⁉ DO FOREIGN WORKERS NEED TO APPLY FOR A WORK PERMIT WHEN MOVING INTERNALLY WITHIN A COMPANY?

According to Clause 1, Article 3 of Decree 152/2020/ND-CP, foreign workers are considered to be moving internally within a company when they meet the following conditions:

✅ The worker is a manager, executive, specialist, or technical employee;
✅ The worker has been employed by the foreign company for at least 12 months;
✅ The company which the worker is moving to is a commercial presence of the foreign company in Vietnam.

⁉ So, do foreign workers moving internally within a company need to apply a work permit?

👉 According to Clause 3, Article 7 of Decree 152/2020/ND-CP, foreign workers "moving internally within a company in the scope of 11 service industries committed by Vietnam to the World Trade Organization, including: business, information, construction, distribution, education, environment, finance, healthcare, tourism, entertainment, and transportation" will NOT require a work permit.

👉 In this case, the foreign worker needs their employer to carry out the procedure to confirm that the worker is not subject to work permit requirements.

The employer must prepare the following documents according to Clause 3, Article 8:

✅ A written request for confirmation that the foreign worker is not subject to a work permit, using Form No. 09/PLI in Appendix I issued with this Decree;
✅ A health certificate or health examination certificate as prescribed in Clause 2, Article 9 of Decree 152/2020/ND-CP;
✅ A document approving the need to employ the foreign worker, except in cases where there is no need to determine the necessity of employing a foreign worker;
✅ A certified copy of a valid passport as per legal regulations;
✅ Documents proving that the foreign worker is not subject to a work permit.

Foreigners holding work visas and temporarily residing in Vietnam who wish to extend their stay must apply for a visa extension. So, what documents are needed for this process? Let’s explore this with G.I.A CORP!

👉 The application for extending a work visa for foreigners includes:

1. The original passport of the foreigner, which must be valid.
2. A visa extension application form, according to Form NA5.
3. A work permit or a document exempting from a work permit.
4. A temporary residence confirmation issued by the local police where the foreigner is residing in Vietnam.
5. A letter of introduction for the staff member submitting the application.
