California Seeking Ban on Gun Ads

California Youth Duck Hunter - California Seeking Ban on Gun AdsCalifornia lawmakers aren’t satisfied with squashing Second Amendment rights. They’re now targeting the firearm industry’s First Amendment rights. The legislation, AB 2571, would prohibit any person or entity from publishing materials in any medium that might make fi****ms attractive to minors, even though minors are forbidden by state and federal law from purchasing fi****ms. The bill would also prevent video games from displaying fi****ms. Advertising that is “attractive to minors” is distinctly vague. “Commercial speech is still protected speech,” said NSSF’s Mark Oliva to Bearing Arms, adding, “California’s bought-and-paid for gun control politicians might find it disagreeable that parents actually teach their children safe and responsible firearm ownership, but that is a reality, albeit one they are attempting to erase.”

Calif. Gov. Newsom Announces Legislation to Attack Gun Industry

Gov. NewsomCalifornia’s Democratic Gov. Gavin Newsom announced the introduction of Assembly Bill 1594, a bill that would allow California’s attorney general and private citizens to sue firearm manufacturers and other businesses for what is being described as a failure to take “reasonable efforts to prevent their products from being used unlawfully.” Those efforts were undefined. The legislation would run into conflict with the federal Protection of Lawful Commerce in Arms Act (PLCAA) that restricts lawsuits against firearm business for the criminal actions of non-associated third parties. This is yet another example of Gov. Newsom’s unwillingness to enforce criminal laws in his state and attempting to shift blame to firearm business that operate within the laws and regulations governing the sale of fi****ms. No one in California can obtain a firearm without an FBI National Instant Criminal Background Check System (NICS) verification. The firearm industry already has partner programs with the Bureau of Alcohol, To***co, Fi****ms and Explosives (ATF) to prevent fi****ms from being obtained by prohibited individuals. NSSF will vigorously oppose this legislation.

Calif. Mag Ban on Hold, Pending SCOTUS Review

MagazineA California law banning the possession of magazines capable of holding more than 10 rounds of ammunition has been put on hold pending the U.S. Supreme Court consideration of the case. The U.S. Court of Appeals for the Ninth Circuit ruled 7-4 in an en banc hearing to uphold the law, however the California Rifle & Pistol Association and several gun rights groups filed suit against the ban, stating the law violates their Constitutional right to self-defense and makes criminals out of otherwise law-abiding citizens. Now the Ninth Circuit agreed to the groups’ request to stay the possession part of the law for 150 days to allow time for a writ of certiorari to be filed. If the petition is filed during that period, the stay will be extended until the U.S. Supreme Court makes a determination as to whether it will consider the case. U.S. District Judge Roger Benitez had previously struck down the law as unconstitutional.

California Legislature Reintroduces Firearm & Ammunition Tax and More

Ammo TaxPrior to the legislative deadline in California, the legislature introduced a handful of anti-industry bills. NSSF already reported on SB 264, which would ban gun shows on state-owned property and the withdrawn SB 252, which would have banned bear hunting in the state. This week, AB 311, which prohibits the sale or display of precursor firearm parts, and AB 1223, which imposes an additional excise tax of $25 for firearm sales and a percentage on ammunition sales that would be determined at a later date, were introduced. These concepts are not new to California and the tax failed as recently as 2020. NSSF’s Government Relations team will continue to monitor these bills and work to defeat them during this legislative session.

Full Court Rehearing Granted in California’s Magazine Ban, MSR Ban Case on Hold

MagazineThe U.S. Court of Appeals for the Ninth Circuit granted an en banc review, or a rehearing of Duncan v Becerra, the challenge to California’s ban on standard capacity magazines. The decision vacated the three-judge panel’s decision to uphold a lower court ruling that the state’s ban on magazines holding more than 10 rounds is unconstitutional. NSSF will again file an amicus brief in support of the plaintiffs, as we did before when the case was argued before the three-judge panel. The same court is holding Rupp v Becerra, a challenge to California’s ban on modern sporting rifles (MSRs) in abeyance until Duncan v Becerra is decided.
