A CASE WE DIDN'T TAKE:

My firm recently received an inquiry from a traveler who was injured in an encounter with a wild animal while traveling in Africa. The traveler was inquiring whether we’d be willing to represent her in a lawsuit against the tour operator, the owner of the accommodations where the lawsuit happened and…

…her travel advisor.

In the inquiry, she remarked that she had been referred to the tour operator by a travel advisor, and said, “she put us in touch with the outfit below. I suspect [she] got compensation for the trip.”

We didn’t take the case for a variety of reasons, not the least of which is that the booking agent should in no way, shape or form be liable for an accident like this.

But this example reinforces a few things for us:

1) it’s critically important for every agency to have a rock-solid terms and conditions document with a disclaimer of responsibility and limitation on damages provision;

2) If you hold yourself as an expert in a particular type of travel — safaris, wellness, culinary, adventure travel — you’ll want to make sure that your T&Cs disclaim specialized knowledge of risk; and

3) Don’t turn yourself into a tour operator — staying in your lane as a booking agent is the thing that protects you the most from having to deal with a lawsuit from a client who wants to sue everyone and anyone.
