📍DO FOREIGNERS WORKING IN VIETNAM FOR LESS THAN 3 MONTHS NEED A WORK PERMIT?
🔻 Depending on the nature of the job, many foreigners may intend to work in Vietnam for a short period. However, not all cases require a work permit. Whether a work permit is necessary depends on the duration of the employment and the type of work the employee will be doing. Let’s explore the regulations on work permits for foreigners in this situation and the necessary information to ensure compliance with the law!
🔻According to Article 7 of Decree 152/2020/ND-CP on cases where foreign workers are exempt from obtaining a work permit, foreign workers coming to Vietnam to work in managerial, executive, expert, or technical roles for less than 30 days and not exceeding 3 times within 1 year are exempt from needing a work permit. The following conditions must also be met:
The working time of less than 3 months is calculated from the moment the foreign worker starts working in Vietnam, and it is the total accumulated time within a continuous 12-month period. This means that the total working time of the foreign worker in Vietnam will be aggregated over 12 months.
The foreign worker must be employed in positions such as expert, manager, executive director, or technical worker.
The stay in Vietnam for each assignment should be under 30 days.
