requires spouses to address and resolve a number of issues before their marriage can be declared legally over.

Some of these issues include how to divide marital property, how to share custody of children, and whether one spouse will provide financial support to the other. Reaching agreements on these matters via mediation is one of the most preferable and cost-effective ways to go.

If you have been living with an agreeable child custody arrangement it can be a bit unnerving to approach your ex-spouse about moving out of the state.

There are legal mechanisms in place that can help you find the right path forward, however custody concerns related to moving out of state are far too complex to leave to chance if the other parent opposes the move.

In California, when a spouse receiving alimony payments remarries or enters into a domestic partnership, the support payments end.

Though this is the typical outcome, it can be helpful to have a family law attorney review alimony orders and martial settlements to determine whether you may lawfully cease spousal support payments.

Even if your domestic abuser does not have a jail record, you can still prove to a judge that domestic violence occurred with an order of protection. However, orders of protection are not always easy to obtain so it is best to consult with an experienced attorney who can coordinate this effort on your behalf.
