In order to enter/exit a country, all countries require foreign nationals to have a valid passport. But what happens if someone wants to enter/exit with a passport that is about to expire? Today, G.I.A CORP will help you clarify this situation!

👉According to regulations, Vietnamese citizens with passports that are about to expire (with a validity period of less than 06 months) can still exit the country. As long as they possess intact immigration documents with a valid period, they can perform entry/exit procedures. The first is a Memorandum of Understanding between the Ministry of Transport of Vietnam and the National Development and Reform Commission of China regarding the technical plan for connecting the Lao Cai station (Vietnam) and the Hekou North station (China). The second is a Working Document between the Ministry of Transport of Vietnam and the National Administration of International Development Cooperation of China for the field survey and feasibility study for the aid project to plan the standard gauge railway routes from D**g Dang to Hanoi and from Mong Cai to Ha Long to Hai Phong. Both railway lines play a significant role in:

⁉ DO FOREIGN WORKERS NEED TO APPLY FOR A WORK PERMIT WHEN MOVING INTERNALLY WITHIN A COMPANY?

According to Clause 1, Article 3 of Decree 152/2020/ND-CP, foreign workers are considered to be moving internally within a company when they meet the following conditions:

✅ The worker is a manager, executive, specialist, or technical employee;
✅ The worker has been employed by the foreign company for at least 12 months;
✅ The company which the worker is moving to is a commercial presence of the foreign company in Vietnam.

⁉ So, do foreign workers moving internally within a company need to apply a work permit?

👉 According to Clause 3, Article 7 of Decree 152/2020/ND-CP, foreign workers "moving internally within a company in the scope of 11 service industries committed by Vietnam to the World Trade Organization, including: business, information, construction, distribution, education, environment, finance, healthcare, tourism, entertainment, and transportation" will NOT require a work permit.

👉 In this case, the foreign worker needs their employer to carry out the procedure to confirm that the worker is not subject to work permit requirements.

The employer must prepare the following documents according to Clause 3, Article 8:

✅ A written request for confirmation that the foreign worker is not subject to a work permit, using Form No. 09/PLI in Appendix I issued with this Decree;
✅ A health certificate or health examination certificate as prescribed in Clause 2, Article 9 of Decree 152/2020/ND-CP;
✅ A document approving the need to employ the foreign worker, except in cases where there is no need to determine the necessity of employing a foreign worker;
✅ A certified copy of a valid passport as per legal regulations;
✅ Documents proving that the foreign worker is not subject to a work permit.

✅ A notarized copy of the foreign worker’s passport and visa;
✅ A certificate proving investor status or a capital contribution certificate;
✅ 2 color photos sized 4×6.

The application will be submitted to the Ministry of Labor, Invalids and Social Affairs. The processing time is usually 5 working days from the date of receipt of the application.

As Vietnam continues to integrate and develop, it has become a popular destination for many international students. With reasonable living and study costs, many students are keen to build their careers in Vietnam. The question arises: Do international students in Vietnam need to obtain a work permit?

1. For International Students Who Work While Studying

According to Clause 10, Article 7 of Decree No. 152/2020/ND-CP, foreign workers who do NOT need a work permit include:

Students who are studying at foreign institutions and have internship agreements with agencies, organizations, or businesses in Vietnam.
Trainees or apprentices on Vietnamese ships.

👉 Therefore, if you are an international student working while studying, you do not need to apply for a work permit.

2. For Graduated International Students Who Stay to Work in Vietnam

For international students who have graduated and wish to work in Vietnam, companies hiring foreign personnel MUST follow the procedure to apply for a work permit as stipulated in Article 9 of Decree No. 152/2020/ND-CP.
